besides the Chairman were Commissioners Swirsky, Baumgartner, Cockrill,
Ledgerwood, Public Works Director Anthony. Absent , (hms. Engelmann
and Smith.
Minutes of the meeting of April 25th were read in full, Comm~
Coskrj.11 moved that minutes of the meeting of April 25th be approved.
Seconded by Comm. Baumgartner, All ayes, motion carried.
The Secretary read Notice of Public Hearing on the application of
Pilgrim Holiness Church for special use permit to allow COnStrUCtion
of a church building at Magnolia Avenue and Adam Street. A report
of the Public works Director was read, pointing out that both Magnolia
and Adam are too narrow to permit street parking, and recommending
that any recommendation of approval of the application be conditioned
on adequate off-street parking being provided. A Letter dated May
6th, signed by June and Walter R. Jones, strongly protesting the grant-
ing of the Termit, and a petition of protest signed by 63 land-owners
of the area, were read. Mr. and Nrs. M. H. Lyle were present in sup-
port of their petition, Mrs. Lyle stating she felt very strongly that
the petition was unfair and based on a misconception of the facts.
Corn. Ledgerwood commented tb.t he had investigated a rumor that this
Church grouy, represented a 'cult" trying to gain a foothold in the
community, and found same to be without foundation, Oral protests
were made by Dr. and Mrs. Locklin. After discussion, Corn, Cockrill,
prefacing his motion with the comment that it had nothing to do with
the faith or religion of the group, moved that in view of the mer-
whelmlng number of protests and the report of the Public Works Di-
rector as to the narrow width of both streets involved, the Commission
recommend to the City Council that the application of Pilgrim Holiness
Church for special use Permit be denied. Seconded by Comm, Baumgart-
ner, Four ayes, one nay (Ledgerwood), motion carried,
Tentative maps covering POINSETTIA BEACH UNITS #1 and #2, sub-
mitted by Paul Ecke, were studied. Mr. Ecke and Mr. Freeland of Free-
land, Peterson ?% Evenson, engineers, were present. The Secretary read
a letter from Mr. Freeland's office outlining proposed zoning for these

subdivisions and other parcels of Mr. Ecke's land now unzoned.
Recommendation of the Fire Chief was read, that a standavld 6" fire
hydrant at each of the following locations: in UNIT #1; between
Lots 2 and 3; between Lots 13 and 14; and at the south end of Lot 24;
all on Carlsbad Boulevard; in UNIT #2 ; between Lots 28 and 29, and be-
tureen Lots 35 and 36, on the east side of the private easement; and
urging that earnest consideratioc be given the water pressure situa-
tion in the proposed subdivisions, quoting figures indicating that
water flow at Terramar is well below the requirement of the Board of
3'ire Underwriters, The report of the Public Health Department has
not been received, but IJlr. Anthony stated their representative had
been over the ground and was very doubtful that they oould approve
the proposed sewage disposal on unit #2, In regard to the water flow
deficiency , b. Ecke verbally agreed that if booster pumps are re-
quired he will install them, but felt he should not be discriminated
against and that steps should be taken to require that the whole Ter-
ramar system be gut under pressure, especially since Mr, Cannon is
contemplating early development of the 25 acres aoross the Boulevard
fron the Ecke subdivisions, Mr. Anthony read his report reconmend-
ing a cul-de-sac at the south end of the private easement, The Corn-
mission studied the map indicating desired zoning of this and other
Ecke land, and Mr. Ecke expla,ined his future plans for the area.
After discussion, Comm, Cockrill moved that the subdivision maps of
POINSETTIA BEACH UNITS #1 and #2, subrilitted by Paul Ecke, be recom-
mended to the City Council for approval, subject to the following
recommendations and exceptions:' that in both maps the water pressure
(pointed out by the Fire Chief as being very low), shall be adequate
in the sense that the same pressure shall be maintained as now exists
in the TERRAMAR subdivision; that the sewage disposal and other health
stamdards as recommended by the County Health Department be followed,
with particular reference being made to POINSETTIA BEACH UNIT #2; that
the laboratory tests of the County Health Department and the recom-
mendations following such tests be complied with; that Carlsbad Boule-
vard on the map of Unit #2 be recommended for a width of 32 feet instead
of 36 feet in that it is a dead-end street, and there will be dwellings

on only one side of the street; and that the easement at the base Of
the cliff have a cul-de-sac at the south end suitable for a turn-around,
according to the radius requirements of See. 111-H-1 of Ordinance #9025,
%@cia1 mention is made of the recommendation of R, W. Hardin, Fire
Chief, dated Play 5th, in which it is recommended that a standard 6" fire
hydrant be installed at each of the following locations: between Lots
2 and 3; between Lots 13 and 14.; and at the south end of Lot 24; all in
unit #l; and between Lots 28 and 29, and between Lots 35 and 36, in
Unit #2; that the entrance of Carlsbad Boulevard on Unit #2 be worked
out to the apyroval of the public works Director at the time final map
is filed, Seconded by Comm, hdgervrood. All ayes, motion oarried,
The Secretary read a letter from Tuttle Engineering Company re-
questing an exception in the width of the street in KNOWMS PARK sub-
division, The secretary was requested to write them a letter advising that
the exception noted has been accepted by the CouncI1.
The Secretary read a memorandum from the City Council referring
back to the Commission the application of William Martin, 2386 Jeffer-
son Street, for variance to permit reduction in building site area on
property located at Jefferson ii hs Floree, on which the commission had
recommended denial, The Council gave as its reasons the fact that the
two nearest adjacent lots are on parcels of one-third and one-half acre;
that the adjoining vacant lot was reduced by highway aoquisition to .67
acre, leaving that Owner still eligible for a building permit on that
parcel; that the very high cost of sewer assessment for 369 feet of
frontage ndke the entire site too costly for a single residence site;
that the City has. at the present time no classification which would meet
the desires of the neighborhood as to land area; that the nearest class-
ification would permit building sites smaller than they feel are suit-
able in this location; and the Council strongly urged th2.t the Planning
Commission find. some way of permitting the variance to be granted with-
out waiting for the completion,of the study of a proposed new ordinance,
in the light of the written support of the adjoining Owners, which has
been received since the decision of the Planning Commission, and upon
the verbal opinion of the City Attorney that this matter may be reopened w
rsithout advertising another hearing, Comm, Cockrill reported on the
Council's discussion on the matter. The Secretary read a letter to the
City Council, dated May lst, signed by the Martins and five neighbor-
ing families, supporting the application, After discussion, comm.
Ledgerwood moved that the William Fartin application for variance be
granted on the basis of hardship. Seconded by Comm. Cockrill, Four
ayes, one nay (Swirsky), motion carried. Comm. Swirsky expressed him-
self as being dissatisfied with the apparent lack of policy of the con-
mission and the prec6dent being set in these cases where the Commission
so readily reverses itself on matters returned from the council for re-
view,
Secretary Swirsky read the resolution to be sent to the City Coun-
cil recommending the adoption of an emergency interim ordinance zoning
presently unmned lands within the City of Carlsbad.
The secretary read a letter from the State Division of Real Estate
giving notice of filing of proposed subdivision 'HARBOR PARK"; and Final
Subdivision Report on "CARTSBAD ESTATES".
Two applications of Emmett Roberts for variance to permit reduction
in west side yard setback from 10 feet to 5 feet on Lots 2 and 5 of
Block "B" 9 SWGRILA TRACT, to clear water line easements with proposed
buildings, were summarized and the Secretary authorized to set hearings
for May ~3rd at 7:15 P, PI,
Chairman Stringer reported that he had a request from Wr. Walter
Krames that he be notified of any proposed rezoning of Santa E'e property.
There was some discussion as to naming of standing sub-committees
for the ensuing year, and decidion made that insofar as possible the
members would retain their present committee assignments, and where va-
cancies have occurred due to change of Commission personnel, the Chairman
will make appointments as soon as possible.
There being no further business to come before the Cornmission, the
meeting was declared adjourned at lO:'l5 P. 14.
