The Meeting was called to order at 7:30 P.M. by Chairman Baumgartner, Present
and Fennel; Planning Secretary Ewald, Planning Consultant Kalicka and City besides the Chairman were Commissioners Jarvie, Swirsky, Yourell, Engelmann

Stringer made the motion and that Comm. Yourell seconded the motion. Comm, Jarvie moved that the Minutes of June 25, 1957 be approved as corrected, Seconded by Comm. Engelmann. Ail ayes, motion carried.
HEARING - VARIANCE - SIMPSON-ROGERS. Secretary Ewald read Notice of hbllic uearine to consider variance to wrmit lot split on property described as a portion of Tiact #245, located at 3586Highland Give, bhwien Magnolia and Chestnut Avenue. Secretary Ewald read a letter addressed to the Commission from E. C. Pedley. 3679 Valley, opposing the granting of variance to permit lot split as he felt no variance or building permits should be granted on the back side of this hill until such time as the proper survey for street and waterway had been made, and then all permits should be made to conform to same. Planning Consultant Katicka stated that the Staff felt that there should be no objection to the variance as the new owner would not bo permitted to build on the property because of the property having only a 25’ frontage.
w. W. ROGERS, 2729 Carlsbad Blvd. , stated that the property would not be used tor building purposes until such time as the streets and sewers have been estab- lished.
ARNOLD M. STORM, 1534 1/2 Magnolia Avenue, asked where the proposed street would run. The proposed Master Stxeet Plan was presented for his inspection.
After considerable discussion Comm. Swirsky moved that Resolution No. 21 be adopted granting this variance due to the following reasons:

That exceptional circumstances exist in that the total lot is odd size and presents unusual land use problems.
That the lot split will create a nonconforming lot frontage, but the owne~ of the property has no desire to build on the property using Highland Drive as a lot frontage.
That granting of the variance will not be materially detrimental to puklic welfare or injurious to property or improvements in the vicinity.
Seconded by Comm. Fennel. All ayes, motion carried.
CONDITIONAL USE PERMIT - HENRY P. CONANT. Secretary Ewald read Totice of Hearing for a conetitional use perrmt to permit the landing of boats,
Tract No. 238 of Thum Lands. There were no oral or written objections. parking of cars and general recreational use on a portion of Lots 11 and 12,
The Planning Consultant stated that he could see no reason why the conditior- a1 use permit should not be granted and that the permit should contain the same restrictions as the previous conditional use prmitr issued in that area. Mr. Xalicka suggested that hereafter a recommendation should come from the Harbor Commission on these conditional use permits that pertain to the harbor and lagoon area before being presented to the Planning Commission, Comm. Jarvie moved that Resolutbn No, 22 be adopted granting a conditional use per- mit to Henry P. Conant under the same conditions that have been given the farmer conditional use permits in that area. Seconded by Comm. Engelmann. ,
Six ayes, Comm. Stringer absent, motion carried.
Secretary Ewald read a letter from William H. Fair addressed to the City Council, which the City Council had referred to the Planning Commission, requesting interim zoning of property to be annexed to the City for a Deluxe Trailer Park. The Planning Consultant recommended that a street be put through

Secretary Ewald reported that the Harbor Commission had studied the recom- mandation of the Park and Recreation Commission regarding the establishment of a swimming and racreational area, and that they recommended that a swim- ming and Recleational area be established east of the Freeway. However, the Park and Recreation Commission did not favor having a park adjacent to schools. Mr. Kalicka stated that the trend is that a park should be made ad- jacent to schools so that the playgrounds could be used jointly. Comm. Swirsky
