I I * I I I i The recording secretary read the notice of the special ; meeting for the purpose of considering the final maps of ; Shelter Cove Subdivision and Glenview Estates SubdivisiorS. i Chairman Ewatd explained that final subdivision maps did I : not go before the Flanning Cornmission until recently.. €34 I stated that he was abstaining from voting because of busi-: : ness interests in the Shelter Cove Subdivision and Vice- i I I Chairman Ward took over the "Chair". I I I I I I I I I I I I $ 8 I I I I i SHELTER CCVE MNAL MAP. I The City Engineer, Lowell A, Rathbun presented the I I I final maps of the subdivision. 1 I i The Assistant Engineer C. X. Thornton pointed out that ; the major change in the final map was that Park Drive i i generated a curve approximately 200' from the easterly ; I subdiviston boundary's onsite, then generally following i : Kelly , Carlsbad Bay Properties e and the Fhipps property; i The Engineering Department generated a curve of a I I i larger radius as it reaches the subdivision boundary I because of the topography of the land east of the subdivi- i sion. I I I The City Engineer stated that Park Drive was originally 1 ; submitted to go down to the waterfront and follow the I I t waterfront easterly, which affected property owners now I i do not want. The Engineering Department moved the t I street over 30' to prevent a sharp curve and excessive CU~. Mr. Thornton stated that the new curve of Park Drive I i will become tangent to the centerline of the 60' road ease+ i ment at approximately the same point that the original ; curve did. i The Planning Technician presented his written recornd- : ations to the Flanning Commission and Vice-Chairman i the alignment of a center line of 60' road easement of the f: ,B' I I I # I I I I I I I ?Vard asked if he had anything to add to this report. The Flanning Technician pointed out that when Pirate's Give pointed out at the meeting that variances would be neces - : sary on Lots 4, 5, 9, 43 and 62. Lot 43 is to be a park{ ing lot for people launching boats. At 4 o'ciock the City : i had not received the recommendations of the San Diego I : Gas and Electric Co. I t I I I / had applied for a variance on February 26, 1963, it was I I & 1 4 I I The City Engineer stated that he had heard the Son Diego : Gas and Electric Company's report orally and asked for ai written report. With a reduced front yard, the poles I i would have to overhang the buildings. i The Planning Technician showed on the map where the ; ; poles would be on a curve and the lines would overhang on: i the property. Mr. Thornton stated that he had made a statement at the i i meeting on February 26 1963. that he did not know what i ; the lot lines would be on the final map. He did not pick I ; out any special lots as he did not know what they would be 1 I I I t I I I I b I 4 I I I I I I I I I 9 I I I I I I I I I I I & I I b I b I i The Planning Technician stated that Firates' Cove could : revise the dimensions on these lots to where they will ; I conform with the Ordinance or they could file for a vari- i : ance. I The City Attorney pointed out that the Grdinance did not call for the whole Planning Commission to approve a fins; : map as it can be signed by the Chairman and the Secretarv i of t~ Commission. * I I I I I I I I I 1 I Commissioner Grant explained that this was done this : way until about a year ago when Commissioner Davis : called attention to the grading plan as he has had problem! : on his property caused by the grading of a subdivision : adjoining his property. R . R. 3OBINSC.N stated that the plans have been under i consideration for 6 months by the City and they were not : ; notified that these lots were non-conforming. They had I made a trip to Los Angeles that day to complete negotia- i I tions ancl it was cosint them $70. per day. They are try? i ing to do this in the proper manner but their engineer wa5 I not notified that the lots in question were non-conforming4 : Mr. Thornton asked if it would be permissible, since in i i the past the final subdivision map d.id not come before the! t Planning Commission, to approve this final map subject i to the variance being applied for. i ROY KLEMR, Engineer for Pirates' Cove, stated that he i I would not have handed this in knowing that there were 5 ; : lots that needed variances. This map has been before thd Engineering Department and they should have been warned : of this earlier. I b I I I I I I I I I I 1 I 4 $ * I I I I I I I i .Mr. Thornton stated that he was not aware of this until i late in the afternoon. I I I 1 I 1 KEN EERIGNT stated that he believed there was a provi- i I sion in the orc3nance that would take care of this matter . i I The City Attorney stated there were special circumstance$ I that apply to the property because of the unusual size and : I unusual circumstances. : FZANM DeVCXE San Diego Gas and Electric Company, : i stated that he brought the letter in and Mas not able to ge; it in before the meeting. The problem of the wires could i ! be changed by putting in higher poles and he believes they: can work something out. I ; The recording Secretary read the letter from the San Diedo I Gas ancl Electric Go., regarding the poles and wires. I : Commissioner Grant asked Mr. Thornton if they could i I I I I I 1 I *I I I I I I t I I 8 I figure this out. I I I I t 1 I ! Mr. Thornton stated this was brought out at the hearing : : for a variance, and it was pointed out that the building I i inspector would not issue building permits unless they I : had the proper setbacks and clearances. I RCY IZLEPdtA stated that the power company is putting : : these poles on the inside of the walk instead of on the out: i side. Mr. Thornton stated that when the poles are placdf 1/2' i : from the curb as they did on Cbedtnut, there was strong : i opposition from the Council 2nd the public. ROBINSON asked for a detailed report of what is . !necessary for them to have at the next meeting to avoid ' i :the embarrassment they had at this meeting. I I I I I I * I I :FINAL MAP OF GLENVIEW ESTATES. 1 t 1 i I :The Planning Technician pointed out this property on the i I tentative map, I !The City Engineer stated that this map has met with the i :requirements of the ordinance. There was a discussion ; :at the Council in the requirements of the projection of : sewers to this point. I !Commissioner Davis asked if there were any grading plan4 :or leveling to be done. I iThe City Engineer showed the grading plans and stated :that the subdivider would have the improvement plans at ; Ithe Council meeting. The bond improvements would not i :come before the Commission. I I I I I I 1 I I t I I 4 1 I I 4 I b I !The City Engineer stated that he will certify that this map :is correct. The City does not require letters from the i iSan Diego Gas and Electric Co. , unless there are ease- : :merits. The poles will be placed in the parkways so there ; :are no overhanging of the lines, I :Mr. Thornton stated that they have a letter from the San iDiego Gas and Electric Co. and there is no conflict with i jthe street. : Davis :It was agreed to approve this final map of Glenview : Grant :Estates as presented and that the Chairman and the Ewald !Secretary be directed to sign this. ; Palmer !The Chairman s&ed that he had a request from both sub- : :dividers to hold this meeting which is not a public hearing.! :Prior to this time, the finaL map was signed by the Chair- : :man and the Secretary of the Planning Commission, but i jsince it has to come before the Commission, it delays the : :signing for 3 weeks. !It was felt that the Commission is responsible and they did! :!p;i jnot feel the responsibility should be entirely upon the Chait- :I1 1 :man and Secretary. :The Chairman stated that the only way one could be sure i ithat the map is correct is to check with the Engineering . ; :Department. He would not have called the meeting if he .: '4:: !had known of the irregularities of these lots. I # I : The City Engineer stated that he would like to make it 1 clear that he had stated if these plans were in by Monday 1 I morning, they would do all they could to cooperate, but i ; they did not foresee these nonconforming lots. When the : Engineering Department get these requests in for a specia$ I meeting they have to set aside all other work in order to ! woik on this. He apologized for not having a written I 1 i report and that he could only give a status of their report.! I I I s t I Commissioner Sonneman stated that the Engineering strain on them. ! Department are doing a good job and they have a terrific I I I 1 I i KAY KALICKA P. 0. Box 7 1 , stated that this is the only; i City that he knows of that requires finalmaps to come ; back to the Commission for approval. The Engineer has i no legal reason to sign it unlesa it is right. The reason i : this map was delayed was because he has been in court, : I and the City Attorney and City Engineer have also been in ; court. Me did not know about Shelter Cove and it was just! I a coincidence. He questioned whether it was necessary 1 ; for a final map to come back to the Commission if there i i were no problems, and if there were unusual conditions, : ; then it could come before the Commission. i The Chairman pointed out that the subdivider's and the I i engineer's reputation were at stake Lf the final map did noi : meet the requirements. I I I I I t I I t 8 I I I I Commissioner Grant askedCornmissioner Davis if they I i could come to some agreement if the property did not : : require unusual grading plans. I I : Commissioner Davis stated that the tentative map gives i i no idea of grades and contours. In the past they left it up : : to the City Engineer and the subdivider's Engineer. The .i I City Engineer has stated the Engineering Department are : i not concerned with property outside of the subdivision i : and merely looked at the property in the subdivision. : Commissioner Davis stated he did not believe it is the i function of the Commission to have to know the techni- : : calities, and that it was up to the Engineers, staff and i I subdivider. Fie wants to do what is best for everybody. : The City Engineer stated that he does not believe he ever made the statement that they were not concerned with i : adjoining property and that they always consider surround+ ing property. In all cases the Engineering Department make a brock study to see if there will be the proper : drainage proper sewer, water system, etc. He is very I much in sympathy with Commissioner Davis, but there is : : no provision in the grading ordinance relating to the I detrimental effect to propert$ value, but is limited to i i safety and drainage effects upon adjoining property. i MR. KALICKA stated that the grading plan of the lot : could have been brought in and then the property could have been graded wrong. He believes when this has ; happened, it has been done by "one-shot" developers. He i pointed out the rigid requirements of the FHA and that : i they are just as concerned about the adjoining property. i It was pointed out that the Mayor had established a comrnib \ set up recommendations and standard specifications for : I developers to go by and they will have a booklet on this i i in a few months. : ADJOURNMENT: By proper motion the meeting was i adjourned at 9:63 P.M.
