besides the Chairman were Commissioners Davis, Hardwick, Kistler, Jarvie

Approval of Minutgs of April 11, 1961. A motion was made by Cannirsfoner
Jarvie and sec&ded by Commissioner Hardwick that the minutes bf April 11, 1
1961 be approved as submitted. All ayes, motion carried.

A motion was made by Commissioner Hardwick and seconded by Commissioner Ward
that Resolution No. 206 be adopted recamending that Ordinance No. 9060
be amended to allow a conditional use permit on subject property, subject
to r;he condition that any structure crrcted upon the aforesaid described
property shall not be used for public dances, for the following reasons:
1. That the characteristics of such use are not incompatible with
type of use permitted in surrounding area.
2. The factors of hazard occasioned by unusual volume or character
of traffic or the congregating of large numbers of people or ve-
hicles would not be detrimental to the surrounding properties.
The Chairman asked for a roll call vote. AYES: Chairman Grant, Comnissioners Hardwick, Kistler, Jarvie and
Ward
NOES: None
ABSTAIN: Commissioner Davis
ABSENT: Comnissioner Hughes
Resolution No. 206 adopted.
HEARING - RESOLUTION OF INTENTION - - Rezoning from R-1 to R-3 of property
fronting on Pi0 Pic0 from north side
of Palm to the south side of Elm in
accordance with kesolution No. 734
of the City Council.
Notice of hearing was read. The Secretary certified as to publication of
notice of hearing and the mailing of notices to property owners in the area

There was one item of correaportcience on this matter.
Letter, dated Agril 17, 1961, from Mr. and Mrs. Joseph Bertino, 3655 Adaml,
stating that they felt the proposed zone chnnge'wouid be detrimental to
the neighborhood.
LEO?; ROUNDS, 1134 Pine St., stated that in his opinion it would be an asset
to the community and bring more taxes into the city. He felt that the
property was not good for R-1 zoning but would be good for R-3 zoning.
PERCY STIFF, 1088 Chestnut, stated that he concurred with what Mr. Rounds
had to say.
EElIL H. O'BRYANT, 1155 Oak St., stated the only reason he would oppose
this rezoning was that he bought his home there because he liked the country
and wanted a family home for his three children. He could have moved into
Oceanside or down on the beach but he wanted to be in an R-1 zone.
MORTIMER BONDY, 1150 Pine St., stated that he had not intended to express
himself tonight but those of them who have studied the situation know that
it is an R-3 zone and definitely not an R-1 zone. Most people that go
through Carl3bad do not know when they go through, and the residents arc
not developing their town to its greatest potential.
MR. STIFF stated that he had bought his home 3 years ago figuring he had
a country home. Now Chestnut has started going through there and he can-
not afford to keep his property any more. Business should be promoted in Carlsbad. There is a shopping center coming in across the Freeway and
there should be motels and rentals.
BILL BALDWIN, 1031 Palm Street, stared that his only objection was that
the rezgning did not extend further and include his property which he had
purchased because it was potential R-3 and he had a long rmge view of put-
ting in rentals. The Catholic school is going to be there and he undoubt-
edly would be making an application for a reclassification on his property.
He stated that at one time he had requested of the city that all that
property be rezoned to R-3 but for some reason or other the matter was
dropped .
MR. STIFF stated that in a few years he felt they would tunnel under the
Freeway at Chestnut Street and 5 or 6 years from now that would be a fast
street and the only one ping through to EL Camino iteal.
Chairman Grant stated that he and Commissioner Hughes and the Secretary had
been the comnittee to decide which property should be included in this re-
zoning and they felt the relief should be given to those properties border-
ing on Yio Pic0 and realized that many of the others would want to be in-
cluded, and that thky had the right to apply for cezoning of their prop-
erties in the usual manner when' they so desired. Cornmissioner Jarvie
said that as long as the committee had seen fit to include only this amount of property, Mr. Baldwin, along with any others who so desired, was invited
to make application for rezoning.
When asked by Commissioner Hardwick what it WRS thc?t he feared from this
rezoning, Mr. O'Bryant stated that his lot was 75' x 260' and was large
enough to allow play area there, whereas with apartments, there would be

no roam for play.

MRS. O'BRYANT, 1155 Oak, asked if there were any way Qf garnming the type
of rentals in R-3 zone
Chairman Grant assured her that there were many protections for R-3 zone and then showed the O'Bryants on the map that their property was not in-
cluded in this rezoning, in which case they had no objection to the reclass-
ification.
There wzrs some discussion among the Camnission about frontage roads in other cities and the fact that the need for a rezoning such as this had
been under discussion for a long time.
Chairman Grant wished to have it noted in the minutes that the only written
opposition to this rezoning, letter from Mr. and Mrs. Bertino, was from
a citizen whose property would not be affected by this zone change, their
property being on Adams St.
4. motion was made by Comnissioner Jarvie and seconded by Comnissioner Ward
that Resolution No. 207 be adopted recomnending reclassification of subject
praperties for the following reasons:
1. That it will allow this property to be put to its best use.
2. That such reclassification will not adversely affect the compre-
hensive general plan, but will rather enhance it as frontage property
is not usually considered to be desirable R-1 property.
3. Public necessity indicates that this is the best'use to which
this property could be put.
The Chairman asked for a roll call vote.
AYES: Chairman Grant, Conmissioners Davis, Hardwick, Kistler,
NOES : None ABSENT: Commissioner Hughes.
Jarvie and Ward.
Resolution No. 207 adopted.
7- New Business:
The Secretary read Comnissionet Ward's minutes of the Board of Director's
Meeting of the San Diego County Planning Congress which was held April 17,
1961 in the Grill Room of the Rancho Presidio Hotel. Those attending from
Carlsbad were Conmissioners Ward and Jarvie and Secretary Price. It was decided by vote of the delegates that there are to be four metings during
the year 1961; three lunct-eons to be held May 29th, August 28th and October
30th and the date for the dinner will be set later by Dr. Miller.
Chairman Grant requested that: the Commissioners let the Secretary know as
soon 8s possible after receiving notice of these meetings, whether they
would be able to attend or not so that he can make reservations.
Chairman Grant briefly reported on the contents of the brochure, Alternatee, Part 3, Agriculture, San Diego County Regional Plan, Objectives and Pol-

icies. Since the other Conmissioners had not had the opportunity to study
this, the Chairman instructed the Secretary to place this matter under
"Old Business" on the agenda of the May 9th meeting.
The Secretary brought up the subject of the Tentative Subdivision Map for
Lebarr Estates, Unit #2, which has been placed on the agenda of the May 9th
meeting, however, he explained that there were a number of engineering
problems that have to be considered and that it might not be ready for con-
sideration at that time. Conmissioners Davis and Ward were appointed to
assist Chairman Grant as a comnittee to make a preliminary study of this
subdivision.
Commissioner Hardwick brought up the area of Carlsbad along Vista Way and
Haymar Rd., adjacent to Oceanside, which he felt some thought should be
given towards rezoning as an industrial and manufacturing area. He stated
that it had easy access to the Freeway anddthough it is not near a rail-
road or spur, there are many types of light industry that do not need to
be and there were many other things that made it a good place for that
type of industry. Comnissioner Hardwick was appointed Chairman of a com-
mittee to make a study of this matter with Commissioners Kistlerand Jarvie
to assist him.
By proper motion the meeting was adjourned at 8:50 P.M.
