Discussion was resumed on the IACONA application, Mrs, Mary Mullican, 810 Home Avenue,, was present and stated &e is the prospective purchaser of the lot in question and has plans drawn of a dwelling which will fit the lot without requiring any variances (verif isd by Mrq EwaPd) ,, Afbr a favorable report by Comm, Stringer, concurred in by COMES, Engelmann and Fennel, and
somu further discussion, Corm, Fennel moved the adoption of Resolution #S pecommending to the City Council the approval of the application of Leon Iacona for variance to permit reduction in lot area from 6000 to 5025 equare fee%, and in street frontage from 60 feet to 50,25 feet, for the reason that surrounding properties are of ejlfmilar size and frontage, it would be a de- sirable development if divided and improved, and granting of the variance would have no adverse effect upon any surrounding property, Seconded by Comm, Engelmann,> All ayes, motion carried,
HEARING ST,, MICHAEL*S CHURCH - CONDITfONAL USE BERMIT, Notice of Public
Hearing on the application of St, Michael s Church for conditional use permit-to erect a-church and accessory buildings on a portion of -Block 6, Carlsbad Townsite, lying between Carlsbad Boulevard and Garfield Street, north of Cedar Avenue, in C-1 and R-3 zoning, Also read was a letter from Daubney and Stevens, attorneys, dated September 27, 1956, outlining a 10- year expansion program to include a church building, parish hall and Sunday School rooms8 living quarters for the Vicar, and, finally, facilities for operation of a parochial day echool; and to provide for removal to the now site of foHr to six existing graves at the present church site on Oak Avenue,
Staff report of Gordon Whitnall Associates was read, recommending approval of the application provided an amended master plan be filed indicating the
following:
(1) Specific location intended for interment of bodies, with adequate fencing,
(2) Off-street parking areas, based an anticipated number of persons to be servedp and location of driveways,
(3) Improvements to be required by Director of Public Works in public right-of-way surrounding the property (sidewalks, curbs, etc,)

spoke in support, of the application, stating that the plan subabetsd was merely tentative; that the initial structure will be the church building itself, seating bekween 380 and 400 personsB to cost an estimated
$65,000,00; that there is a possibility of &he Church peceiving an addi- tional grant of land, axtending northward along Garfield; and that it may be possible to arrange for removal of the bodies to a graveyard in the Sara Luis Rey parish inetead of interring them at the new church site,
The matter of State requirements for moving bodies was brought up and dis- cussed briefly, Chairman Swirsky explaining that the granting of a condi-
tional uee permit would not waive or set aside any State requimaents in
this respect
There was considerable discussion on each of the points set forth in the
WhitnaP1 letter,, Also, Mr. Ewald brought up the point of the proximity of the proposed church building to several existing and contemplated liquor establfshmenCs along Carlsbad Boulevard, and considerable discussion ensuedo Mr. Wdwick was asked to convey to his clienks that the C.-l zoning
along the Boulevard permits a variety of commercial uses, among them bear
and liquor establishments; that granting of such licenses is an administra- tive decisAon of the ABC Board and ft is not mandatory that an application for a liquor license in tho immediate vicinity of a school or church be denied, ft was felt that existing liquor licenses would not be affected by the establishment of? 8 church in the area and it would be impractical to attempt to take into Consideration futurdr propopled license applica- tions in the ComaissionQ s deliberations,
Come, Engelmann moved the adoption of Resolution #6 re'commending to the City 'Council the granting of a conditional use permit to St, Michaela s Church for construction of a church building and accessory facilities, as1 set forth in the application filed September 28, 1956, on a portion of
Block 6, Carlsbad Townsite, in R-3 and C-l zoning, subject to the following conditione t
Approval by the Planning Commission of an official master plot plan;
Any improvements which the PubXc Works Director and Planning Coarmnis-
sion determine shcdd be required in the public right-of-way adjoin- ing the church site, such as curbs, sidewalks, etc,;
