i Dr. Palmateer reported that at the last preliminary meet! i ing of the committees of Oceanside and Carlsbad, they : : read a list of the reasons that compelled that action be i i taken on the Buena Vista Lagoon. These reasons were : : supplied to the committees for their study. They have th$ i cooperative attitude of the City of Oceanside and they feel ; : that this is a logical time when such a study should be i pushed along. He reported that I/ 9 of the lagoon is in : : quasi-public ownership, being the Nature Conservancy an4 Buena Vista Lagoon Association. He asked for the legal : : opinion of the City Attorney about the private property as i some want water over their property and some do not, : and questioned the liabilities involved. 1 1 t I

The City Attorney explained that a private property owner! could fill his own property with water but that he could not: flood his neighbor's property unless the other property i owner wished this. If the water level was raised on his i neighbor's property, they would have the right to protest ; this through the courts, and property owners at the mouth: of the lagoon would have the right to let the water out of ; the mouth of {the lagoon. 1 I I I I i Dr. Fhlmateer stated that one of the problems is that the : I lagoon property is in the two cities and questioned forming : a district and who would control it. I I I I 1 I I I I (b) The Vice-chairman announced the Citizen's com- i mittee meeting for the Master Plan for the City at the Magnolia School on Monday, November 30, 1964, at : 7: 30 P. M. , and that Mayor Neiswender and-Paul Neal i from DMJM would be present.
Dr. Palmateer called attention to the Home Section in : the Sundey Times which featured 3 or 4 pages regarding I lot sizes.
