1- The meeting was called to order at 7:30 P.H. by Secretary Price, Present beside8
the Secretary wre Commissioners Netka, Fennel, Stringer and Jarvie. Absent
Chairman Swirsky and Comdssioner Lahlero
%he Secretary stated that Chairman Swirsky was unable to attend the meting and
that Vice-Chairman Hayes had resigned; therefore, it would be necessary to elect
a Chairman Pro Tern. It was moved by Corn. Jarvie and seconded by Corn, Netka that Corn. Stringer be elected as. Chairman Pro Tern for the evening. 3 ayes, notion carried. Corn. Stringer assumed the chair as Chairman.

MRS. GROB!m referred to her statement as shown at the top of page 6 and requested
that the word "vacatedff in the 3rd line be changed to ffclosedffo
It was moved by Cm. Jarvie and seconded by Corn. Fennel that the minutes of
April 14, 1959, be a?proved with the exception of the correction as requested by
Mrs. Grober, Four ayes, motion carried,

a. The Secretary stated that there were people in attendance who were in- terested in the request submitted hy Donald A. Briggs, Jr., at the last meeting; that the City Attorney had submitted a written opinion to the effect that. he was not able to give a decision as to the legality of the 20s in the street that is
a question that was beyo:nd the scope of his authority; had suggested the matter
could be settled through an action to quiet title; and recommended that the adminis- trative branch of the city government take no action on the requested lot split until 24ro Briggs could produce an unequivocal title to the entire parcel of land,
The Chairman stated that if the matter were again put on the Planning Cdssion Agenda, l4rs. Grober would be informed of it
MRS. GRQBGR stated that the property had been offered to her about the first of
March and that the advertisement had stated that the parcels had been okeyed by the City for building; that if she had not checked into the matter, she could
have been an innocent purchaser; and that the title company showed the street as closed to vehicular traffic only, and that briggs had accepted title from the McUonaXds.,
The Secretary stated that the City is not responsible for what individuals ad- vertise; that the hghee~ing department had grcmted a lot split to I4cUonald for 3 lots which was different from -the one presented by Hriggs; and that the property on which the McEonalds had gotten a lot split was not the same parcel Briggs ac- quired title to 2s it was a larger amaD
Considerable discussion 'gas given this matter, during which it was pointed out that
the Planning Comission sould take no action until such time as a legnl decision
had been obtained on the property involved,
4- WRITTEN COIWUNICATIO??S :
a, The Secretary stated that a letter had been received frm Corn. Hayes
in which she had submitted her resignation from the Planning Commission because of her appointment as City Attorney, and expressing a desire to assist the Sign
and Day Nursery Committees if neededo
bo The Secretary read a memorandum from the City Council together with a letter from Robert B. Ne:Lson concerning a cross street from State Street to Madison Street.
The Chairman reviewed the action taken by the Planning Commission approximately two years agov at which time a recommendation was made to the City Council that a- street. be put through :in this areao
Considerable discussion vas given this matter during which it was the decision
of the Comission that there was no change in the recommendation made previously, It was moved by Corn. Ja:.-vie and seconded by Come Netka that a memorandum be forwarded to the City Council reconmending that a cross street be put through from State Street to i.la$~son Street, this proposed street to be as sham op. the back of page 24 of the Cornunity llsvelopn~i; Plan, 5 aye^^ Motion carried,

5- STUDY SESSION:
a, Day Nursery Committee.
The Chairman stated that a report had been made to the effeot that a study was being made on day nurser:ieso but that he, a8 a member of the codttee, had never been called to a meeting,
For the benefit of the new Commission members, the Secretary reviewed what had transpired on this subject previously, and read the report of the hearing from the minutes of September 23, 19$30
MRS. CRAWFORD stated thaf, the City had paid a great ded of money for their planning and she could not unders;;and paying all that money and then not going by the plzn; that people come into the community and buy a home. in a nice neighborhood <and %hen have 20 kids screaning and hollerkng next door, with women stopping their cars all
around to let the kids ont and bick them up, and the kids were naming aL1 ower the street,
_I MKS. SKAW of Oceanside si;ated that, just for infomation, she had operated a nursery school for many pare, but it had always been in a school zone which was
important because of cam coming al1;during the day; and if she were to buy in
Carlsbad, she would not raant to buy a nice hone m.d have the possi’oility of a
nursery school next door,,
Considerable discussian vas given this mattes by the Commission. The Chairman appointed Corn. Fennel as Chairman of the Connittee in lieu of Comm. Hayes who had
resigned, and Comm, Z;Ekilc?lp to serve a8 the third member. The Codttee was re- quested to subdt a repo1-t at the meting of Nay b2th, and the Secretary was asked
to put 8 notice in the pqer to the effect that 8 Cownittee report would be subh, mitted at that time,
b, Modification of required front yard in hillside areas.
The Secretary submitted a fonmila for modification of front yard set backs in hillside areas and stated that this would do away with people having hillside lots continuously having to request variances in order to build a house where
the terrain dictates the location of the house. He further stated that khc re- quested sample ordinwce had not arrived frora &. I;Jhitndl0
The Codssion decided to hold the study on this matter in abeyance until the
sample ordinance had been received.
c. Perimeter zoning of lands served by the Municipal Water DbtrS-cta
The Secretary referred to the action of the Commission at its meeting on March 24, 1959, wherein a motim was duly made and passed to recommend to the City Council that the County Board of Supervisors be requested to ask the Counl-ty Planning
Commission to zone the area bounded by the Carlsbad Nutual Water District Boundaries
and lying outside the City of Carlsbad to Residential-Agricultura9, He stated that while he was in San Diega last Friday he had checked on this matter and found the County plans to do something about this rather quickly, and that the Commission would be called upon to make specific recommendations. The Secretary further stated that the Zounty seemed to foe1 that blanket zoning may not be feasible or practical particularly in view of the different interests involved, such as the airport development; and that a business man from Los &des plans to develop a $1,500 000 to $20 000 , 000 trailer park on the north side of the Batiquitos Lagoon,
Some discussion was give3 this matter by the Comnlission, and it was the general feeling that LA, being the most restrictive zoning, would give the property owners the opportunity t,:, request the zoning they desired,

The Secretary reaci a memorandum from 14rq IJhitnall regarding a "Precise Plan" and a "Site Plan".
After some discussion by the Commission, it was decided to hold this matter in abeyance, and the Secretary was requested to send copies of 1-k. !Jhitnal_l! s memoran-
dm to members of the Canmission, together with a supplementary sheet,
e, -nents to zoning ordinance.
The Secretary stated that Mr. 1,21itnall was expected to send some recommendations for mending the zoning orciin;lnce which had not been received, The Comission de-
cided to hold this matte? Bn abeyance until the recommendltions were receivedo
