M, by Chairman Cockrill, Present besides the Chairman were Comms, Smith, Baumgartner, Swirsky, Engelmann, Ledgerwood, and PuWic Works Director Anthony. Absent, Corn, Stringer. Comm. Swirsky moved that reading of the minutes of the meeting of December 13th be waived. Seconded by Comm. Raungartner. All ayes, motion carried. Secretary Baumgartner briefly summarized actions of the previous meeting . Hearing on the application of Go D. McLean, 2740 Arland Road, for side yard and front yard variance, set for 7:30 P. M., was postponed to 7:15 P. M, on Sanuary 10, 1955, since there was no one present either in -.. - support of or opposed to the application. Comm. Smith moved that the Planning Commission secretary prepare a letter of thanks to Col. Gronseth and Comm. Ledgerwood for their most ex- cellent work done in connection with a master street plan for Carlsbad. Seconded by Comm. Swirsky. All ayes, motion carried. Secretary Baumgartner read Notice of Public Hearing on the application of C. D. Field , Mrs , George Yarberry , Jr. , Richard Scheetz , and the Plan- ning Commission for reclassification from E-2 to R-1 of all of Wilsonia Tract not presently zoned R-1 or R-lA, and a portion of Section 31, Town- ship 11 N. Range 4 W. as described in the advertisement. The applic,mts were present in support of their petition, as were practically all affect- ed property owners signing the petition as consenting to the reclassifi- cation. The fact that the only differenoe between R-1 and R-LA is the 75-foot frontage restriction in B-LA, was explained to those present, and that R-lA was for this reason considered better zoning and was more apt to be acceptable to the City Council. Cm. Sutton was present and recalled that about two years ago the Planning Commission went on record that they would not recommend R-1 zoning in any future cases, as a protection to property owners, since it procides no frontage restriction and could re- sult in long narrow lots which would deterioriate the value of the neigh- borhood. After some discussion, all residents present agreed to a reborn- mendation by the Planning Conmission of R-LA. One written protest was received from Rowland G. Hagar, 2717 Wilson Street. Corn, Smith moved that the Planning Commission recommend to the City Council that the property -1- .~ ~~~~ ~~ ." - as advertised and describ ed be reclassified from €3-2 to Zone H-LA, in view of the fact that there are 14 proponents of this change as opposed to one opponent, and that the recommendation to reclassif$ the property to Zone K-LA Instead of B-1 was made because proponents were apparently under the impression that they were asking for R-LA; and further, that proponents attending the hearing stated it was their desire to have the property reclassified to R-Yl instead of R-1. Seconded by Comm, Swirsky, All ayes, no nays, motion carried, Secretary Baumgartner read Notice of Public wearag requesting zon- ing of all unzoned areas within the City of Carlsbad to R-A (Roadside Agrfcultural) , initiated by the Planning Commlssicm. Comm, Smith ex= plained to those present that from time to time the Commission had at- tenpted to get some zoning in the unzoned areas for protective purposes, which would be acceptable to everybody, but without success, Allan Kelly, owner of property in the affected area, stated that the proposed R-A zon- ing was agreeable to him. He stated that at one time the County was con- sidering/all unzoned areas in the entire County to R-A to get some control, zoning and that the plan even contemplated constructing a sewage disposal plant on his land just south of the City limits, Cmn, Suttm suggested that the Commission request from the County .fringe area" zoning, and It was decided that Chairman Cockrill would address a letter to the County regarding zoning in fringe areas. There were no written or oral protests, and no one appeared in pro- test to the zoning. Comm, Baumgartner suggested thp-t in view of the fact that Mr. W, D, Cannon, Mr. Paul gcke, nor any representative from the San Diego Gas 8c Electrio Company, a11 large land-owners whose property would be affected, were present, it might be well to postpone the hearing for two weeks, but others felt that since the normal procedure had been fol- lowed and notice published as required, the Commission was not obligated to allow further opportunity for protests, Nr. Anthony urged that the proceedings go forward as rapidly as possible as he felt there may be real danger in delay. It was felt that further opportunity would be afforded property owners to protest at the time of the City Council hearing, Cmn. Sutton stated he believed that if any owner comes before the Planning CO~lSSiOn and requests a different zoning than R4, he should not be -2- forced to pay the $25,00 fee for rezoning, but Comm. Smith stated he be- lieved It would be inequitable not to charge the fee when in all other cases it is required, After considerable discussion, Comm. Ledgemood moved that the Cornmission recommend to the City Council that all unzoned areas in the City of Carlsbad be zoned R-A, Seconded by Comm, Smith. Ayes, Comm, Ledgemood, Smith, Baurngartner, Elgelmann; nays, none; abstain- ing, Comm. Swirsky; absent, Comm, Stringer, Secretary Baumgartner read the Commission's memorandum to the City Council recommending that the Public Works Director be appointed Planning Director for the City of Carlsbad, and reported that the recommendation was accepted by -the Council and Mr. Anthony appointed Planning Director. Secretary Baumgartner summarized the application of Frank Small, 2720 Roosevelt Street, for reclassification from R-3 to C-1 of property described as all property on the westerly side of Roosevelt Street between Grand Avenue and Laguna Drive, not presently zoned C-1, and all property on the easterly side of Roosevelt Street between Grand Avenue and Laguna Drive extending east to the alleyway, The petition was signed by 23 property-owners of the area in support thkreof. Comm, Baumgartner moved that a hearing be set for 7:30 P. M, on January 10, 1955, to consider the application of Frank Small for reclassification from H-3 to C-1 of the property described irl the petition, The map was consulted, to work out a proper description of the property for e.dvertising, and it was found that the present dedicated alley extends only 100 feet north from Grar,d Avenue , the westerly line being 170 feet east of the property line on Roosevelt Street, Mr. Small was advised to work with his neip'lnkors' on the alley situation, as it will be a faotor in granting rezoning to C-&, Chairman Cockrill read a letter from Mr. Kalicka of Gordon Whitnall & Assooiates, thanking the Commission for asking him to the meeting and expressing the hope that they will be retained by the City for a Planning Study of the City of Carlsbad, Comn, Swiraky stated he hd done a little research and found tbt the Statute provides that in any fiscal year, the City Council may levy a maximum of 2 mills on the domlar of assessed valuation for the purpose of defraying the lp.wful expenses incurred by the Planning Commission, Under this maximum about $18,000.00 could be raised, of which the -Sari Diego Gas Electric Company would contribute about $6000.00;, or, at 1 mill per dollar, $9,OOO,OO. It was suggested that this Idea could be presented to the Council as a possibility for recommend.ing that $2700,00 be raised for a Planning Study, either l/3 mill levy as outlined, or in the regular manner. It was decided that the chairman and as many other members as could get there would attend the City Council meeting on January 4th and invite them to attend an early Planning Commission meeting to rvhloh Mr. Kallcka would be invited. Copies of the Light Industrial Survey put out by the Chamber of Com- merce were passed to members, There being no further business to come before the Commission, the meeting was declared adjourned at 9:2O P. 14, Respectfully submitted, V -4-
