Meeting cRlled to order at 7:15 p. PI, by Chairman Cockrill. Present
besides the Chairman were Comms, Stringer, Smith, Ledgemood, Gronseth,
Baumgartner, Public Works Director Anthony. Absent, corn. Garcia.
Comma Smith moved that reading of the minutes of the meeting of SePtem-
ber be waived, Seconded by Comm. Stringer, All ayes, motion Carried.
Comm, Stringer reported that the southern half of the San Diego Aque-
duct will be dedicated on October 2nd, from 1O:OO A. 14. to 2 Po lye,
and that there will be signs on U. S, 395 leading to the point where the
ceremonies will be held. He stated that refreshments will be served at
noon, sad that the City Ea11 could be contacted for further information,
Secretary Baumgartner read the application of Albert Stein, Jr,, for
variance to allow reduction from 50 feet to 40 feet in front yard setback
to allow construction of a retail business building on property described
as the Southwesterly 140 feet of Lot 32 of Seaside Lands, except the
Northwesternly 32.80 feet, located on the east side of State Street 100
feet north of Grand Avenue, in a C-1 zone, Coma, Stringer moved thclt a
hearing be set on said application at 7:15 P, PI, on October lJ, 1954,
Seconded by Comrn. Gronseth. All ayes, motion carried.
The Secretary read P. letter from the League of California Cities announc-
ing the Annual Conference to be held in Los Angeles on October 17-20, and
recommending that housing arrangements be made early by writing the League
off ice at Berkeley,
Comm. Stringer reported on the meeting held to discuss zoning of the
harbor area, stating that practically all owners of water-front property
were present and spoke their thoughts; that two owners definitely felt that
everything adjoining the water's edge should be zoned commercial, but that
others felt that anything the City deemed fit was satisfactory to them,
Allm Kelly presented a plan showing lots 40 feet wide and 110 feet deep,
which he recommended as an appropriate size for waterfront lots, Comm.
Stringer also stated that Mr. Garber of the San Diego Gas & Electric Com-
pany had been present and had eftpfregsed the hope that no one would invest
money in business enterprises contemplating use of the water, as they would
not be in position to make any commitments until the plant had been operat-
ing approximately three months so that they would know where they stood.

Comm4- Stringer stated he would get a committee together one of these d.ays
and try to get a report in before the end of the year.
Secretary Baumgartner read Notice of Public Hearing on the applica-
tion of Harry P, Welborn for variance to permit reduction in east side
yard setback from 10 feet to 5 feet on property described as a portion of Lot
C, ,Alles Avocado Acres, located on the north side of Palm Avenue between Pio
Pic0 Drive and Adarns. Street, There were no oral or written protests, and
Mr. Welborn and three adjoining neighbors, I4r, Scholtens, bo Hozelle and
PIr. Evans, were present in support of the petition, IJIr, Welborn also sub-
mitted a letter of consent signed by all affected neighbors. After dis-
cussion, Comm, Gronseth moved that a recommendation be made to the City
Council that the request of PIr, Welborn be granted, Seconded by Corn.
Baumgartner. All ayes, motion carried. Mr. Welbom was advised that the
City council will act on his application at their next meeting on October

5th.
The possibility of having an outside planning study made by State
College Political Science classes was again discussed, and Mrs. Vermilyea
was requested to write to the Professor with-whom we have had correspon-
dence and find out vrkther such a study could be set up for the second
semester.
The present status of the dedication of 15 feet on the south side
of Grand Avenue from Hope Street to the dead end of Grand Avenue was dis-
cussed, since many of the persons affected were present on another matter.
They were advised that the blanket deed conveying the property, swed by
the various owners, was in order, but the City could not accept such dedi-
cation until a Policy of Title Insurance guaranteeing clear title Is fur-
nished, which Policy of Title Insurance would have to be ordered and paid
for by the grantors thenselves,
Secretary Baumgartner read Notice of Public Hearing of the appli-
cation of I”irton Nielsen aYld R. H. Sonneaan for reclassification from R-2
to C-1 of property described as a portion of Tract 117, Carlsbad hds,
located between Grand and Elm Avenues, west of U, S. 101 Freeway, Mr.
Nielsen and PITS. R, H. Sonnew were present in support of their petition,
Opposing the granting of the rezoning were Mr. R, W, Johnson, 988 Grand
Avenue, on the grounds that the street is too narrow and there are too
many children in the area; that commercial traffic would be a distinct

hazard; Mrs. Krueger at 1022 Grand , because of the narrow width of the
street and lack of a turn-around; John Ortega, 955 Grand, who stated that
his mother and neighbors, the Henleys, both residents of the area, were
opposed to it; V. V, Seymour, 918 Grand, because of the dead-end street,
lack of sidewalks, and numerous children; Everett M. Pierce, owning prop-
erty at 1015 Grand, stated he was opposed to the rezoning under present
conditions but if the street were widened by dedication of the additional
15 feet, it would present a different picture; Iqlr, John Howe, 2971 Harding
Street, because he doesn't think i+, is a suitable area for a business
zone; and Charles Kampe, 1001 Grand Avenue, because he had purchased his
lot in what he felt was a quiet residential zone and was opposed to having
it changed into a commercid area.
Mrs, Gettle, at Gmnd and Jefferson Streets, stated that she would
like to see all of Grand Avenue rezoned for business.
Cornm. Gronseth commented that he felt that the ultimate development
of Carlsbad would call for rezoning all of the property between Grand and
Elm Avenues to C-1. He pointed out that there is at present business be-
ing conducted in that area in contravention to the City zoning ordinance.
Comm. Smith stated that his property comes to within 300 feet of
the property in question, and that he has lived up there and seen this
area develop from pasture lands to nice residential property; that he felt
Mr. Nielsen has put in a very nice place, but that this rezoning, if
granted, would unquestionably result in other pieces of property being
rezoned and would open up all of Grand Avenue for business activities.
Mr. Nielsen stated that he had been encouraged by his neighbors to
open up a nursery, a business in which he has had considerable previous
experience in the East; that he has obtained permission to build every-
thing he has constructed and has built as attractively as possible, He
stated he felt that Carlsbad has a great future and that the business he
would conduct there, if his petition is granted, would be a great asset
to the City. He stated that there will be no cars parked up there in
connection with this business,
Comm, Strlslger stated he felt that Grand Avenue could never be a .
business street, due to its narrow width; that he feels granting of this
rezoning would be spot-zoning, which the Commission from its very begin-
ning has avoided. He stated tMt he had recently talked with ayl
authoritative source who said that by no means would any lending agency
finance a business in that area,
Comm. Stringer moved that a recommendation be made to the City
Council that the application of I4r. Nielsen and Itlr. Sonneman for reclass-
ification be denied, in view of the strong opposition expressed by resi-
dents of the area, Ayes, five, nays, one (Gronseth) , motion carried,
The citizens present were informed that the City Council would set a
hearing, when they meet on October 5th.
At 9:OO P. fr, Secretary Baumgartner read the Notice of Public
Hearing on the application of Harry A. and Mary E, Hanse, Ralph L. Guest,
Virgil IyI. and Viola M. Crilly, and. the Carlsbad City Planning Commission,
for reclassification from Zone R-2 to Zone R-3 of property described as
those lots facing Carlsbad Boulevard between Sycamore Street and Hemlock
Street. The application was accompanied by a letter of consent signed by
eight property owners of the area, besides the applicants, Appearing and
speaking in opposition to the petition were Mr. Geo. L, Kronmiller, 3424
Carlsbad Blvd., Iqr. and Mrs. Niels H. Martin, 3480 Carlsbad Boulevard,
and fJIrs, Geneva Fritchel, 122 Acacia, all of whom contended that R-3
zoning would tieteriorate the area as it would permit bungalow courts and
other types of dwelling groups which would be extremely detrimental to
the present residential development, Mr. Kronmiller submitted a letter
of protest signed by 85 residents, Comm, Ledgerwood studied the petition
and commented that he was familiar with the area and would say that 95%
of the signatures were residents of the affected area.
After discussion, Comm. Gronseth moved that a recommendation be
made to the City Council that the petition for the rezoning of the lots
facing Carlsbad Boulevard between Sycamore Street and Hemlock Street, as
requested by the Hansens, the Crillys and Mr. Guest, and the Carlsbad
Planning Commission, be denled, in view of the great number of protests
registered, Seconded by Comm. Ledgerwood. All ayes, motion carried.
The citizens present were informed that the City Council would act on
this matter on October 5th by setting a hearing.
Comm. Ledgerwood was excused at 9:40 P. PI,
At 9:40 P. M. the Secretary read Notice of Public Hearing on the

Lot 88 of Granville Park #2, located on the west side of Garfield Street,
north of Beech Avenue. There were no protests, written or oral, Comrn,
Gronseth moved that R recommendation be made to the City Council that the
application of Alex and Gretrude Mallen for variance be approved. Second-
ed by Comm, Stringer, All ayes, motion oarried.
At 9:,5O P, 1’1, the Seoretary read Notice of Public Hearing on the
application of W, J, Bowman for reclassification from R4 to C-1 of prop-
erty described as the Southeast one-half of Block 7, Carlsbad Townsite.
The application was read and studied, There were no written or oral pro-
tests, send no one appeared in support of the petition, Mter discussion,
it wa,s decided that the present HA zone would permit most of the appli-
cant’s purposes and that it would not, be good planning to grant reclassi-
ficiation to C-1 at this time Comm. Gronseth moved that a recommendation
be made to the City Council th3.t the application of W. J, Bowman for re-
classification be denied. Seconded by COW, Baumgartner. All ayes, mo-
tion carried, The secretary was requested to notify Mr. Bowman that the
property in question was already zoned R-4 5nstead of R-2 as stated in the
petition,
Comm, Smith commended Chairman Cockrill for his handling of a dif-
ficult meeting,
Comm. Smith was appointed to Serve as the Commission representative
to the City Council meeting of October 5th.
Comm. Gronseth announced that he was resigning from the Planning
Commission, Other members of the Commission expressed the hope that he
would reconsider and commended him for his long-time valuable service on
the Commission. Chairman Cockrill stated that Comm, Garcia had also re-
signed as of this date,
There being no f’urther business to come before the Commission, the
meetfl?g was declared adjourned at lot05 P. PI.
