Present besides the Chairman were Comrns, Helton, Cockrill, Baumgartner, Sutton, Stringer, Building Inspector Ewald. Absent, Comm. Gronseth and Public Works Director Barter, Comm, Sutton moved that the minutes of the meeting of December 14th be approved as corrected (with time of meeting inserted). Seconded by Comm. Cockrill, All ayes, motion carried, Secretary Stringer read a letter from Mr. John A. Hier withdrawing his application for reclassification of his property on Forest Avenue froril E-2 to B-1, Comm. Bawngartner moved that Mr. Hier be refunded his money, less any expenses involved in handl3ng the application, this being consistent with the policy followed in the past; that since Mr. Hier's application has been pending since August 5th, the Commission feels that refund should be made. Seconded by Comm, Sutton. All ayes, motion car- ried, Secretary Stringer read a letter from Fir. Horace L, Gilbert of Es- condido regarding formation of the Trailer Court committee, and request- ing that a representative be named to the committee, After discussion, it was decided to defer the appointment to a later meeting, and that a letter should be written Hr, Gilbert so advising him, The Claud Fennel request to vacate the abandoned road described as a portion of Road Survey No, 135 and an 'old Survey No, 43' , lying be- tween Vista Way and the Easterly boundary line of the new State Freeway, was reviewed. Nr. Christiansen was present, representing Mr. Fennel, and located the abandoned road on the map, explaining that the portion of the road which might in the future be used as access to the lagoon was not included in their request. After discussion, Comm, CockriEl moved that a recommendation be made to the City Council, after study of the Fennel request, that the Council proceed along the linea outlined by the City Attorney. Seconded by Comm. Sutton. A11 ayes, motion car- ried, Mr. Christiansen was given a copy of the instructions outlined by the City Attorney and asked to furnish a legal description of the area involved, The applications of Twin lnss, Inc., to rezone to C-1 two small areas, one on the Roy D. Yhibmore property in Tract 1 of Lapa Mesa Tracts, and one on the Katherine Cappe' property in the 4100 block on Harrison Street (portion of Tract 238, Thum Lands) were reviewed and further dis- cussed. Plr, E, G. Kentner of the Twin Inns was present and submitted photographs taken along Pi0 Pgco Drive to substantiate his claim that the illuminated signs which he proposes to erect if granted rezoning, would not be a detriment to the neighborhood nor lower the present standards of the area. He convinced the Commission that he would be u11- able to continue in business if he could not find some means of adver- tising to the traveling public, and that other businesses in Carlsbad who depend upon this type of trade are in a similar predicament. He sug- gested that it might be possible to adopt an ordinancet restrictlng the type and size of signs on the freeway to a certain minimum, which would eliminate any haphazard or cheap sias being erected. He statedthat he would not be in favor of a community sign which would feature a great deal of writing on it, as he felt that the fewer the words, the more readable and therefore the more valuable the sign, City Attorney Bruce Smith was called and asked to come to the meeting. The matter was discussed and it was stated that the Council had author- ized negotiations with the San Diego Gas & Electric Company for a long- term lease. The Secretqry read copy of a letter from the Parks, Recreation, Beach and Tree Commission to Mr. Drury, Chief of the Division of Beaches and Parks, asking that some emergency funds be allocated to save sand de- posits from the San Diego Gas & Electric Company dredging, Mr, maid commented that the first unit of the IkcIna plant will be opened in Octo- ber, and that some intelligent planning should be done in the area in the near future. The map of the San Diego Gas & Electric Company property was studied and the question of zoning and street planning discussed in a general way, including the possibility of a stmet around the north -2 - ~ ~~ " - ~ ~~ ~ i 0 shore of the lagoon, but nothing was agreed upon. Discussed on the Kentner sign matter was resumed upon the arrivd of the City Attorney. Asked whether such an ordinance as was suggested, restricting size and type of structures, would be discriminatory, the City Attorney stated that it would be, and that extreme caution should be ex- ercised, both in the framing and the application of an ordinance as it could be declared discriminatory, either as to the wording or as to the application. He suggested that one method that could be used would be to open up the matter on a short-term discretionary special use permit basis, running for a few months, and then shut down completely when it appears that no more sign permits should be granted, He stated it would be poss- ible to limit the size of the sips permitted but that it would be dangep- ous to establish minimums which would eliminate the small business from benefit%ing because of cost. It was decided that since the matter was so complicated and of such wide public interest, an adjourned meeting should be held, with appropriate newspaper publicity, inviting City Council members, Chamber of Commerce members and anyone else who might wish to atitrend and express themselves on the subject. COW. Sutton moved that the meeting be adjourned to 7:3O P. Ma next Monday evening, January “kt@, and that the Chairman designate someone to notify, either by newspaper or letter or by personal contact, the people who have protested the rezonhlg, that there will be an adjourned meeting; and that the City Cowncil, the City Attorney, the Chamber of Commerce, all be notified of said adjourned meeting and requested to at- tend.
