I I I lChariman Sutherland explained that Mr. Adler has submit-! jted this tentative map but there were problems that had to i
:be worked out with the rights of way for the extension of ; ;Elm Ave. through this property. Street dedication was :given when the tentative map of Falcon Hill Subdivision wai :approved by the Planning Commission and by the Council. i :He explained that at the last meeting Mr. Adler and his ; :Engineer and the City Engineer and City Attorney were to i jmeet in order to work out a solution for the extension of ; :Elm Ave, through this subdivision.
:Mr. Adler presented a written report on Carlsbad Country: !Homes explaining Exhibits "A" through "HI' and that the ; :terminus of their proposed extension of Elm to El Camino i Real was taken from the County Master Road Plan adopted : :in April of this year. He stated they are standing with jthe original subdivision plan as submitted with some modi-: :fications and presented an alternate map. I I
:Mr. Johnston pointed out the location of the proposed eub - i :division and the proposed extension of Elm Ave. on the mat.
:Mr. Thornton explained the grades and the cuts that would :be required in the grade of Elm Ave. proposed by Mr. Ad. jler that would be 7% in some areas and as high as 10% in :others. He reported that the Engineering Department i saw no further evidence in changing the re-routing of Elm :Ave. as they felt that for the general well-being of the CitJ it is desirable to have an East- West throughfare and they :tried to relieve the strain by having Tamarack extended to !El Camino Real. He pointed out that Chestnut terminates
:at the freeway and there is a need for an East-Nest route ;to the beach area within the next five years. He stated :that the Engineering Dept. stands on their recommenda- ition of October 7, 1964, and 8aw no reason to change on :this as they feel this route would be the least costly for thc !City to acquire. He explained that when the tentative map

/of Falson Hill Subdivision was approved by the Planning jCommission of August 13, 1963, and by the Council on I ;August 20, 1963, dedication for street right of way was ; !given for the extension of Elm Ave, and if they used the i ;proposed route suggested by Mr. Adler, it would cost the ; !City approximately $100,000. because of 5 homes that i lwould have to be acquired in Falcon Hill. The subdivider : :has received financing of 4 homes and there are plans in i lthe Building Dept. for the 5th home. He also pointed out ; ithat the terminus proposed by Mr. Adler for Elm &El i ICamino I Real.was'ngt thehame as the City desires. I
IMR. ADLER stated that he would like the first map they pr$- Isented as he believes it would give them 2 extra lots. He i jfelt the land in the direct line of Elm Ave. could be used : ;for better use and he would be willing to dedicate 2 1/2 or i 13 acres for park purposes or a desirable portion for an : iamphi-theater.
!The Chairman stated that this was not pertinent to this coni lsideration unless the Commission wants the park in lieu : of the extension of Elm Ave. I I
There was considerable discussion on Elm Ave. being pra -, ~cised planned and Mr. Thornton stated the Engineering : ;Dept. will definitely consider Mr. Adler's route, The I 'Council directed the Engineering Dept. to precise plan E14 Ave. in 1961 and the Engineering Dept. staff has always ; been conscientions of alerting the public concerned of I I this extension.
After further discussion a motion was made to adopt Reso-! lution No. 377 disapproving the tentative map of Carlsbad i Country Homes subdivision for the following reasons: I I
1. That this map does not conform to the requirements! of Section 200, Ordinance No. 9050 of the City of Carlsbadi since the approval of this map would interfere . with the ; proposed projection of Elm Ave. to El Camino Real as i stated by the City Engineer and as shown on the tentative ; map of Falcon Hill subdivision approved by the Planning : Commission on August 13, 1963, and the Council on Augusf 20, 1963. I

Secretary Grant read the proposed resolution and the City Attorney and Mr. Thornton explained the necessity of I I ha ving this. I
The Building Inspector commented that there was a ques- : ion as to the legality of withholding a building permit until property owner deeded additional right of way.

;Dr. Palmateer read the proposed resolution and reported *I . : :that the committee from Oceanside are willing to cooperat4 and made a few changes on the rough draft of the resolutioxl.
I Points discussed were that the main concern of the lagoon i :now is the water, and that pumping the water in from the i i ocean would kill the migratory water fowl; the R-T zoning : :that was granted to the Apache Corporation for the Bird Island Development; if it should be a park, the communty : ! should get together and buy it by means of community pro: ; jects; if homes are built on this property, it would prevent: I this lagoon from ever becoming a harbor; the need for re- i L: Wing this for an open space area; the forming of an As - : i sessment District for the development of the lagoon; the ;fact that Nature Conservancy might be willing to give the i property to the City if they are not able to trade or negoti-; : ate for other property; the new owner of the property i zoned R-T on the lagoon will be faced with the problem of :water and access to this development: the State acquiring i i the Buena Vista Lagoon for a State Park. ; The Chairman explained that the first meeting of the 7 citizens committees would be at the Council Chambers on ; i a separate night from the regular Planning Commission ;meeting, and the Mayor would be present to welcome themi I and to give them a "pep" talk and explain the rules. He 1 ;stated that he felt that a representative from DMJM shoullli ;be present at the meeting and copies of the Master Plan ; i should be supplied.
The Chairman instructed Mr. Johnston to draw up a com - : I plete set of maps from a copy of DMJM's colored map for i ; these committees.
