APPROVAL OF MINUTES: (a) Minutes of the regular meeting of March 11, 1969 Motion X were approved as corrected. Ayes x xxxx WRITTEN COMMUNICAT1,ONS: (a) There were no written communications. ORAL COMMUNICATIONS: Director Olinghouse extended an invitation to members of the Planning Commission to attend a meeting of the Housing Element Citizen's Committee being held Wednesday, March 26, 1969 at the Pilgram Congregation- al Church on the corner of Chestnut and Monroe Streets. PUBLIC HEARINGS: fa) RECLASSIFICATION - continued, To consider an application for zone change from R-1 to R-3 located at 701 Magnolia Avenue, on the Southerly side of Magnolia Avenue, between Jefferson Street and the A.T.&S.F. Railroad. Applicant: G. Howard Robertshak and Everett C. McClung. The Secretary read a letter from Robertshaw and Mc- Clung requesting that their application for rezoning be withdrawn effective this date. The letter was dated March 19, 1969. The Commission gave acknow- ledgement to this letter. (ib.), TENTATIVE MAP - Knob Hill - 18 lots located on the Northerly end of Donna Drive and Northerly of Falcon Hills Estates Unit No. 1. Applicant: D. A. Gannon, Inc. The Chairman requested the waiving of the reading of the application and notice of public hearing, and announced that this matter had been deferred from the last regular meeting in order to give the Plan- ning Department to review, the changes that had been made by D.A. Gannon, Inc. This decision was reached with bhe approval of the applicant and also included an investigation by the Planning Department of the extension of Elm Avenue. The Planning Director explained the changes that were requested by the applicant and pointed them out on a map which was displayed. He stated that in or- der to explain past City action on the extension of Elm Avenue, he reviewed Council Resolution No. 1155 and Planning Commission Resolution No. 395 which adopted a Precise P1a.n for Elm Avenue. Gannon, Inc., stated the changes that are being made and the reasons they are being made. Questions were raised by the Commfssion regarding a small piece of property adjoining the applicant's property. MR. A. L. JANDRO, 2801 El Camino Real, Carlsbad, explained that his property was surrounding the piecl of property in question. MR. CARL H. NEISWENDER, 3225 Donna.Drive, Carlsbad, raised a number of questions regarding the develop- ment of property by the applicant- and Mr. Karl Mullen and the staff answered the questiones to his satisfaction. Since there were no others present who wished to speak in favor of the application, the Chairman askel if there was anyone who wished to speak in oppositiol to this application. MR. ALLEN JANDRO, stated he was opposed to this appl cation on the same grounds as was stated at the previous meeting. Since there were no others present who wished to speak for or against this application, the Chairman declared the public hearing closed at 7:52 P. M. After some discussion.and review of the changes re- quested, a motion was made to adopt Resolution No. 603 recommending approval of certain variances and - the tentative map of Knob Hill for the following reasons: 1. TAIN V'ARIANCES AND THE- TENTATIVE MAP OF KNO-B HILL, Sub (c) VARIANCES - -To consider an application for a var iance for the purpose of reduction in required set- backs and in req.uired lot area per dwelling unit lo- cated on the northerly side of Normandy Lane between Garfield Street and Mountain View Drive. APPlicant: Donald P. Hoefer.. Notice of hearing was read. The Secretary certified that property owners in t-he area were notified and that publication was given and then .read the applica- tion, and read the names of owners of adjacent proper ties. Donald Jackson stating he had The City Planner presented the Planning Department Report and explained to the Commission the parking arrangements that would be made with ttiese setbacks. He then presented the Engineering Department Report. The Chairman announced the Commission would now hear from anyone who wished to speak in favor of the appli cation. Since there was no one;..present who wished to speak in favor of this application, other than the applicant who felt his application was sufficient, the Chairman announced the.Commlssion would hear from anyone who wished to speak in opposition of the appli ca ti on.. Mr. Edward Vasquez, 2340 Ocean St., Carlsbad, and Mr. Doug Oldershaw, 1265 Yourell, Carlsbad both stat- ed they were in opposition to this application be- cause of the variance in side yard set back. They stated that apything less then a five (5) foot set back would be a definite fire hazard. Since there were no others who wished to speak in . opposition, the Chairman delcared the Public Hearing closed at 8:19 P.M. Also -discussed were -other. variances granted that were 'sim'ilar to this application. Af-ter further discussion, a motion was made to adopt Resolution No.. 610 granting a variance on property located on the nortker.ly-s-i.d-e--of Normandy Lane, between Garfield Street an.d.. A RESOLUTION OF- THE CARLSBAD CITY PLANNING COMMISSION GRANTING A 'VARIANCE ON PROP- BETWEEN GARFIELD STREET AND MOUNTAIN VIEW DRIVE, was read by title only and further reading waived. ERTY LOCATED ON THE-NORTHERLY SIDE OF NORMANDY LANE, (d) AMENDMENT TO PRECISE PLAN,- To consider an amend ment .. to Precise Plan, PP 6602 for the addition of a 'I vending patio at property 1ocated"on the northwester- ly corner of Palomar Airport Road and Interstate 5 Freeway. Applicant: Shell Oil Company. Notice of hearing was read. The Secretary read the application and stated that there was*no written correspondence on thi-s matter. The City Planner presented the Planning Department . Report and stated that the applicant requested an addition of a vending patio to the existing service station facility on subject property, and pointed the area out on a map. The City Planner then read a portion of Sectian 24 of PP 6602, a.s was mentioned in the Planning Department Report. He stated that thz applicant had not conformed ,to .certain portions of.th'e maintenance agreement on the service statSon facility. The Chairman announced the Commission would. now hear from anyone wishing to speak in favor or (rgainst the application. As there was no one present wishing to speak in favor or against .the application, the Chair- man dexlared the Public Hearing closed-at-8:40 P.M. ' After a volume of discussion centering around this type of vending patio, the Commission .agreed that 'this type of consideration could set a preced.dnt with other service stations. When the Commission discuss- ed the fact tjat the applicant had not complied with conditions in the maintenance agreement, the City Planner suggested that if the Commission approved this application, it be with the condition-that the applicant comply with the previous maintenance agree- ment. Airport Road a.nd I-n- terstate #5 Freeway as requested by Shell Oil Co., fo the following reasoas: '1. The lack of a particular Precise Plan 2. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD DENYING AMENDMENT TO PRECISE PLAN, PP 6602, was adopted by title only and further reading waive.d. OLD BUSINESS: Chairman Jose requested a report from the Planning Director regarding the memorandum sent them which was presented at the last regular meeting. The City Planner gave.an oral report on this request from the Parks & Recreation Commi'ision and stated he felt a decision should be delayed until the meet- ing in Sacramento on March 27, 1969. The Chairman stated that since the Park & Recreation Commission-requested other considerations and the request that the Planning Department be directed to prepare a study, etc. was only one facet of their request. The Chairman stated that he did not feel . it was necessary to await a decision from the March 27, 1969 meeting from the State. The City Planner stated that perhaps it would be ad- vantageous to communicate.with th&,.Oceanside Planning Department on this matter and coordinate a study. The Commission requested the Planning Director to follow through with his suggestion and.present a report at the meeting of April 22, 1969. OLD BUSINESS: (a) Planning Commission Procedures Discussion was held regarding the procedures for the conduct of the Planning Commission and it was the Linanimous dec9sion of the CommisS'ion that the-resolu- tion be adopted subject to the revision that .the terms of office be from January 1, to.the following December 31 of each year rather than the fiscal year. . . . . . .,. Commissioner Forman nominated Commissioner Gullett for the office of Vice-chairman for the Planning Commission. By proper motion, Commissioner Gullett was appointed toi.the office of 'Vice-chairman of the Planning Commis sion. - Resolution No. 613.
