Meeting called to order by Chairman Bond at 7rOO P, H. Present
besides the chairm were Corns'. Helton, Baumgartner, Stringer, Sut-
ton, Cockrill, Building aspector Ewald. Absent ,Corn'. Gronseth,
Public Works Director Barter.
Minutes of the meeting of September 28th were read and approved.
Edward G, Kentner made an oral request for special use permit
to allow erection of three highway advertising signs; one on the
J, 0, Kinman property along the freeway at Knowles Avenue; one on
the B, D. Whitmore property on the Wton Brown Sanctuary; and the
third on the property of Katherue C, Cappe, on Harrison Street,
Hr, Kentner submitted a model of the proposed sign, and explaued
that the sig~s would be illuminated where possible and made as at=
tractive as possible, Comm, Sutton moved that a hearing be set
on October 26th at 7:30 p. m, to oonsider the application of Edward
G, Kentner for special use permit to allow erection of three high-
way advertising sims in Carlsbad. Secamded by Corn. Cockrill.
All ayes, motion carried, Mr.. Kentner was asked to make formal ap-
plication on proper forms, and did so before adjournment of the
meeting. It was agreed that the City Attorney be requested to at-
tend the Ootober 26th meet- to clarify legal aspects of the sign
si tuat ion I
Mr. Ewald reported that a sign ordinmce is being worked on and
that he, Mr. Simmons and the City Attorney would meet on Tuesday
afternoon to discuss it,
Secretary Stringer reviewed the Notice of Public Hearing on the
John Hier application for rezoning from E-2 to B-1 of an area in
Cedar Hills Addition, north of Forest Avenue, which had been tabled
from a previous meeting, Present were Mr. Hier and neighboring prop-
erty owners Edward Yourell, A. V, Dmism, and C. Brodie, A letter
was read from Mrs'. riena Suttm requesting that a written agreement
be executed concerning the constmotion of a street on the east 1lne
of Mr. Hier's property before any recommendation of reclassification
is made, and stating that she is not opposed to the rezoning if the
street matter is determined first', After considerable discussion
it was agreed that affected property owners will et together within
the next two weeks and attempt to work out a solution wWch is agree-
able to all concerned, and bring a recornendation to the Planning Com-
mission prior to November 9th'. Comm, Cockrill moved that the Hier
matter be postponed to November 9th at 8:.00 P, PI', Seconded by Corn,
Helton, All ayes, motion carried,
Secretary Stringer read Notice of Public Hearing on the application
of H. E, Ebright for variance to permit reduction In side yard setback
from 10 feet to 5 feet, on property located on the west side of High-
land Avenue between Pine and Basswood. There were no oral or written
protests'. Corn, Helton kioved that a recommendation be made to the City
Council tbt the request of Ef. E, Ebright for variance be granted, for
ths reason that the property presents topographical irregularities
making conformance to the setbaok requirements very difficult (refer
to Sec, 15.6, Ord-noe 90051.. Seconded by Corn. Cockrill, All ayes,
motion carried.
Secretary Strinmr read a letter from Paderewski, Mitchell and
Dean, Architects, of San Diego, accompanied by sketch of proposed new
four-classroom building on the Jefferson Elementary School site, and
requesting information as to whether a side-yard setback of 4'9" would
be permitted, inasmuch as the school intends to buy the adJoinlng prop-
erty. After some discussion, Corn. Sutton moved that the matter be
referred to the City Attorney for interpretation as to what should be
required, with the comment that in the opinion of the Commission, both
a special use permit and variance are necessary; that the letter be
answered and permit forms enolosed. Seconded by Corn. Stringer. All
ayes, motion oarried.
The Secretary read a letter from San Diego State College, signed by
Robert A, Richardson, stating that they would not be able to make the
proposed planning study of the City of Carlsbad, as Prof , Taylor's
field of experience Is primarily In land use and did not cover the
scope of the desired study,. He suggested that possibly a new approach
could be made through a Political -Science class taught by Prof, Osbom,
to be undertaken during the second semester, The matter of how to pro-
ceed with over-all planning without the assistance of the study -8
discussed at considerable length, and the suggestion made that sub-
committees be set UP to take up the different phases, such as zoning,
street planning, et&, and make recommendations to the Planning Commis-
sion, The suggest1on;was also made that special meetings be held on
alternate Monday nights as a committee of the whole to discuss zoning
and street planning and other proper plamfng matters', It was decided
to hold the first such special meeting on Thursday, October 22n&, at
7 p. I%., at the City Hall. Comm. Stringer moved that a letter be writ-
ten to Robert A. Richardson of San Diego State College stating that
we accept their offer of help in land utilization through Dr. C, Os-
born's Political Soience class, and would appreciate Dr. Osbom coming
to Carlsbad to discuss the matter with the Commission at his earliest
convenience, advising them of the Commission* s regular meeting nights,
Seconded by Corn, Sutton. All ayes, motion carried.
Secretary Stringer read a letter from Byrl Phelps requesting per-
mission to construct a pump-house and storage tank on a portion of Lot
28, Carlsbad Estates, for the purpose of furnishing water to homes 3a
Carlsbad Estates and other nearby high areas'. Corn. Sutton moved that
a hear- be set on October 26th st 8~00 P. El. for special use permit
as requested, subject to the filing of a form1 application in the City
office by the Carlsbad Mutual Water Conpany, prior to time for adver-
tis9ng. Secondea by Comm. Stringer-. All ayes, motion carried.

Seoretary Stringer read Notice of Public Hearing on the applica-
tion of Gallinger Corporation for variance to permit reduction of side
yard setback on 10 lots in Carlsbad Estates, Letter accompanying the
application was also read'. Mr. Tom Galllngpr was present and submitt-
ed plans on the project and explained that everythjlzg possible was
being done to comply with zoning requirements but that 512 order to
present the most attractive appearance, which Is to the City's advan-
tage, it was necessary to apply for the aforesaid varimces. Corn'.
Bau@artner moved that the Commission recommend to ths City Council
that the application af Gallager Corporation for ten variaces as
requested be approved. Seconded by Corn.. Cockrill. Four ayes, no
nays, Corn. Suttan abstainlmg, motion carried'. There were no protests,
oral or written, to the application.
A recommendation from the City Council that the Planning Commission
consider initiating rezoning from B-1 to B-2 of the small trlangular

adjoirzing the property POW in process of rezonag upon the petition of
George and AdalIne frudhome, et al,/ After discussion, Comm, Sutton
moved that a hearing be set at 8:30 p. m. on October 26th, to consider
reclassification from R-1 to B-2 of the paroel of lasd described as the
triangular portion of Tract llj, Carlsbad Lands, on the east side of
Pi0 Pic0 Drive, between Elm and Oak Avenues, lying southwesterly of
Parcel 1 of Assessor's Map Book 35, Page 41, Seconded by Corn. Helton.

Comm', Sutton suggested tht oopies of all ordinances be printed on
x 11 paper, and copies sent to all Planning Commission members.
Comm, Sutton also suggested that maps should be published showing all
zone changes as they occur. Also, that the member of the Planning Com-
mission attendlng the City Council meeting be provided with a copy of
the Plaming Commission m3nutes so that he could be better prepared to
discuss recommendations to the City Council.
Mr. Ewald reported that he, Fire Chief Hardin and Mayor McClellan
are working on fire zones and will probably have something ready by the
next Council meeting.
Seoretary Stringer read Notice of Public Hearing on the application
of Nelv3n and Jeannette Lull, et al, for reclassification from E-2 to
B-1 of an area desdribed as all of Tract 245 except the westerly 150
feet, and all of Tract 250, Thum La.nds'. Written protests from C. C,
Wslters, Mlna Weston MacBeth, B, B, McLaughlin, E, C, Pedley, Jack Lil-
lie, W. H, Syme, Carl Harms, E, A, Storm and A. M. Stow, and H.. 0,
Sylvester, were summarized, A letter of consent listing ten names was
read, but it was explained that the Storms had asked that their names
.be withdrawn from the petition. A chart was made showing names of the
proponents and opponents and the location of their property(. Mr., and
Hrs. Lull were present and stated that of the Protestants had pre-
viously stated their desire to divide their property.
Comm, Sutton moved a 10-miaute recess, seconded by Comni. Helton.
All ayes, motion carried.
ChairrrmaaEE ' Bond reconvened the Commission at gtl0 P, Ms. Corn, Sut-
ton moved that in view of the number of proteats and general sentiment

in the area, the Comission recommend to ths Council that the Lull
applioation be denied. Seconded by Comm. Stringer”. All ayes, motion
carried, The question of refunding the reclassification fee was
brought up, and Mr. Ewald stated that as a taxpayer he protested re-
turning any rezoning fees, as such a practice obviously threw the bur-
den of printing; costs on the City, to be borne by other taxpayers, Mrs’.
Lull stated that she was willing to pay the advertising costs. Nr,
Lull asked that the Planning Commission recommend a clean-up of all
property by the owners and insistence that the weeds be kept down‘.
There being no further business to come before the Commission, Corn’.
Strizlger moved for adjournment at 9:50 P, H, Seoonded by Corn‘. Helton.
