Present besides the Chairman :v%re Commissioners Fwd. Secretary Ewald. Absant Chairman Baumgzdner and Commissioner Swirsky. 2- minutes of February 25, 1958. Comm. Fennel moved that the minutas The Commission requehd the typographical. errors corrected in the of February 25, 1958 be approved as corrected and the minutes of March 3, 1958 be approved as submitted. Seconded by Comm. Jarvie. All ayes, motion carried. 3- HEARING - Resolution of Intention No. 4 - Ambulance Service and hrtnariea- -_ Notice of hearing wa5 read wherein an amendment to zoning Ordinance No. 9060 would be considered by the Planning Commiasbn, by adding to and subsection lO(bb) Mortuaries, which wwld place both Ambulance Section 1400, Conditional Uses. subsection lO(aa) Ambulance Service. Service and Mortuaries under the items excluded from the R-1, R-2 and R-3 zones. and deleting from Section 800 subsection 2. item (i) Mortuaries. The Chairman asked if *re were any comm-eats from the audience. MR. DALE GI”. owner of the Carlsbad Mortuary, stated that he had been trying to purchase property for a mortuary site; he had looked over all of the property eoned R-P and there was no property available for his use; he would need approximately 27 spaces for off-street parking; many of the property owners were against this type of building as they felt it would depreciate their property, but he failed to see where a $30,000 to $40,000 building would depreciate the surrounding properties; he had taken an. option on property located on Pi0 Pic0 Drive, and Mr.. Kalicka and . .ao Whitnall had looked the property over; Mr. Whitnall had 6tated that this property was in E. good location for a mortuary because of the traffic templated change of zoning, and the proposed amendment to the wning conditions involved when funeral processions occur; becau.m of the con- ordinance considerable time had transpired. 3nd in order to exercise the Commission were considering this amendment to the coning ordinance, his option he had been forced to purchase the property on Pi0 Pico.. If where would this place mortuaries as far as Boning? Mr. ann wan in- formed that mortuaries would not be allowed in any of the R zones if this amendment were adopted by the Council. Mr. Ginn further stated . that he had hen informed by Mr. Whitnall tht an application for a variance to build a mortuary on Pi0 Pic0 Drive would be the solution. Public hearing was declared closed at 8:OO P,M. After considerable diecuaaion by the Commiesion. it was felt the mabtrr had been presented to the Commission. It was moved by Comm. Stringer of the variance shauld be dbcusaed at such time aa a formal application that Resolution #56 be adopted, zecommendhg to the City Council that Intention 84 of the Planning Commission. Seconded by Comm, Ebright. Ordinance No. 9060 be amended in accordance with Resolution of Five ayes, Comnaissionerm Baumgartner awl Sivrraky absent. Resolu- tion #56 adopted. 4 .. MR. FRED TUCKER, 751 Arbuclsle Court. stated that he had attended mt heating of %&?request mads by Yourell, Fit a1 for reclassification of certain property located on Madinon Stre&~north of Gayd, and warn informed the heaving would be continued until the meeting of March 11. 1958. Mr, Tuckw was informed that the public hearing bad been declared 1958. and witholr'c notice to him the hearing had been held on March 3, closed at the meeting of 'Fcb. 25, 1958, therefore the Commission wag not legally obligated to notify the surrounding property owners; later in the meeting the epplicant had requested that the matter be conridered prior to March 11, 1958, and an adjourned meiting was held on March 3. 1958. At the meeting of March 3, 1958, with the consent,ofthe applicant, the matter had been postponed until such time ao the applicant presented a precise plan in accordance with the requirements of Ordinzncs No. 9060. Mr. WBitnall infarmed the Commission that at such time as thir motter ia reopened the surrounding property owners would have to be notifiadd. 5- Consideration of tentative map - Paradise Estates Unit No. 2. The tentative map of Paradise Estates Unit No. 2 was presented to the Com- mission €or their reviewo Proposed Re solution No. 55 was presented to the Commission for thit review# recommending the approval of the tentative map of Paradise Estatesa, Unit No, 2. subject to certain condi- tions and recommendations being performed by the subdivider. which had the Commission it was moved by Comm. Fennel that Resolution No. 55 been submitked bp the va+tous agencies of tbo City. After discussion by he adopted, recommendhg the approval ob tSxe tentative map of Paradise perEormed by that subdivider, as eet forth in said resolution. Seconded Estates No. 2, subject to certain conditions and recommendations being by Corn, Ebrig-ht. Five ayes, Commiedonera Baumgartner and Swipsky abaent. Whitnall and the City Engineering Department t the meeting oi r'ebruary 45. lm it was mutually agreed by the work on this pro:&m and present a report to tle Commission for their review. Mr, tV%tnall stated ellat he and Ms, Kubota had been unable to work on thia problem and asked'that the rxlattaT be continued until such time as they could aubmit a report. Mr. Whitaall reported to tha Commission tbt he had .been asked to attend the Council meeting an March 18, 1958* and he war hopeful of being ahle to spend Tutfoday Afternoon of Mmch 18th with the City intentions aa to f:b propos'zd change in the Praeway in south Carlabad.
