Present besides the Chairman were Commissioners Fennel, Jarvie, Engelmann, Hourell, Stringer, Baumgartner, Planning Conmftant Kay Kalicka, Planning Aide-Secretary Max Ewald, After correction of minutes of August 28th (the name of Chairman of SuWivisicm Sub-committee changed frost Corn. Baumgartner to Comm, Yourell), Camm, Fennel moved that the minutes as submitted and corrected be approved. Seconded by Coma. Yourell, All ayes, no nays, motion carried, WRITTEN CORRESPONDENCE: a, Memo from the City Council was read, regarding action on HiglaIand Drive lot-splitting policy.- Recommendation of 8-29-56 was considered-and approved as recommended by the Planning Commission. b, Statement of Policy by City Council on Street Acceptance was read, stating thak standapds for street improvements set forth in the subdivision Ordinance #9050, adopted on ehe 17th day of April, 1956, should be met by all persons who offer streets for dedication to the city. Administrative officials of the city shall assist property owner by giving advice and counrsel on problems of planning, engineering and legal advice. ce A letter from H. A. Baughman, 4008 Garfield St., dated Aug. 29th, was read, asking that consideration be given to the idea that the Gas 6 Electric Coo storage tanks be constructed underground, to avoid unsightly appearance and fire hazard, Secy Max Ewald was directed to answer letter of Mr. Raughman explaining that the problem of zoning in that area is still undergoing study, and that his request will be considered in continued study of the problem, ELLSWORTH DRACE VARIANCE: Memo from the regular meeting of the City Council, dated Sept. 6, was read, referring this matter back to the Planning Commission for further study, with a letter written to the City Council by C, D. McCllellan, protesting the granting of the variance. Mr* McClelfan was present and sub- mitted a petition bearing names sf 30 interested property owners in the near vicinity of Lots 4 and 5, Rella Vista Tracto Carlsbad, also protesting the granting of the variance. A letter from A. He Maxted, owner of property in BelXa Vista Tract, was read, in which he states that he wishes to go on record with the Planning Commission as definitely apposing the variation of restrictionc Glenn Feist seated that the petition had been collectdd by several people, and that in his opinion, when almost all of the people of a given area expressed the same wish, &help wishes should be given serious consideration, Me felt that were an actual building plan to be submitted eo these people, and approved by them, they would give consen& and support, but until such time as the con- sent of the people was gained, no action should be takeno The Commissioners answered that whil0 &he neighbors* attitude is an important factor, the value sf a house on a certain plot could not be dictated; thab the 530 frontage would be merely a roa$ entrance and the house would be built on property that is well over building raquiremene in square footage. Most people in that area have required variances and it would be unfair Lo deny this one,, The property cannot be-farmed and this is the only way to make properky useful and place it granted for eeamms- on the tax rolls It was po nee out by Comm. Baumgartner that variances are o omphy and shape of building site; and thaat boeh seemed to apply in Chis case. Comm. Jarvis moved that the mattem be con- tinued tQ the next meeting. Motion died for lack of second, Comm. Stringer made a motion that due t~ the fact Chat no ,new evidence had evolved since the August 28th meeting, the a,ppIication for variance of Roy Ellsworth and Pauline Draee be sent back to the .City Council with the original recommendation for appPova% of variance. Vote on the mobion: a131 ayes, no nays, motion carried, ROBERT \t'* RAIKD VARIANCE Bearing was opened on thai .qplication for variance on property on the east side of Highland Drive, between Oak Avenue and Ruena Vista Way, owned by Robert W. Baisd, 1721 Monterey, Coronade, Calif, Comm, Baumgartner disqualified himself from taking action on this matter due to business association with app?icant. In a letter dated Sept. 10, 1956, read by Secy Ewald, the following interested OIJ~~FS of adjacent or near properky involved, stated they have no objection to the variance being granted; Geo, H. Ni.#con, 2924 Highland, Mrs. Lyle Lrawsoo, 2862 Highland, Mrs. Dellla R, Noble, 2850 Highland, and Mrs- Helen N, Reese, 2850 Highland. Grace Harrison, 2190 Chestnut., stated she had no objections providing a minimum house area of 1000 square feet was required. Due to the fact that the Planning Commission can not put an area requirement on a house, and that the variance requested is small, a motion was made by Comm, Fennel that the variance be granted. Coma, Yourell seconded. Vote on the motion: six ayes, no nays, Comm, Baumgartner abstaining, motion carried. 8:40 P# Recess for 5 minutes., Reconvened at 8:45 PH. SUBDIVISION MONUMENTS: Bob Watson, contractor, was present and presented a request for a permit for installation of monument markers at the entrance to Harbor Estates Subdivision, far which he submitted written plans and specifi- cations. (Corn, Swirsky asked for and was granted permission to abstain from discussion, due to business association. Vice Chairman Baumgartner presiding) After considerable discussion it was decided that the matter of pobicy on such installations should be determined before permit granted; also that recommend- ations to the City Council be asked from the following: City Atty, Director of Public War-ks, Fire Chief fs Police Chief. Cow. Fennel moved that the matter be postponed until information requested had been received, Corarrn, Jarvie seconded. A13 ayes, no nays, unanimously carried. PI0 PIC0 POTENTIAL R 3 ZONE COMYITTEE: Chairman Stringer reported that a meeting of this committee had been held, discussing at length the property in question (all property abutting east side of Pi0 Pico, extending from the south boundary of Elm St. to the north boundary of Chinquapin St.) A map showing property Pines involved was procured and studied by the committee, and the question debated as to whether the property was more valuable as R 1 zoning, or R 3 zoning, Ifas decided that property would be'more fully developed as ip multiple dwelling zone, which ineludes hotels, motels, and auto courts. Zt was suggested that, the R 3 zoning be extended northerly to Knowles Ave. After some discussion, Cotnm. Stringex- moved, Coram, Fennel seconded, that all proper- ties 1ying.easterly of Pi0 Pico, abutting on Pi0 Pico, from the southerly boundary of Knowles andl extending to the northerly boundary of Chinquapin, along Pio Pic0 be put in a potential. R 3 zone. All ayes, no nays, motion carried. Action to be in form of a resolution to the City Council. SPLIT LOT COMMITTEE: A policy for frontage of split lots other than Highland Drive was discussed. Secy Ewald pointed out that at the present time a lot can be split with 30 or 40 foot street frontage as long as the square footage meets requirements. It was sugg3sted that a Resolution of Policy be sent to the City Council, Comm. Engelmann moved that in all areas of the City of Carlsbad where there is no existing policy OF where the existing zoning ordinance does not require a particular street frontage, that the street frontage on such lots in such areas be 6Q ft, CQ~IB. Stringer seconded. All ayest no nays, motion carried Comm. Swirsky pointed out to the Commission that the hearing on the new zoning resolution will be before the City Council on Sept. 2s0 Since it is necessary for a member of %he P3.anning CommBssion to attend the City Council meeting when some official action is to be taken, a liaeon member will be appointed to attend such meetings, members to be appoinked in alphabetical order. Comm. Baumgartner was appointed to attend th~ City Council meeting of Sept. 18. Members were instructed to secure their own replacements if unable to keep appointment, c m W Mr. Kal icka brought up the probl.em of zoning on Highl and Ave, in the area of Buena Vista Way end Arland Drive. Because of odd lots it will be difficult to zone this area in the same manner as the rest of Highland Drive. He stated that some decision must be made so that %he zoning map could be finished. Comm. Engelmann made a motion bhat &he action of August 28 be rescinded and that the Highland Ave. area north of Ruena Vista Way be transferred back to 7500 square feet with a 60 foot frontage requirement* Coram, Stringer seconded.
