The Secretary read a letter from Hra. Olive 3, IIeisler, dated May 25, 1959, in which she stated that the carport and rear guest house would be moved to covly with the 20 foot requir3ment. The Secretary then stated that the two structures referred to are nonconforming uses of land, and whether or not it would be per- missible to mve them might be a question of 1a.w for the CiW P,ttorney to pass on, The Chairman asked the City Ehgineer if the buildings would have to be moved back6 The Chairman stated that the Commission numbers had received copies of the EngineerOs report and the proposed resolution concerning this subdivision; and that all me- bers had investigated the matter thoroughly, No one present desired to make any comments in addition to what had been said at the previous hearing, Corn, Clizbe made the following statement for the record; "As a newcomer to the Carlsbad City Planning Commission, I gained invaluable knowledge from a meeting in San Uiego yesterdw wAth some sixty members of v&ous planning co~ssions within the county, vLewpaint is broadened, and some pre- viously 'sets ideas have undergone a distimtchange, more in line with practices followed by other cities within the countyo ffWhat we do, and our decisions, will have 2 profound effect on the future of Carlsbd, We have an excellent guide in the Community Development Plan prepared in 1957 by Gordon ihitndl & Associates, "Under consideratian tonight are two proposals concerning land bounded by Chest- nut, Adas, Basswocd and Highland Streets, covered by Area Study 3J3B of the Com- munity Tlan, (2.) Mrs. Iioisler has submitted a plat for a very fine small eubdivisfon, The lots are 18,000 sg, ft,, and minimum floor area of homes 13% sq, flt, Both features are highly desirable and above city standards, But approving this plat will solve the other landlocxed problems of Area 8R (2 ) Mr. Stone has a 96 x 200 area behind his home which would be an ideal homesite for some retind couple, lie also oms a 12 ft, access strip to this land, ht granting this variace likewise will not solve the other landlocked problems bound to come up in Area @Blo If this parcel were divided into two lots each with 100 ft, frontage, each xould have an area of nearly 10,000 sq, ft, kt, a sewer lines, two water lines, and at least One gas line, would have to go down the 12 fto sti?ip, to say nothing of power lines, "Approving these two requests would only compound the difficulties to be encountered by this or future Planning Commissions,, I asked a member of the San Mego Planning Commission how they handle similar situations. Daisy M, Stone for a split with a reduction in frontage from the required do0 - to l.20 on property located on the north side of Chestnut Avenue - between Ad= and HiRklando The Chairman reviewed what had transpired on this mattor at tho previous hearing on hy U, 19fi9, and stated that the Commissioners had checked this puce1 of property, The public hearing was closed at 8:lO P.M. Con~iderable discussion was given this matter by the Commiaaion, during which Corn. Clirbe suggested fhat the property Owners in the affected area could be asked to meet with the Commission in an effort to work out something that would be to the mutual advantage of everyone, as there are other landlocked properties in the seoticm with identical situations. It was moved by Comm, Stringer and seconded by Corn. Clizbe that Resolution No, 120 be adopted denying the request of Lawrence Do and Daisy M, Stone for a lot split with a reduction in frontage from the required 60 to lZ8 for the following reaaons t 1, A 12 road is not adequate to carry any amount of traffic of any type, 2. KAY KALICKA, of Sandie Properties, atated that he had no objections to or comments on the proposed resolution, MR. JACK KUBOTA. representing Kawtner and IIolly, stated that, as he understood it, the proposed improvements on Tamarack would be accepted, and the offer to dedicate Us was for the future widening of the streeto The Chairman stated that was right, MR. ROSSAU, UW Tawrack,, stated that his property would be landlocked by this subdivision; that it is 531@ deep running along the easterly boundary of this sub- division: that in f igur:& his property,"he had always left 30' at the rear to be used as a road; that a :EOOB block is too Long, and that this particular block could be cut into 4 blocks by running streets from Magnolia to Tamarack and from Adam to Highland; that in fii+g his property, he had always left 30° at the rear to be used as a road, and that while Carlsbad was still countyo all property owners but one had agreed to a road, be bssall further stated that there is a culvert along the back property line that drains the water coming from Highland and asked if this drainage would be run into the sewer; that there is an underlay of hard pan that canes out about 150 * from Adams St which had caused quite a bit of difficulty in the past; and that he wasn't opposed to the subdivision, but felt too many short streeta were being built in Carlsbad; and, in addition, he hated to see houses crowded into an area that would off set nicer place8 Pa. JACK KEENAN stated that he owned the property on the northwest corner of ' Tamarack and Adame; that every time it rains his garage gets flooded out: that his is a large estate and hs realized that everyone cannot build a 3500 sq. ft, houseo but that being among maw dler homes will not improve the property value; that when the sewer was constructed on Adam about a year ago, he had asked to be taken out of the district as ;?e owns 450 * on Adams, but would be willing to tie into a sewer going dong Tamamck, He then asked the location of the sewer for this sub- division; what would be done about the drainage problem; and what effect the sub- division would have on his taxes aa the man from the tax as8essorgs office had told him that the evaluation of his property would be raised about 2 times what it is nowo The Chairman replied to Mr. Keenan's questions, stating that the 88wez.s for the subdivision would be tied into the existing sewer on Adams; that one of the condi- tions of the proposed r;solution is that the proper drainage will be maintained: and that taxes were supposed to be assessed on the basis. of the fab market value of the property, Considerable discussion was given this matter by the Caamiasion, during which it was stated that there w3re other solutions for opening up any landlocked properties in the sectionD and that while there was a drainage problem, this would be solved by the City Engineer. BOB BLIXJB,, 3404 Highland,, stated that he had come to say something about the Heisler mbdivfsios!; the proposed extension of %Kinley St. was on hi8 property-and he was not interested kn selling it for a street; that he was leaving next week for the sufimer but could be reached through his daughter at the Highland Street address. A recess was dealared by the Chairman at 9:30 P,M, The meeting reconvened at 9:45 P,M, STUDX SESSIOEJ. a, Substitution 02 "Site Plan" for nPrecise Plan", The memorandum from Hr, Gordon iwtnall with the proposed revision of the zoning ordinance on the subdect of substituting #'Site Plan" for "Precise Plan" in the zoning ordinance was stfldied and discussed by the Comnission. It was moved by Corn, Fennel and secondd.by Corrrm, Stringer that the Planning Commission adopt Resolution of Intention No, 9 to hold a public hearing to consider mending the toning ordinance by changing the language so thzt "Site Plan" would be substituted for "Precise Plan", ThlS Chairman asked for a vote on the motion. 6 ayes, COIU% Netka absent, motion czrr$ed, WRITTEN COMJNICATIONS o a,, Letter from Comty Director of Plsnninq. The Secrdtary read a letter from the County Director of Planning regarding zoning of a residentialuagricu'ltural type for territory within the boundaries of the Carlsbad Nunicipal Mater District, and stating that, as projects are worked out in order of their assignme:.lt, early action on this request w&s not probable, The Secretary then stated that when he discussed the problem with them, it was in- dicated that they would take early action, Considerable discussion was given this matter by the Commission, It was moved by Comm, Fennel and seomded by Camn. Stringer that a memorandmu be sent to the City Council recommending thzt the letter of the Count$ Director of Planning be acknowl- edged, and advising the County that the Planning Commission of the City of Carlebad is ready to cooperate at any time, The Chairman asked for o vote on the motion. 6 ayes, motion carried, bo Letter fromn Mrs, Grace Oardners The Secretary rek a ma..aorandum from the City Council together with the attached letter fran Mrs, Grace 3ardner, in which Mrs, Gardner stated that the Standard oil Co, was interested in buying her property on the corner of Elm and Pi0 Pico, if the City would allow thsm to put a gas station there, and asked the CityOs cooper- ation in this, The Secretary then stated that the Standard Oil Coo has an option on the property,, had discuased the matter with him, but had not returned the ap- plication for a change of ZOn80 It was the decision of the Commission that no actdon could be taken on this matter until tho application for chge of zone had been received from Standard Oil Coo 9- ORAL CO?flUNICATIONS comma Stringer made a report on a trip he had made with the Cit;y Manager, City Engineer and members of the Public Works Cdssion to the County Engineer9s office in San Mego on Hay 23th, regarding the proposed interchange and road con- necting Paloarar Airport with U.S. 101, He explained the two plans that care now under consideration, stating that one was for Las Encinas and the other for Ponto, and that there was only 170' difference in the length of the mads, the shorter being the One to Panto, ~omm. Stringer then 8tr888ed the importance of having this ~oad and interohange within the southern limits of Carlsbad, Comm. Jarvie atated'.that he had attended the adJourned meeting of the Council which was held prior to the Planning Comnissian meeting this evening, and that a committee had been appointed Eo work on this matter, with Cm. Both features are highly desirable and above city standards.
