Present besides the chairman were Commissioners Bond, Gronseth, Sutton, Stringer, Mayor McClellan and Public Works Director Barter* Col. Gronseth moved, Mr. Sutton seconded, that reading of the minutes of April 13th be waived. Notice of Public Hearing was read on the application of E. Thacher for reclassification from E-2 to R-1B of M area described as follows: north baundary, Tamrack Street; east boundary, California State Highway XI-SD-2B, south boundary, the southern boundary of ThUm Lands; neat boundary, the center of the Atchison, Topeka & Santa Fe Railroad right- of=way. A letter of protest from Thaddeus A. and brtha Ruszinski was read, the basis of their protest being the possibility of a tax increase as a result of reclassification. Col. Gronseth repoPted that Everett Ogborn, who had been one of the signers of 8 letter supporting the peti- tion, had stated that he was agreeable to rezoning to R-1 but opposed to rezoning to R-1B. Mr. Thqcher waa present, also Elwoo6 Trask, omer of adjoining property, In support of the petition. Mr. Thacher stated that his plan is to divide the property into 60 x 120 lots instead of the minimum 6000-square-foot lots. The question of ahi increase in taxea as a result Qf reeonin@; was 8isCuSse8, and it was felt that since the basis Of tax valuation is the market value of the property, subdivision &#vel- oprneat may have a tendency to paise the value of the adjoining property and conseqmntly the tax rate, but rezoning itself would not affect the tax rate. An application for reclassification to R-2 of an area just north of Chinquapin, between Jefferson and the freeway, was introduced as possibly having a bearing on the present matter. Yr, Thacher and Mr. Traak both stated that they would be pppoeed to R-2 for this area. After discussion, Mr. Suttm moved that the Planning Comnission Pacormnand to the City Council that the application of E. Thacher for reclassification from E-2 to R-1B of the area described in the Notice, be approved, Seconded by Mr. Bond. All ayes, motion carried. Time of hearing, 20 minutes. Secretary Stringer read the Notice of Public haring on the appli; cation of R. H. and Jane Sonnernan, and the request of the Planning -1- Commission, for rezoning from R-2 to C-1 of 100 feet on both aides of Elm Avenue from the area presently zoned C-1 to California Highway XI-SD-2B. There were no protests, Col. Gronseth moved that a recom- mendation be made to the City Council to adopt the proposed eone'change from R-2 to C-1 of tho property on Elm Avgnue, as advertised, Seconded by Mrr Stringer, All ayes, motion carried. Tjme of hearing, 10 minutes. Secretary Stringer read the request of Manuel Flares, 3155 Roose- velt Street, for variance to permit side yard reduction on both sides from 5 feet to 2fr feet, on property described as Lot 25, Block 33, Carls- bad Townsite. Mr. Barter explained that Mr. Flores has an erfstkg building which has no foundation, whlch is 40 inches from the property line on one side and 20 inches on the other, which he proposes to raise and put on a foundation, centering It 2h feet from each side line. Mr. Sutton moved that a hearing be set on May 11th at 7:OO p. m, on the ap- plication of Manuel Florea for reduction of both side yard8 from 5 feet to 29 feet, Seconded by Mr. Bond. All ayes, motion carried, The matter of the Foster & Kleiser letter asking that outdoor advertiaing be declared a permitted use in Zones C=1, ($2, Mol and L2, was reviewed. During discussion It was suggested that all signs except those in connection with an owner's business, on his own property, be prohibited, but it was brou- out that such an ordinance would work a hardship on businesses such as hotels, restaurants, motels, etc., which depend largely on the traveling public for their income. Col. G,onseth moved that the question of signs be referred to the City Attorney for interpretation as to the legality of excluding certain signs and per- mitting aiwr of businesses within the City, with theJ requost that- he render an opinion on which the Commission my act at ita next meting, Seconded by Mr. Sut ton, All ayes, motion carrie8. - Mr. Sidney Fuller, residing on Valley Street, asked whether the master plan of streets contemplated extending Elm Avenue through Tpaot 119 of Carlsbad Lands, from the angle with Elmwood through to Valley, The master plan map was studied and the tentative extension of Elm Avenue on a curve through that area explained to Mr. Fuller, with ths information that the map was subject change. Mr. Fuller was advised to contact his neighbors to ascertain if they were willing to dedicate part of their lan& to the City for a street, and then come in to the Planning Cornmisston with -2- the offer. Secretary Stringer read EL memorandum Prom the City Clerk advising of a question raised by W. W, Rogers as to the 10-foot side yard require- ment in Zone R-lB being excessive on a 50-foot minimum frcmtage building site. The pertinent section of the ordinance was read, and, after ais- cussion, Mr. Stringer moved that a recommendation be made to tb City Council that Sections 6 and 7 of Ordinance 9018 be amended to provide for the same side and rear yard setbacks in Zone R-1B as in Zone R-2, Seconded by Col, Gronseth; all ayes, motion carried. It waa agreed that the City Clerk be requested to notify Gen. Rogers of the action taken. Secretary Stringer reviewed memrmdum from the City c~unoil ask- ing that an amendment to Ordinance 9025, providing for minimm width of streets in exceptional cases, be considered and recornmendeb to the Council. After discussion, Mr. Strhger moved that a recommendation be made to the City Council to adopt an amendment to Ordinance 9025 providing that a local street which the Planning Cormsdsaion feels aould not became a major street may, at the discretion of the Planning Commission, be 8 minimum of 50 feet wide, Seconded by Col. Gronseth. All ayes, motion carrfed, Secretary Stringer read the appliaation of Gallinger Construction Company and Edwin M, and Nancye Sherman, for reclassification from E-2 to R-2 of a portion of Tract 237 of Thum Lands, to permit erection of two-farnily swellings on 18 lots. Mr. Mcclellan stated that because Mr. E. Ogborn'a property is in the block, he was consulted and asked to join in the petitibn, but had dbclinsd. Mr. Suttun moved that the applica- .i tlon of Gallinger Construction Company, et al, be set for hearing on May 11, at 7:OO p. m. Seconded by Mr. Bond. All ayes, motion carried. The matter of setting hearings on variances wlthout form1 action of the Planning Commission raa discussed. Opinions of the members were divided as to whether this would prove good practice where a Df- rector is not employed. Mr. Sutton suggested that, since he was acoum- lating data on planning practices over the County and this question was included in the questionnaire, it might be well to defer action until all the answers were received, It was agreed that there might be diffi- culty in some cases where irregularities exist which might not be ap- parent at time of filing the application. It was brau&t out, however, that in 901116 instances it would .be possible to speed up rservioe and save - 3- W the applicant as mch as 13 dags. It was agreed to withhold action cm the matter until further data was obtained on the questionnaire. Chairman Smith read the questions and answers on the questiomaire returned by the National City Planning Commission, for the information of the Commission. Secretary Stringer read a letter from Mrs. C. Bo kffaker requesting; that a nal'n8 be given the access road, so that she may have a street ad- dress for her new home which faces this road. After discussion, it was decided to ask the Carlsbad Journal to run a news item stating that sug- gestions from citizens of a name for this road will be welcomed by the Planning Commission, Secretary Strlnger announced a meeting of the Northern San Diego County Associated Chambers of Commerce , to be held on Tuesday evening, April 28th, at the Carlsbad Hotel, at which one topic for diecussion would be a site for a new airpwt, near San Marcos, which spot had been chosen by the CAB after numerous other suggested sites had been turned down by them. Col. Gronseth turned over to the Planning Commission, the map con- taining the suggested Master plan of streets as prepared by his commit- tee, stathg that it represented tbir ideas but could be altered or amended, as it was intended primarily to serve as a basis for street planning. He was given a vote of thanks by the Comnission for the time and effort spent on this proJect, .. Mr. Subtton reported that Dr. Wilcox, who teaches a class in Muni- cipal Government at San Diego State College, had called him and advised that they would be interested in mking an analysis of the Planning De- partment, or would go into any other phase of the Citg Governlnent as desired by the Planning Commission or City Council. & stated he believed Dr. Wilcox wodd come up between now and the end of the school year for a conference . Mr. kttm was requested to keep in contact with Dr. Iilcox and find out what would be a convenient tiae for him, and a special meeting could be set UP. It was suggested that a budget be prepared covering the fi.sca1 Far 1953-54, to be part of the entire City budget, the ftandSto be set up so that the City Clerk would be authorized to disburse them upon rsquest of the Planning Commission. 1.t; was suggested that if such a fund could be - 4- "q set up it might be possible to employ a part-time draftsman to set up records or a part-time director.' It was decided that this should be dme immed.fately. Mr. McClellan stated that he felt that for several reasons it is inadvisable to have a Council member on the Planning Commission, and that he would like to have the Planning Commission recommend that the ordinance be amended to designate another member to take the place of tb Council member. After some discussion, bfr. McClellan moved that the planning Commission recormnend to the Citg Council that the ordin- ance desimating the make-up of the Planning Commission be changed to eliminate the provision that a member of the Council shall be a meniber of tb Planning Commission; that instead., an additional meniber be nmed in the same manner in which other mmbers are named. Seconded by Mr. Sutton. All ayes, motion carried. Mr. Sutton moved that a recommendation be made to the City council that the Planning Commission be composed of aeven appointed members and one or more City employees, and that the seven appointed members only have the vote, and that the City employee serve in an ex-officio capacity. Seconded by Col. Gronseth. All ayes, motion carried. Mr. Sutton moved that the Plannlng Comrnission recommend to the City Council that the City Attorney be instructed to draw up an emr- gency ordinance to remove the allowance of trailer courts in R-4, C-1, C-2 and M-1 zcyles by spec-ial 'pqr'mit from Ordinance 9005. The motion wa.s seconded by/GronBetb,' and discussed at cmsi8erable length, the suggestion being made that possibly the City Council could by resolu- Col. tion suspend granting of special use permits for trailer courts for a specific time, until a Further study could be made and submitted by tb Planning Co~ssion. After furtbr discussion, Mr. Strlnger mvsd that the motion be tabled until &y llth, until a little more study can be given the matter and expressions from the public obtained. Seconded by Mr. Bond. Ayes, Stringer, Bond, McClellan, Barter. Nays, Gronseth, Suttan and Smith. Notion carried. Mr. Sutton moved that a recommendation be made to the city Council that the City Attorney be instructed to draw up an emrgency ordinance to prohibit trailer occupance in the City of Carlsbad, without proper sanitary facilities , and that no tent shall be used as a dwelling in the City of Carlsbad, except on special perMt from the City council Pr$- during the course of construction of 8 permanent dwelling for appli- cantb own use. Seconded by Mr, Bond. A11 ages, motion carried, The thanks and appreciation of the Planning Commission were ex- tended to Mr. McClella&’op his valuable a88istaI3~0 during his term on the Commission, and also to Mr. Sutton For his capable administration as Chairman durkg the term just ended, Mr. McCle11an announced that he had received a letter of reslgna- tlon from R, R. Robinson, newly appointed member, for the reason that he felt hi8 personal and business involvements made it inadvisable for him to serve on the Commission. The resignation was accepted with regret. It was suggested that a member of the Planning Commission attend each City Council meting so that if necessary, he could be consulted as to Planning Cornissfon recomendations. Chairman Smith atated he would begin at the end of the alphabet md work forward, so Ut-. Sutton was asked to attend the meeting of May 5th, with Mr. Stringer as al- ternate in event Mr. Sutton could not be present. Chairman Smith also named Mr. Bond and Cal. Gronseth to prepare the budget, with Mr. Bond acting as chairman, There being no further business to come before the Commission, the meeting was declared adjourned at 10: 30 p, m, Arnie Strmger, Secretary.
