IHCWAi3D F. BARTON, stated that he and the other proper6 :owners were in favor of the zone change as his business :

bs to the hazards of R-1 zoning to the businesses now lo- i kated there. City Attorney Wilson stated that some of the : Imsinesses would have IS many as 50 years under the zonr i Sng ordinance and that each business would have to be con- : iqidered before a definite answer could be given. It was fquestioned whether the property owners would be willing to:

! 8 PAUL Vi ESTON of Vdeston Trucking stated that he request: i ed the zone change as he had bought some of this property ; :with the City Marrager's and Engineering Department's i reassurance and welcome and that they felt sure the zon- : jing would be made adequate for him to operate his businesi ; in this locality. Mr. Weston stated his plans to build a : i trucking terminal for loading and unloading his products
junder R-1 zoning. He reemphasized that he had conferred: :with the City Manager and the Eggineering Department be- ; i fore investing in the land and that they had welcomed and :encouraged him to come in and build.
:Go McDOUGAL of McDougal Sanitation stated that he had :
:bought the property 40 years ago and set up his business 1 :there since it was isolated from the problems of city zon- I iingend-residences. He requested that the zoning be chang-:

iH-1 McDougal would have to move his business within five i !years. I
PAUL IVICEVIC stated that be requested the zone change i !as his business of growing and transporting tomatoes would :have to be discontinued as R-1 zoning does not allow it.
IDAitdEL HAFF commented that he thought consideration i :should be given to the fact that the land could be used in : jthe future as a recreational area with facilities because of i $he closeness to the ocean. He stated that if it became a : :C-M zone it would be detrimental to the uses he intends $or his 36 acres south of the proposed zone change which is! :to build a high class residential area. I I
F1ALTE.R DeVORE, co-owner and partner in Raff & Asso- i :ciates, stated that billions of dollars could be invested in .1: $his land, but the C-M zoning would be detrimental to that i fype of development.
:<he public hearing was closed at 8: 50 P. M.
it was noted that Mr. Baney., property owner of a section ::;i:i bf land under reclassification of zoning, had not signed nor ; i:::j; Bgreed to the zone change. The City Attorney stated that I i::::: the reclassification could still be voted on to include, Ba- ;

ICmn. Grant suggested that a resolution be read denying I !reclassification of this zoning stating that a special inter- : pention permit might be obtained from the County Health I Department for Mr. Martineau to operate his dog kennel, : iand that special use permits be obtained for the other 0 ?msinesses permitting them to build and/or operate their i
:business legally.
!Mr. Weston pointed out that he has been operating under a i jspecial use permit in the Encinitas area as his business : was in operation before zoning took place. He commented i khat he was not able to expand or improve his business : bhich in turn has forced him to break the ordinance which I
$e does not want to be forced to do here. I
!After further discussion, Cmn. Grant moved that Resolu- i 1: ion No, 384 be denied for the following reasons: I
: 1. Requested zoning would be incompatable with the ifuture use of this and aaacent land. 0 I : 2. Property is very close to the Batiquos Lagoon whic~ !someday will be a harbor with an ocean opening. I I : 3. The new freeway will be east of this property and : - ithe present freeway will become a local street. I 0 : 4. Allowing the requested rezone would be detrimental:
$0 surrounding property in relation to its highest and best i hse. *
