Present besides the Chairman were Commissioners ,Baumga,rtner, Smith, Ledgerwood, Garcia (7:35 pH), Public Works Director Anthony. Absent, COmSm Cronseth and. Stringer. Secretary Baurngartner briefed the minutes of the meeting of June 28th an3 were approved as summarized. Secretary Baumgartner read the application of Benjamin F. Taylor and Meline Taylor, 3 093 Ocem Street, Carlsbac?, for variance to allow reduc- tion in front yard setback to 2$ feet from property line, and in sidg yard setback to 3 feet, on property described as a portion of Frazier's Addi- tion, accord.ing to Piap 203, located on the west side of Ocean Street at Oak Avenue. Illr. ad IvIrs, Taylor were present and explained that it was their intention to sell a portion of their property, amounting to 6,056 square feet, and that said setbacks were necessary to permit building on the site End were in conformavlce with those on adjacent property, granted by the Board of Supervisors in 1944. After a short discussion, Comm. Smith moved that a hearing be set on the Taylor application on July 26th, the Church of Christ, by its trustees, James H. McKaig, Wm Pa Cap;ps and John A. PIcECaig, for special use permit to allow construction of a church building at the northeast corner of Oak Avenue and Pi0 Pic0 Drive, de- scribed as a portion of Tract 115, Carlsbad Lands. Said trustees were present in support of their petition, and there were no protests, oral or written. Mr, Anthony brought up the question of off-street. parking, st&- ing that no street parktng would be allowed on Pi0 Pic0 Drive. The mat- ter was discussed, and the point brought out that in some cities a require- ment is made of double the floor space for off-street parking in the case of retail businesses, churches, etc. The trustees were agreeable to set- ting aside double the floor space of the building as an off-street parking area, Coma. Smith moved that inasmuch as there have been no protests, either written or verbal, to the application, a recommendation should be made to the City Council that the request of the Church of Christ for special use permit be granted as requested, with the provision inserted -1- that a narklng area of two tines the square footage of the proposed build- ing be set aside for off-street parking. Seconded by Comm. Ledgerwood. All ayes, motion carried. Comm. Ledgerwood was excused at 7:55 P. 13. The tentative may of SIUNGRILA, submitted by E. C. Yourell, covering 21 lots Located east of Olive Drive, north of Forest, on property described as a portion of Tract 6, litpa Mesa Tracts, w8,s discussed. Secretary Baum- gartner stc?ted that he had looked the ma;? over and checked it against the subdivision 'ordinance and found a few things that dict not conform to the ordinance, It was noted that co9ies of the ma? had been passed out to Hr. Sedmond, County Health Inspector, the Water Company and the Fire Chief, for their study and recommenaations. The 18-" water line bisecting Lots 8 and 11 was discussed, Mr. Yourell stating thnt his engineer had assured him that the lots could be built on. Fir. Yourell stated he had talked to Mrs. Sutton and had offered to extend the street "Yourel.1 Avenue" up to her property, to which she was agreeable as it will fit in with her develoyment plans. The desirability of a cross street to be located between Lots 6 and 7 and across Lot 15 was dis- cussed and Mr. Yourell stated he would be willing to give up enough ground to put a 60-foot street on the present location of Symce Street. Mr. Anthony was excused at 8:20 P. PI. The fact that the easterly portion of the proposed subdivision is zoned E-2, which would have to be rezoned to R-1 for this development, was discussed at length. It was agreed that rezoning proceedings should be in process before action on the tentative map could properly be taken. Mr. Yourell agreed to make application for' reclassification to 3-1 immediately; and Comm. Smith moved that a hearing be set at 7:3O I?. Pi, on July 26th to consid.er the application of E, C. Yourell for reclassification from E-2 to R-1 of property described as a portion of Lot 5, Cedar Hills Addition, Map 532, City of Carlsbad, and at the initiation of the Planing Coamission, all of the remaining portion of Cedars Hills Addition, which includes that portion on which rezoning is requested by Mr. Yourell. Seconded by Comm, Garcia, A11 ayes, motion carried, c , Comm. Garcia was appointed to serve on the Fire Prevention Code Committee, of which Nr. Anthony is Chairman.
