The meeting was Called to order at 7:OO p,m, by Chairman Robert
Sutton, The present bexldes Chairman Sutton were Col, R. M. Smith,
H. H, Barter, J, B. Bond, Arnie Stringer, Col, Gronseth and Mayor
McClellan, Absent: Tom Acuna,
The minutes of the last meeting were read and approved,
A hearing was held at 7:lO p.m. on the application of Trona and
Imogene Munoz for a zone variance for two side yard variances from
10 feet to 85 feet on property located between 1158 and 1212 Oak
Avenue, Carlabad, California. Letter of' protest was read by See,
Smith which was received from Major General W. A. Worten and Mrs.
Wortan, Discussion followed regarding error in the advertisement
of public hearing, Mr. &unoz stated his reasons for requesting Cha
variances and reported that Mr, Nelson the architect who drew the
plana had told them they walxld have to ask for a zone variance which
would be a simple matter. Discussion followed regarding the architect
violatine; Ordinance 9005 and it was suggested by Arnie Stringer that
Col. Smith prlspare a'statement to be published in the paper that all
plans dram up by Architect's and Buildem mpst comply with the City's
Zoning Code. After much discussion, it was moved by Col. Smith and
seconded by J. €3. Bond, that recommendation be made to the City
Council tha t the request of Treno & Ymogene Munoz for two side yard
variances from 10 feet to 89 feet be granted and be it furth:?r
explained in the recommendation to the Council that the variance
requested is not the same as advertised %ut a lesser variance than
was indicated in the adTrertisernent. All ayes. Yotion carried,
A hesring was held at 7:45 p.m. on the application of 0. L.
Killian for a zone variance for a 5 foot set back from the \vest Alley
on property described as: hts 17 and 18, Block 38, Carlsbad Townsite.
Discussion followed, Col. Smith moved that in view of the fact that
Mr. Killian meets the requirements for the building he intends as
set forth in Ordinance 9005 that it be recommended to the City Council
that no action be taken on his request for a variance and in addition
since the City incurred lhe cost of two advert3sements in this case
that orly half of the $10.00 fee be returned to Mr. Yillian. Seconded
by Mr. Bond. All ayes. Motion Carried.
A hearinc was held :It 8:lS p.m. on the application of CUud R.
and $retchen Helton to permit a reduction of building Site area from
6000 sq. ft. to 5750 sq. ft. on the following described Pmpdrty:
Lot 1 in Block R of Palisades No. 2. Col. Gronseth moved that the
application described aboTre be eranted. Seconded by Mr. Bond.
Discussion took place regarding side yard set back on the two existing
houses. Mpb vote was taken and instead it was decided to continue
this hearfne: until December 8, 1952 meeting SO that b. Helton will
be present.
A hearing was held at 8:30 p.m. on the application of Alton A.
& ,largaret v. Gladden to rezom a portion of Tract 99, Carlsbad Lands
from R-2 to R-3 and also a hearicg at the iniation of the Carlabad
Planning Commission to rezone a portion of Tract 98, Block 16, Carlsbad
Lands from R-2 to R-3 and all areas in Tract 98 not presently C-1,
from R-2 to C-1. col. Smith moved that recom.cndation be made to the
City Council that the reclassification of property requested by
Alton A. & Margaret V. Gladden and the CaFlsSad City Planning Commission
as described above be granted. Seconded by Arnie Stringer. A11 ayes.
Motion carried.
Col. Gronseth reported that he has not yet heard from League
of California Cities regarding minimum floor area requirements. ' He
also reported that he had snoken with the Building Inspector of San
Diego regarding t'nia matter and he stated that San Diego has no minimum
floor area requirements. They are presently opposed to any limita-
tion in floor area except as provided in the Uniform Building Coda.

Col. nronseth stated that the San biego Building Inspector saggastad
to him th-at if Carlsbad provides a minimum floor area for dwellings
it be exclusive of floor space devoted to auxiliary uses such as gar-
ages, open porches, breezeways, etc. Col. Gronseth also reported that
he spoke with Mr. Radcliff, Building Inspector of Oceanside yeparding
this matter and it was reported that Oceanside has a minimum floor
area requirement in av R-1 zone only which requires 750 sq. ft., and

mit cooking facilities. As far as the minimum floor area requirements
in the two catogories of apartment houses and mest houses covered
in the Uniform Building Code requirements are 120 sq. ft, for a livin&
room in apartment houses and guest houses and 80 sa. ft. in tE1.e sleep-
inr room, Col, Gronseth will obtain copies of zoning ordinance from
Ocaanside. It was also suggested that copies of the State %using
Act should be obtained,
Col, Gronseth mooed that the hearing on minimum floor area
requirement3 be continued and fwther study of this be made. CiQ
Council to be notified of the continuation of this hearing. Seconded
by Col. Smith. A11 ayes. Hotion carried.
Col. Smith outlined in brief the letter received from Benjamin
and Adeline E. Taylor regarding a petition for the vacation of a por-
tion of the westerly 15 feet of Ocean Street at Terminus of Oak Avenue
in Carlsbad, California. It was sug-ested this letter be referred to
the City Council,
Sec. Smith neviewed the application of Carl and Natalie B. Manos
of 952 Elm Street requesting a zone change from R-1 to R-2 to permit
the construction nf a duplex on the followfnp described property:
North side of Elm Avenue, 160 feet East of TTarding Street, being a
option of Tract 117, Carlsbad Lands, k". Stringer moved a hewing

Sec. Smith read a letter from Willis H. Miller, Director of
Planning, County of San Diego, PLarkning Department reauesting us to
sdlect a representative for the Steering Department. Col. Gronseth
moved that Robert NI. Su",ton be appointed to 8c.t; 83 representative on
the Steering Committee. Seconded by b. Stringer. All ayes. Motion
carried. City Clerk Hagen will notify Mr. Miller,
Letter from Art Snyder regarding the removsl of a tree and
trimming of other trees on his property located at Grand and Madison
Streets was discussed, Col. .Frdns&,EU to table this matter until moved
December 8, 1952 Planning Commission Meeting in order for the Tree
Committee to meet prior to the next meeting to discuss this matter.

Seconded by Mr. Stringer. A11 ayes, Motion carried.
The Palm Vista Tentative Subdivision Map was discussed at
length. It was noved by Col, Smith and seconded by Col. Cronseth
that recommendation be made to the City council to approve the tenta-
tive map of Palm Vista as submitted by Gallinger Construction Company
with the following exceptions: Width of travel way of Macnolia and
Jefferson Street to be 40 feet instead of 36 feet, with curb on
easterly side of Jefferson Strest and south side of Magolia Street,
fourteen feet from property line. The variation in set back on the
east side of Harding is not recommndad at this tine. Attention of
the Council is invited to the ?rainage easement which traverses the
subdivision. All ayes. bylayor LIcClellan absent, &lotion carried.
There being no further business to come before the meeting,
the meeting was adioumed at 11:20 p,m.
