S, Freeway XI-S. D, -2B. Applicants: George ik, and Lily Steltner. Notice of hearing was read. Secretary Grant certified that notice of the public hearing was published and sent : to the property owners in the area, and then read the application. There was no correspondence on this request. Commissioner Palmateer was present at 7:43 P, M. Chairman Sutherland declared the public hearing open / and announced the Commission would now hear from the : applicants or their representative and any others desirine to speak in favor of this reclassification. MRS. LILY STELTNER explained that the propekty is zoned it-2 which allows duplexes and they want to build i 1:;I:: more buildings on this property. 8 1 11 Mrt. GEGi-iGE STELTNEit stated that they have owned ! this property for 10 years and there are no deed re- strictions on the property. The Secretary presented a sketch of the proposed units i they would like to build. The Chairman inquired as to the affect the Freeway widening would have on this property and if the applicant4 ;t+; were aware of this. I Mr. Thornton explained that the State has presented the I City with a map of the proposed widening of the Freeway : through the City. The public hearing was closed at 7:51) P. M. Upon being questioned, Mrs. Steltner stated that they i have had several persons desiring to purchase the property but they objected to the zoning. The City Attorney informed Commissioner Palmateer i he was eligible to vote on this matter. After further discussion, a motion was made to adopt I aesolution No. 400 denying this request for reclassifica-i tion for the following reasons: I I $ I I I I * b I I t I 8 I I I I I I I I I I I 1. I The Planning Director said that a legal lot split was pending and suggested if this variance is granted that it be I I granted subject to approval of the lot split, or that the i Commission continue this hearing until' the lot split is ; completed before taking action on this variance. The Planning Director stated that in the future variance I applications will not be accepted until lot splits have I I been completed. Don Briggs, Jr., commented on the expense involved in i obtaining a lot split due to posting a bond or putting up : the cash for improvements, and stated this is a big expense to go through if the variance is not granted. He stated that it is possible to build on this property with! out the variances, but would be better with them. Some of the hedges grow to 12,15 and 25 feet and: : have trunks 5" in diameter and are used for privacy and wind breaks. He referred to Section 16.12 in the City ; : Code and asked for a clarification between hedges and treeh i The present ordinance states that hedges in the front yard : : setback cannot be over 42" and hedges in the side and rear: !yard setbacks cannot be over 6'. I I I I I I I I I I I I I I I 1 I I I I i The City Attorney discussed adopting a resolution of :intention to amend the ordinance. :It was the concensus of the Planning Commission that this i matter should be brought to the attention of the Parks and : Beautification group. iDGN BdIGGS, JR. offered to bring the matter to the Park; ; & Recreation Commission's attention at their June 28, 1969, :meeting.
