Cockrill, Present besides the chairman were Comms, Baumgartner, Gronseth, and Public Works Director Anthony. After Chairman Cockrill had made several telephone calls in an effort to get a quorum, Comm. Present besides the chairman were Comms. Baumgartner, Gronseth, Ledgerwood, and Public Works Director Anthony, Comm., Stringer arrived at 9:OO P, PI, Reading of the minutes was w~lived. Secretary Baumgartner read application of H, Po Welborn for variance to permit reduction in east side yard setback from 10 feet to 5 feet, on a portion of Lot C, Alles Avocado Acres, located on the north side of Palm Avenue between Pi0 Pic0 Drive and Adams Street, at 1050 Palm Avenue. The petition carried the consent of 'H, G, Scholtens, neighboring property owner (1044 Palm). Comm. Baumgartner moved that a hearing be set for 7:30 Po M, on Monday, September Z7th, on the application of H. Po Welborn for variance as applied for. Seconded by Comrn. Ledgerwood. All ayes, motion carried, Secretary Baumgartner read the application of Morton Nielsen and R, H. Sonneman for rezoning from R-2 to C-1 of a portion of Tract 117, Carlsbad Lands, located between Grand and Elm Avenues west of U, S, 101 Freeway, There was some discussion as to whether the area to be reclassified should be extended at the initiation of the Planning Commission, but it was de- cided that an extension of (3-1 zoning in that area at this time would be Pre-ture. After some discusslon, Cs~mm, Baumgartner moved that a hearing -1 - ~ ~~ ~~ I be set at 8:OO P, M, on Wonday, September 27th, on the application of Morton Nielsen and R, H, Sonneman for reclassification from R-2 to C-1 of the property belonging to the Sonnemans and the Nielsens, as described in the application, Seconded by Corn. Ledgerwood. All ayes, motion oarried. Secretary Baumgartner read the petition of Mr. and Mrs. Harry Hansen, Kalph PI, Guest, and Mr. and Mrs.VX,rgil PI, Crilly, for reclassification from B-2 to #-3 of property described as Lots N, 0, P, Q, and K of Block 2, Carlsbad Palisades. There was considerable discussion as to boundar- ies for the proposed reclassification, It was pointed out by Corn, Ledgerwood that it would not be feasible to .extend R-3 zoning beyond Hemlock Street to the south as sewers were not available to that area, due to the low level of the lots. Signing the petition and consenting to the reclassification were the following property owners: hthony L, Medeiros; Eva E, Felt; Bertha Wyers; G, L, Sullivan; Leona Penrod; Frank T, Downing; and IJIr, and Mrs. George W. Getze, After considerable dis- cussion, Cornm. Gronseth moved that a hearing be set for 8:15 P, M, on September 27th for reclassification from R-2 to R-3 of property described as Lots 1 to 4, Block B; Lots 1 to 6, Block C; Lots 1 to 6, Block D; Lots L, M, N, 0, P, of Blook 1; Lots N, 0, P, Q and R of Block 2; and Lots 1 to 5, Block E; all in Carlsbad Palisades, being those lots facing Carls- bad Boulevard, lying between Sycamore Street and Hemlock Street, Seoond- ed by Comm, Baumgartner. All ayes, motion carried, Secretary Baumgartner read the application of W. J, Ebwman for re- classification from R-2 to C-1 of property described as the Southeast one-half of Block 7, Carlsbad Townsite, located between Ocean and Gar- field Streets, north of Cedar Avenue, Wr. Ben Morrow was present and stated he was appearing on behalf of a friend who owns nearby property (Lots 39, 40, 41 and 42 of Lot A, Hayes Co, Addition, Nap No, 2) on which he contemplates building some ultra-modern apartment houses if he can.secure reclassification from R-2 to R4, He was advised to prepare and bring in a formal application before the next meeting on September 27th. In discussion on the Bowman application, it was brought out that if the Commission should deem it advisable, to substitute a higher zon- ing thNl that advertised for hearing, it can so recommend, but that a 1OWer Zoning cannot be substituted, Chairman Cockrill relinquished the -2- ~ ___ chair to Comm. Grometh, and moved that the request of W. J. Bowman for rechssification from R-2 to C-1 of property legally described as the Southeast one-half of Block 7, Carlsbad Townsite, be heard at 8:45 P. M. on the evening of September 27, 1954, Seconded by COmm. Ledgemood, All ayes, motion carried. Secretary Baumgartner read the application of Alexander and Gertrude Plallen for variance to permit reduction in south side yard setback from j feet to 29 feet to allow construction cf an additional roocl to an ex- isting dwellLng on property described as Lot 88, Granville Park #2, lo- cated on the west side of Garfield Street, nor6h of Beech Avenue, at 2677 Garfield Street. Secretary Baumgartner moved that the request of Plr. and Mrs. Mallen for variance in south side yard setback from 5 feet to 2* feet be set for hearing at 830 P. M, on September 27th. Seconded by Comm. Gronseth, All ayes, motion carried, Mr. Anthony asked whether the Commission had any recommendation as to the use of transite pipe in soil lines, etc., stating that he felt it results in a better job and he would like to use it. Members felt that this was not within the province of the Commission and should be taken up with the City Council, A memorandum from the City Council was read, recommending that the small piece of Santa Fe right-of-way at the end of Oak Avenue be rezoned either to PI-1 or C=2 to correspond with surrounding property. Postponed until a later meeting. The Secretary read a letter from the State Board of Education approv- ing purchase by the Carlsbad Elementary School District of three parcels of property adjacent to the present Jefferson School site. The request of E, L, Whatley, 1199 Ikgnolia, for permission to build on an interior lot having no frontage on a dedicated street, was reviewed and discussed, The problem was recognized as a fairly common one with no solution under present conditions, polnting up the urgency of getting a master street plan perfected. It was suggested that the proposed street map be published, area by mea, as a recommendation of the Carls- bad Planning Commission, to see what public reaction would result. However, it was agreed to await further study and development of the map by the master street plan sub-committee, Ledgemood was appointed to represent the Planning Commission -3 - ~~~~ ~~~ ~~. ~~~~ ~~- . __ at the City Council meeting on September 21st. A memorandum from the City Council was read, referring back to the Planning Commission for further study the question of reclassification of the remainder of the Cedar Hills Addition (exclusive of the portion of SHANGRILA Tract recently approved by reclassification) frog E-2 to R-1. It was suggested that the Council be notified that the Planning Commission has under study the rezoning of the entire area. Comm. Stringer expressed the opinion that as long as the property of a given area is 90% in the use for which it is zoned, the Planning Commis- sion should not consider rezoning it. However, he felt that a master street plan should be developed and placed on file so that when good plan- ning requires reclassification of the area, this phase will be ready.
