Present besides the Chairman were Comms. Sutton, Helton, Baumgartner, Stringer, Cockrill, Public Works Director Anthony. Absent, Cod. Gronseth. Comm, Baumgartner moved that reading of the mautes of the meeting of March 8th be waived. Seconded by Corn. Sutton. All ayes, motion car~ied. Chairman Bond read a letter from Mr. G. Miller Parks, planning engineer, advising that he was still available for consultation and planning advice and would like to work with the Planning Commission. It was agreed that no action could be taken at this time, unless Mr. Parks would be willing to meet Informally with tb Commission at no charge to discuss a possible flxture working arrangement. The Secretary read the petition of Eddie and Alioe Vaerquez for variance to permit reduction in front yard and rear yard setback on Lots 42 and 43, Granville Park, located cm Ocean Avenue between Mountain View Drive and Garfield. Due to the extreme shallowness of the lots (approximately 50 feet wide) and the narrow width of Ocean Avenue, it was pointed out that even the maximum legal reduction of 50% would not be sufficient to allow erection of the proposed house, which is laid out on the plot plm to show a distance fsom front building line to property line of 12'6" and in the rear, 4'. There was a great deal of diseussion, during which Comm. Kelton stated that he was reasonably certain that the County had adopted an or- dinance establishing a blanket varlanoe for the small beaOh lot area in questlcm, and it was decided to ask the Citg Attorney to check this poss- ibility. It was also proposed that an R-j zone (Special Beach Lot Dls- trict) be created to take care of the shallm beach lots, fronting on nar- row streets such as Ooem Avenue, with modified setbacks to suit the needs of these particular lots, After discussion, Comm. Sutton moved that a hearing be set for 7230 P. W, on April 12th to consider creation of an B-5 zone (Special Beach Lot District) of the area, now R-2, north of Cedar Street, West of Carlsbad Boulevard, and south of Buena Vista lagocm. Seoonded by Comm. Stringer. All ayes, motion carried. Comm. Sutton moved that the Vasquez petition be tabled. Seconded by Corn'. Helton All ayes, motion czarried. The petition of Andres Trujillo for special use permit to allow con- struction of a churoh in an B-2 zone, was read, the property being described as Lots 27 and 28, Block "Bn, Carlsbad Townsite. Comm, Cockrill moved that a hearing be set on April 12th at 8:3O P. M. to consider the request of Andres Trujillo for special use permit to allow construotlon of a church on Lots 27 and 28, Block "Ba, Carlsbad Townsite, looated on Madison Street between Palm and Magnolia Avenues. Seocmded by Comm, Sutton, All ayes, motion carried, Seoretary Stringer read Notice of Public Hearing on the application of Twin Inns, Ino,, for special use permit to allow erection of an adver- tising sign on thg Whitmore property at 2357 Jeffersm Street, There were no appearances, either for or against the petition, and no oral or written protests. The question of whether a time limit should be imposed on the permit was disoussed, and it was definitely felt that this limitation should be made. It was also agreed that approval of the special use per- mit should be made subject to minimum and maximum dimensions, and should be ncm-tranferable and not subjeot to sub-lease, After discussion, Comm. Sutton moved that a recommendation of approval be made of the speolaJ- use permit requested by Twin Inns, Inc., to allow erection of an advertising billboard on the Roy D, Whitmore property at 2357 Jeffersm, with the f ollawlng provisions : (1) That the sign shall be non-transferable, (2) That it shall not be subject to sub-lease, (3) That the permit be granted to December 31, 1957. (4) That illumination of the sign shall be turned off not later than 12:OO midnight. (5) That the sign shall be a minimum of 40 feet and a maximum of 50 feet in width, (6) That the sign shall be erected in full accordanoe with Ordin- ance #8020, and before work is commenced the design of the sign shall be approved by the Planning Commission. Seconded by Comm. Cockrill. All ayes, motion carried, Comm. Baumgartner reported that he had been given tb report of the San Diego County Smog Committee on smog caditions in the county to read and summarize for the Planning Commission, for the purpose of determinag whether this subject properly comes within the province of the Planning Commission, During discussion it was brought out that certaln phases of smog control quite properly would Ue. in the field of Planning, such as -2- ~. ~~ " ~~ 4 0 controlling the development of industries suspected of creating smog, etc,, but it was the feeling of the Commission that in a broader sense this subject is a health problem, Comm, Baumgartner stated that the re- port was sent in with a request that a representative be chosen to serve on the County-wide committee being set up to study the situetion, Comm, Baumgartner was instructed to report back to Mayor McClellan that the Commission feels that the subjeot is very broad and does not properly oome within the province of the Planning Commission, Hemorandum from the City Council was read, asking whether it was the intention of the Planning Commission to waive the provisions of Ordinance #9025 regarding sidewalks, curbs and gutters, in recommending approval of Terramar Unit #4 final map, The pertinent sections of Ordfnance #go25 were read and discussed, It was agreed that on any future study of sub- division maps the Commission would recommend that curb and gutter be con- structed to the satisfaction of the Director of Public Works, The tenta- tive map on this subdivision was checked and. it was found that a roll curb was indicated, After considerable discussion, Comm, Baumgartner moved that the Council be advised that it was the intent of the Planning Commission to forego the siddwalks in Terramar Unit #4, due to the lack of zoning, and to conform with the present development in the area, but that it was intended that the roll curb as indicated on the tentative map would apply, the Commission having overlooked the fact that It did not appear on the final map, Seconded by .Corn, Helton. All ayes, motion carried, Corn. Suttan It was mov.edby/that the question of whether the sub-division ordin- ance is too strict in some respects, should be taken up with the City At- torney, Also, that a memo be sent to the City Council asking them to consider the rewording of Section VII-A4 to require sidewalks, curbs and gutters, except that sidewalks may be waived in R- and E- zones at the discretion of the Planning Commission and City Council, Seconded by Comm, Stringer. All ayes, motion carried. The secretary was instructed to send a memorandum to the City Cow- cil advising that the Planning Conmission was initiating the creation of a Zone R-5 in the Granville Park area, with modified setbacks to suit the needs of the shallow lots facing on narrow streets, am&! that any sugges- tions from the Council will be welcomed, Comm, Baumgartner had met with Mr. George reported that the Civic Center Site Committee Nelson, architect, and had requested that he draw 811 over-all plan for the various departments and buildings, and also a plan for the combination fire and police station, with a sub-area wide enough to receive three fire trucks. The plan would contemplate the fire department on one side, to consist of a main office, reareation room, kitohen and bunk room, and the police department on the other side, con- sisting of three rooms and two toilets; with parking area in between the two departments. At a later date, there would be jail facilities added at the rear of the polioe department, Corn. Helton reported on the progress of the Subdivision Standards Committee, and read from a written report recommendations for street widths, etc., in which it was recommen8ed that major streets should be 90 feet in width, and that no street be less than 52 feet wide, It was agreed that am adjourned meeting should be held on Monday, March 29th, to take up further business, and the meethg was declared adjourned at 9:.OO P, M. to that date at 7:OO P.
