VJRITfEN COMMUNICATIONS:
(a) A letter from Attorney Russell W. Grosse, 804 3rd
Street, Oceanside, dated June 12, 1969, to the Plannin
Commission, requested certain areas in the City be re-
zoned to R-3 property and this property was show-n on a
attached location sketch. It was also stated that eac
Df said property owners had signed a petition to reque

Discussion followed as to the Commission's peroga
tive in such a case and upon questioning, Mr. Oling-
'louse clarified that if this were in fact a matter of
a rezoning for the best interests of the City, then th
zommission could take action; however, if otherwise, i
nlould be more applicable to consider each individual
applicatian. It was noted that portions of this area
lad been applied for rezoning before and at that time,
there had been considerable opposition on the part of
adjacent homeowners. Inasmuch as the letter stated
that an application would he filed if the Commission
did not wish to take action at this time, it was agree
this would be the best way to handle it. The motion w
made to advise the attorney(for the petitioners) to
make application to the City for rezoning this area.
ORAL COMMUNICATIONS: There were no Oral Communica

PUBLIC HEARINGS:
(a) Continued - RECLASSIFICATION AND SPECIFIC PLA
To consider application for Zone Change from R-1 to C-
XGeneral-Commercial) on property located at 1045 Grand
Avenue, Southeasterly and of Grand Avenue, Westerly of
Interstate 5 Freeway - Applicant: John H. Grant.
A letter from the Planning Department dated June 16,
was read and requested a continuation of this public
hearing until the meeting of August 26, 1969, to allow
sufficient time to establish a final boundary for the
Specific Plan, to meet with the applicant to discuss
specific uses for the property, and to have an informa
meeting with the neighborqtng property owners to discus
the proposed project. Following a brief discussion of
the many requirements on this Specific Plan, the motio

(b) TENTATIVE MAP - To consider application for Tenta'
tive Map containing 16 lots - Carlsbad' Industrial Park
located Easterly of El Camino Real and approximately
4,000 feet North of Palomar Airp0r.t Road; Applicant:
RalDh J. Palmer.
The Planning Director read the Staff Report dated June
1.1, 1969 in full, giving the background on this portio1
of a Tentative Map submittal and approval by the Com-
mission in April 1968; that map containing 54 acres,
expired in May 1969. The Staff Report recommended ap-
proval of this industrial development and listed 23
Conditions of Approval. Exhibit A was shown and brief1
to the Commission, as to the boundaries, sewer, water
and access street for this development.
Commissioner Palmateer requested clarification from thc
Planning Director on the City's recent "Planned Indus-
trial Zone" and this particular industrial development
as well as the lot size and requirements for same.
The applicant, RALPH J. PALMER, was present and gave a
brief history of the original map application and this
present one for 16 lots on approximately 29 acres. He
raised two questions on the "Conditions for Approval'.'

City's requirement for sidewalks along El Camino Real
was questioned, unless this requirement were conformed
to all along El Camino. A recent development that did
not have such a requirement was cited. 2) A decision
as to who would supply water to his development was
requested -- City of Carlsbad water district or the
CMWD -.- and Mr. Palmer cited inconsistencies with othe
in this area.
he Engineering and Planning Departments discussed the
vailability of City water to this project and noted
he nearest service was near the new mobile home park,
nd some distance away. Mr. Spano stated that since
he industrial park was within the City, they could sei
t and application would have to be made to the water
istrict. It was further noted the question of water
ervice has been a problem repeatedly in considering
pplications for development in this area. It was fel,
hat this problem must be resolved in view of potentia
evelopment near the airport and near El Camino Real.
he City Attorney volunteered that several attorneys,
ncluding the attorney for the water district, were cu
ently studying this problem of water service for that
rea, and it was hoped something could be resolved in
he near future. He felt the Commission could=proceed
nder the assumption the City can,supply water for thi!
evelopment.

require sidewalks for new development.
Commissioner Dewhurst cited Item 14 of the Report re-
garding streets conforming to Coun.ty standards, pendin
County improvement of El Camino Real and he felt this
Mas an absolute necessity in view of increased use of
El Camino and its future role as a major artery for th
City.
Commissioner Little recalled discussions in the past
about the County adding runways at Palomar Airport and
the proximity of this development should this take pla

snd upon questioning, he advised that these County-run
airports had recently become the responsibility of the
County's Administrative Department and they wou1.d be
reviewing Palomar and other airports for some time.

ning Commission Resolution No. ,613 Denying.
The City ManagerEs memorandum dated June 19 was read
regarding City Councill's granting of amendment to thi's
Specific Plan to allow auto-related uses? and requeste
the Commission's report back per the 0rdi.nance require
ment. It was the unanimous opinion of the Cornmisspone
that they acted in good judgment in denying the amend-
ment allowing auto-related uses because this created a
"unplanned area" and, there are already 3 expsti'ng sta
tions in the same area. Chairman Jose noted thi-s; i.s
not a freeway-oriented station and will therefore not
be allowed the same size sign per the City"s new si'gn

Plan should. certainly be complied with. The Commissio
directed the Planning Department to draft a reply to t
Council incorporating th-ese comments. This was agreed
to by a voice vote.
(b) Continued - Reauests for House Moves - To conside
two applications for house moves; decision from Plan-
ning Commission as required by the Ordinance; Applican
Jack McCoy - 4 house moves and James A. Scanlon - one
house move.
(1) Application of Jack McCoy - The Planning Dire
tor reviewed the application for tiouse moves as submit
It w'as added that the Staff Report and recommendation
of the Building Department had been previously stated.
The applicant was present and had nothing further to
add in his behalf and there were none in the audience
to speak in favor or opposition of the proposed house
moves. The Building Inspector had nothing to add but
upon questioning, he did reiterate his department's
reasons for recommending these houses not be moved. Th
public hearing being closed, the Commission discussed
the individual houses in question and Mr. Osburn answe
all questions on each of these units. It was further
noted by Mr. Osburn that a street deadends on this
property (985 Laguna Drive) and it was therefore neces
ary for a Planning Commission-decision regarding any
proposed use of this property.
In discussing what constituted good or bad land use fo
this type of area, the Planning Director read four poi
which established this fact. He added the Planning
Department did not believe this application to be the
best use of the property, in light of the City's plans
and hoped-for developed there.
A motion was made to deny the application of Mr. Jack
McCoy to move four houses to property at 985 Laguna
Drive, for the following reasons: 1) This would not be
the highest or best use of the land and, 2) This would
possibly be a detrimental effect on future development
in this area.
(2) Application of James A. Scanlon - This ap-
plication had not been heard before and is a request
to move one dwell ing from 2790 Madison Ave to 1240 Pin
Avenue. The Planning Director read a report dated May
28, 1969, wherein it was stated the wood frame dwellin

A motion was made to approve the application for one
house move by James A. Scanlon, from'2790 Madison Ave
to 1240 Pine Avenue in the City of Carlsbad, for the
following reasons: 1) This will not represent a detr

time, it appears to be the best use of the land.
Following this action, the Building Inspector suggest1
that a policy might well be established covering futu
requests for house moves, which his department would
be required to submit to the Commission. This could bl
based on a minimum dwelling size and would have to be
added to the zoning ordinance. The Planning Commissil
could then request a report on the circumstances sur-
rounding the request. The Commission agreed a policl
dith guidelines would be helpful and a motion was the1
nade requiring the Planning and Building Departments
to prepare and submit a proposed Amendment for the Or1
-tance, giving guidelines for future house move reques
such as minimum footage, age of the house, condition,
stc. This policy should be presented to the Commissic
3rior to the next request for house move submitted to
them.

(a) Resolution of Intention No. 67 - Amendment of thc

:larified by the Planning Director. Mr. Olinghouse
did ask, if there were any comments or proposed addit,
ions to this amendment, that these be submitted to thc
Planning Department prior to the public hearing on Ju

14, REGARDING SERVICE STATIONS, AND ADDING TO SECTION
1404, ARTICLE 14, "CONDITIONS FOR APPROVAL FOR AUTO-
RELATED USES" LISTED UNDER PERMtTTED USES, SECTION 140
ARTICLE 14. Notice of public hearing to be held July
22, 1969 at 7:30 P.M. will be given according to law.
(b) A League of California Cities brochure and attach
note from the City Clerk requesting early return of a1
hotel reservations to that office was discussed, advis
of the Annual Fall Convention in San Francisco for the
dates September 28 through October 1, 1969. The Chair
man took a poll of those commissioners who wanted to
attend and discussed the possibility of only a certain
number being able to attend account of possible budget
cuts regarding travel and per diem. It was agreed by
all who have attended previous conventions that this
was a most worthwhile instruction and learning session
for newly appointed planning commissioners. The Plan-
ning Department was requested to submit the following
listed names for Commission representation, and the
brochure is to be duplicated and sent out to all those
listed: Jack Forman, Robert Little, Dr. Roy Palmateer
Donald Dewhurst, Chairman Jose and the newest member,

(c) Commissioner Palmateer advised the Commission tha
the question of City parks was becoming a major proble
He wanted to suggest that informal meetings with Parks
and Recreation Commission, Council and Commission memb
and Engineering and Planning staff be held as soon as
possible, inviting the public for "round-table" type
discussions, but the public would not participate in
the talks. In this way, it was hoped specific objecti

andum to the City Manager, City Counc,il, City departrne
and Parks & Recreation Commission advi'sing of the urge
need for such a meeting, or meetings.
The motion was made to so advise the City Council of
the above suggestions and Planning Commission cooperat
in the matter of the City's future parks and recreatio
faci 1 ity program.
