He stated that the applicant requested amendment to conditional use permit adopted i :'October 9, 1956, to allow .reduction in parking I I spaces to construct a Parish Hall and Adminis- I tration Building. He pointed out on the map the ; ,: parking spaces that would be provided. He stated1 I that in 1958, the Planning Commission adopted a I site plan which showed 10' sidewalks on Carlsbad ; Boulevard and 150' Westerly along Cedar Avenue. I I The installation of the sidewalks were deferred : I for a period of 36 months but th%y have not been I : installed at this time. The church when completed :-will be able to contain 307 seats and the public I meeting room will contain 2700 sq. ft. The I : Zoning Ordinance requires that each use on a' I : given site must provide off-street parking.. The : : applicant proposes to provide 54 parking spaces ; I which is the requirement for a single use but I I not for a joint use. I : Mr. Lill, stated that the only recommendations I would be that the sidewal ks along Carlsbad I ; Boulevard be 10' in width and five (5') feet I I on Cedar Avenue. Also that the east half of Garfield Street is used for driveway access. I : Chairman Little stated that the 10' sidewalks on I : Carlsbad Boulevard and the 5' sidewalks on Cedar : 1 Avenue were the original requirements. He asked ; I the City Attorney what the procedure would be I : in this case. I I The' City Attorney stated that these requirements I I had no w.ay of knowing why the improvements were I I not put in on Carlsbad Boulevard. ; Whsen questioned if the curbs'and other improve- I I ments were installed, the Planning Director : slated that the curbs and improvements were I I installed but not the sidewalks. : The Chairman announced the Commission would now ; ; hear from the applicant or his representative. I I MR. ALLARD, Architect representing Saint Micha'el'l I Church, stated that the reasons for the request I I for an amendment to the conditional use permit is: I present site is adequate for the orderly,growth I : future needs of the church and find that it 1 provides adequate space for the development for I I a church complex. He indicated on the map what I I they have provided for the church facilities. I I I Building ''A" is the existing church which con- I I tains 153 seats. Expansion for the larger class room I I I will be provided for the library and in the I ,I ,I I I I I :-meeting hall, which will be the lower floor of I ; Building 'I&". He pointed out where the proposed I I I Parish Hall will be located. The Parish Hall I : will be for ;church suppers, social gatherings, I and special meetings. They will also provide, I I in the lower floor, a kitchen, business office I I 1111l1 : and a library. He indicated'on the map where I ; the court.:yards were located. The parking lot I has access off Garfield Street and Carlsbad I 111111 : Boulevard. It provides for 54 parking spaces :.which is 3 more parking spaces than required I I 111111 I by ordinance for the' church itself. In addition ; : to the 54 parking spaces an ., additional 26 I ; spaces will be available on the perimeter of the : I property, because of the fact that the property ; 111111 : does face three (3) streets. The planted areas I ;will provided 5.2% of the parking area in order ; I to maintain shade. He felt that the application ; : for the amendment to the conditional use permit I I should be granted. They are not providing any Ifacilities that would differ in use then those I : provided for in the conditi-onal use permit. I Carlsbad is the only City in the County of San : lDiego that requires parking for more than one ; of the assembly areas in the church- complex. In I I reference to the sidew,alk situation, he pointed : .:out that they have no objection to -this. He :also pointed out that there are no plans to 8 build at the present time. I 1 111111 property on Ocean Street 1s a highly.valuable I :property and that it should be given consideration: :before a decision is made on the parking. I :Commissioner Voorheis stated he agreed with ;Commissioner Palmateer in that parking faciliti'es I I #will be necessary for future 'development and I :disposi.ng of this property future parking might I Ibe difficult to obtain in the adjacent area in I I I Ithe future. He felt that the I street improvements and sidewalk requirements along the balance of Cedar Avenue and Garfield ; Street could be waived and be constructed at the I time they start making improvements. He pointed i out that in five'or ten years from now 350 seats ; will probably be too small'. I Mr. Allard stated that it has been a church . I policy to build a certain size church. They would prefer to build in a different location rather than over build a church. In regards to ; the amount of parking spaces on the existing I site, he stated there are 26 parking spaces. It is approximately the same ratioCthat they are I I requiring for the church. I Commissioner Palmateer stated another consider- I ation would be that it fronts on the main boule- I vard and that the church is approximately one I block from the beach. There is vacant land in I this apea, and will eventually be a high density I residential area as the town develops. I I Mr. Allard pointed out in a high density area many people will walk to the church rather than ; drive to it. I Commissioner Smith asked Mr. Allard if he had the authority to say if the lot on Ocean Avenue I could be used for parking for the church. Mr. Allard stated he bid not have the power to I say. He did not know exactly what their thoughts: were but he was sure that the property was far ; too expensive to use for a parking lot. In I r-egards to the sidewalks on Garfield Street, he I stated that it was not their intention to pro- , I ceed without installing the improvements. They I would certainly want to put the street improve- : ments in at the time the parking lot is constucte?, so that,there is no objection on the part of the I applicant on the total future plan. He felt from the ratio: they have now, the parking for ; the church site will be adequate. I MR. HARRY PRICE, 405 Tierra Del Road, Catlsbad, I member of the Bishop's Committee of Sa5nt Michael's 'Church, which is the governing body for: the Mission Church, stated that the property on 1 Ocean Street is owned by the church and is tax- I able property. The taxes on this property are : so high that .it is no longer feasible for the' ; church to keep it. They cannot pay the taxes I on this property. I When questioned if there were any plans for the use of this property, Mr. Price stgted that they: have no definite plans. It'will probably be on I some form of long lease. On the question of the I beach location, he stated he would like to call I to the Planning Commission's attention that there: is no public beach in that location. I I 111111 Commissioner Palmateer stated that the applicant I is not planning on thjs change of use. In five ; years time the Commission .may find,that b# I granting this conditional use permit with these I specifications,that they wished they did not grant; it, due to the problem of the parking. He felt I that if this was granted that a time limit of approximately 5 years be put on the conditiona! use permit. Mr. Allard stated that this wou1,d cause a hard- I shi.p because this is exactly why t.hey have presented this application. They feel that the parking is adequate- Commissioner Smith stated that this does not seem to unreasonable. The only time that the parking would be the heaviest would be on a Sunday niorning. I I I11111 Chairman Little 'stated that sidewalks should be I required along Carlsbad Boulevard and Garfield : Street. A poution of Cedar Avenue, which was I originally requested,for improvements,shouldbbe I mandatory. I I After further discussion, a motion was made to I adopt Resolution No. 551, granting the adeadment : to existing conditional use permit. on property I )t the Northerly side of Cedar Avenue, between I Carlsbad Boulevard and Garfib'Pd Street, for the ; following reasons: I 1. That it would not be detrimental to the surrounding properties. 2. The parking requirements will not be materially affected due to the fact that separalbe: uses will be made of the buildings. He stated that sidewalks are not a park of the I I industrial park. They are not creating a walk- I ing traffic between one industry to another. The I :Council has requested that this matter be referred: I to the Planning Commission for their comments I :and report prior to any action being taking by : the Council. ;The Secretary read the letter dated April 9, 1968,: :from Fred H. Lance, Business Manager, requesting ; I approval of the combined sc'hool development and I : city park. I I :The Planning Director presented a map and explaineh :the location of the proposed combined school and !park site. He stated that some time ago Dr. I : Harmon and Mr. Fred Lance indicated to the City I ithat in reviewing the future expansion in the larea, they would have to have another school site.: they have selected 2 or 3 locatiors that might be I :possible for a school site. The Planning Depart- : iment has also sleuaied these various school sites ; land -other adjoining street patterns and found I :that this was a good location for a school site. : :This site was not located- in the General Plan. I they have reviewed the recommendations of the :General Plan but found that i.t did not allocate : I enough land for.the school site. There is a need ; Ifor a reservoir, He stated that the main I :consideration for the Commissioners is if they I I lapprove or disapprove of ,this school .and park I : combinationsin this location. :When questioned if the reservoir would be used :for water or for fire protection, Mr. Lill stated :that it will p.rovide zone-one pressure. It wili ; be used for both water and fire protection. The I :reservoir will contain a million and a half lgallons of water and will be about 135 feet across; land 20 feet deep. I :Mr. Lill also stated that there has been no study ; of the.schoo1 site made by the Engineering Depart-t :merit, the only recommendation would be that they : :require full subdivision improvements. There was not a recommendation for a I I I school site in this particular area; but they I : find themselves in a position where they will be I 1 faced with additional population within the I I I presently populated areas'in the City. At Buena : Vista School and Magnolia School there is an over1 I population of 150 students at the present time. I I I He also pointed out that the six,th graders that : : attended Magnolia School ar? all a.t Valley Junior1 I High School. Sixty of the sixth graders at Buena: I' Vista School are-also at Valley Junior High. He : ; will build approximately 220 homes. Theyhave I I I estimated approximately an average of 1.2 elemen-: : tary students per home. In addition they have I I projected somewhat into the future and have I : anticipated a total population ifi the area. They: : find that approx-imately 50% of the usable acreage1 ; id developed in the general area now. They also : . I find that the present schools will only handle : I I about 50% of the pupils. They have estimated I 1 that there will be a need for five elementary I I schools in the future. : When questioned how far the proposed site would : : be from Magnolia School, Dr. Harmon stated it is I 1 approximately 3/4 of a mile from Magnolia School.I I : After further discussion, the Planning Commission I I park site.
