I 0 !Report. 1 :Secretary Grant read a memorandum from Robert A. John; Iston, Engineering Department regarding entrance gates in i :other cities. He reported that Oceanside, San Diego, IEscondido, Laguna Beach, Newport Beach and Orange :County did not have any policies or ordinances on entrance : tl:lll
:gates to subdivisions and are handled as a part of a subdivi; :::::: :sion. He also reported that the City did not have adequate j @*I &I I :personnel at the present tine to maintain the plantings at ; :entrance gates. I I i:::;, I:

:When questioned as to the responsibility of the City, the : :City Attorney stated that the City would be covered by an i :insurance carrier if anyone was injured on the property I belonging to the City. I I
!Mr. Thornton stated that it would not increase the inauran& !fee, but would create a problem of maintenance. The sub-: :divider was required to put in the fence in lieu of street : iimprovemuts. The Engineering Department requires that i :a subdivider improve to full standards, curb and gutter, : !and paving to the center of the street. This subdi..<der has: :opposed this on Chestnut Avenue because he has through : !lots, and will be putting in these improvements on the frontj :of these lots. 0 I
!EDWARD HUMMEL, Chairman of the Parks and Recrea- i jtion Commission, reported that the Commission has in- i :spected this site and felt the maintenance of the landscap- : iing was feasible and it is ahbdy landscaped. The Commisb :sion ruled by a majority vote of 5 out of 7 that the City : :should accept the entrance gates at Chestnut Heights, how-: :ever, he did not realize the gates were taken into consid- : Ieration. He stated that he felt that DMJM should consider i. :this also and the City might be able to work something out ' ;in the next 3 years to be able to handle the maintenance of i :these entrances.
:After considerable discussion, a motion was made to send {
!a memorandum to the Council stating that although the I I :Entrance Gates to Chestnut Heights Subdivision are of ac- i jceptable design, nevertheless, accepting the entrance gateg :as City property would additionally burden the maintenance: :and park crews when they are not now able to handle all ; tnecessary work, that it would iucrease the City's possible . :liability for accidents or negligence occuring at or around ; :the gates, and that accepting and maintaining the gates I 'yould nor benefit Carlsbad Citizensas awhole but merely : :those living in and around the subdivision since the above I !stated reasons apply equally to all offers to deed entrance ; gates to the City for upkeep, the Commission recommends i $hat our present entrance gate policy be revoked. !Mr. Thornton stated that the Engineering Department has [
:had a problem for the past six years on the traffic created ; !by the intense use of property after it is rezoned. Without i !a precise plan the greatest problem is in the commercial ; :area where you are allowkd-to build to the property line. ! :He stated that he would like to see slope and fill embank- ; !ant easements added to this resolution. This ordinance I jwould not only apply to every street in town, as it would :apply to limited areas where you have a lot of traffic and : !limited right of way. It would cut down on the necessity of! :obtaining rights of way in the future which can be very i jcostly to the City. I I
!Also discussed was the fact that some cities require that ! :before obtaining a building permit in R-3 and commercial jzones that they check with the Engineering Dept. regarding: :street dedication, rights of way and street improvements. i !The Building Inspector will not give a final release until : :the Engineering Dept. has said these things have been done;

!Citizens Committees. The Chairman stated that he had writ: iten a letter to the Council to send with the names of the ci-: :tizens for the seven committees on the Master Plan of the :City and asked the commission to look at the rough draft of:

!The City Manager stated that Mr. Norwood would be in the !City Thursday, Sept, 24, from 10: 30 on and would have pres :liminary drafts of the General Plan for the Commission and !committees toleview. The City Manager stated that he I jwould see that each Commissioner received these reports ; ;as soon as possible.
