(b) Conditional Use Permi.t(Pre-Annexation) - To consid
allowing construction of a Mobile Homes Park, located
South of Palomar Airport Road and East of Interstate 5
Applicant - Guy E. Ward E Virginia Lear (Owners) and
Macco Corporation (Developers.)
Mr. Olinghouse presented the text in full of Staff
Report dated 4/02/70, covering the technical aspects,
recommendation by staff, reasons for such.recommendati
and conditions of approval if granted. The secretary
read written correspondence in this regard from Mr. RQ
Sheldon, 1052 West Sixth Street, Los Angeles, who stat
this application meets with the approval of certain ad
jacent property owners; and, J. Dekema, Distr.ict Engi;n
for Division of Highways, San Diego, who had no objec-
tions to the proposed development but stated they woul
appreciate the opportunity to review the fi'nal grading
and drainage plans.
The applicant, Mr. Guy E. Ward, was present and
stated he had nothing further to add to the staff rep0
,already presented, and they would attempt to comply w7
'all. conditions as set forth, realizi.ng these were for the best interests of the City of Carlsbad and the dev
~oper. There were no questions of Mr. Mard and none in
the audience to speak in favor or opposition of the
application; public hearing was closed at 7:55 P.M.
The Chairman requested clarification of the staff
report statement regarding this application being rece
before the City prior to the 90-day mobile home park
moratorium. He reviewed the sequence of events and ap-
proximate dates leading up to the actual enactment of
this interim ordinance and there was questio'ning of th
department regarding the proposed "adult only" develop
ment of this park. Discussion followed whether this
should be a required condition of approval. Mr. Oling-
house felt this should remain a perogative of the deve
in his proposed development.
Commissioner Palmateer requested further detail and
c'larification of the proximity of a certain open space
area which the City had long hoped to remain intact for
a proposed "open space corridorbt. He pointed out this
was a natural drainage area and determined to be within
the Ward/Lear property. It was shown by the wall exhi'bi
that this particular area in question was not within th
parcel presently under application, 6ut was withtn pro
of the same ownership recommended for later development
under planned community zoning.
MR. ROBERT L. MEANS, General Contractor, 1717 South
Hill, Oceanside, representative for the owners and deve
opers on a local level, was present and offered to pres
his plot map which he felt was better able to clear up
the question of this land and its location in the p.rese
development. He further clarified as to ground elevattc
in the general area, the natural drainage for the area,
proximity of the sewer treatment plant, adjacent proper
owners, etc. Commissioner Palmateer explained his
questions had been prompted by his continuing Interest

s so near the freeway, he was concerned just how it
rould look from a freeway vantage point. It was felt

Discussion was then given Condition No. 6 regardi,n

birector directed attention to the recently adopted
tmendment to conditional use permit section of the zon
~rdinance and to the clause regarding completion of
:onstruction within one year. It was also suggested
:hat some means of review of these "tlrne period" appli
:ations be devised to follow up on same, prior to the
apse of such time element.
Considerable discussion was given rhe mobile homes
loratorium now in effect and the pending mobile home
'tudy. It was suggested this application be continued

The motion was then made to grant a conditional us

this application, recommendations, reasons and conditi
of approval, if granted. A Wall Exhibit (Exhibit A)
was displayed, depicting the proposed site, entrance a
exit to the property, the general area, etc. The sta
recommendation was to approve this application. The
secretary introd.uced a. letter received in this regard:
from Anna L. Bauer, of Bauer Lumber Company,. the busi
establishment located to the North of the proposed sit
Mrs. Bauer stated they felt the building proposed woul
be an improvement over the present condition of this
property and an improvement to the area as well. They
would therefore be pleased to have Dr. Gregg as a
business neighbor.
The applicant, Dr. Henry C. Gregg, 234 Melba Road,
Encinitas 92024, was present and stated he had little
to add from his first application for such a business
in this City, in that the same proposed business opera
type of building, general location, etc. would prevail
He added that if he had applied for such business only
2 years ago in this City, a kennel or pet clinic could
been built without necessity of a conditional use perm
and that it was to some extent, through his efforts, t
such uses were now controlled by the City.
MR.-TONY HOWARD-JONES, 2985 Park Drive, real estat
broker and representative of Dr. Gregg in the acquisit
of this proposed site, stated he also felt this was an
excellent location in the City, that new development
was needed on State Street and he was very much in fav
of this application.
MR. HARRY L. TRUAX, 4125 Harbor Drive (new busines
location to be 4626 State Street, for E. Brian Smtth,
Engineers, formerly of Oceanside) stated he would soon
be a business neighbor .of this location and he was ver
much in favor of this use at this location.
MR. ROBERT SANBORN, 4525 State Street, stated he
felt State Street was going to undergo some very good
changes and this application was a definite asset for
the area.
MR. NICK SAUER, 2905 Roosevelt Street, stated he
felt this business was a definite attribute to the dow
town area and urged the Commission to approve same at
this time. There being no further to speak tn favor
or against this applicatton, the public hearing was
closed at '8:40 P.M.
It was then stated that the Planning Commission ha
originally been in favor of Dr. Gregg's first applicat
and there appeared to be no reason for not approving
this application for the. present location and use.
The motion was duly made tu grant a conditional use pe
mit for construction and use of small ani,mal clinic at
2739 State Street, subject to the conditions of approv
(Items 1 thru 11) as set forth in Staff Report of 3/31
and for the reasons following: 1) Proposed pet clinic
will be an asset to the general area and, to downtown
Carlsbad; 2) This use will not be lnjurious to sur-

CONDITIONAL USE PERMIT FOR THE CONSTRUCTION AND USE OF
4 SMALL ANIMAL CLINIC LOCATED ON THE WESTERLY StDE OF
STATE STREET, BETWEEN BEECH AND GRAND AVENUES.
NEW BUS I NESS:
(a) Resolut.ion of Intention No. 71 - to set p'ublic
hearing for 4/28/70 to amend the Zoning Ordinance re
Horses in Residential Zones.
Mr. 0linghouse.briefed the Commission on the back-
ground request precipitating this particular resolutio
dhich would amend the R-A-10,000 zoning regarding hors
although the original memorandum request from the City
Manager in the Fall of 1969 was concerned primarily
dith horses in R-1 zones. He further explained the
better control of the clause to be incorporated in the
R-A-lo'zoning, which is considered more restrictive
than in the other R-zones. Further, he pointed out tha
at present R-A-10 zoning permits 8 horses on 4 acres,
dhile 16 horses would be allowed on a like acreage in
the other R-Zonds. The City Manager's memorandum requ
for a study of this situation in thts City was then
discussed and following additional data offered, it wa
agreed the Planning Commission did not feel a situatic
existed regarding horses in Residential zones, at this
time. -Therefore, the motion was made and unanimously
agreed to send a memorandum to the City Manager so ad.
vising.

This item is now complete and incorporated in the Art
14 amendment under Conditional Use Permit uses.
70.17 Review of Sign Ordinance re variances: The Pla
Director wished to discuss certain excerpts from the
ordinance re -.variances, which had been forwarded for
Commission review. The original sign ordinance wordi
regarding variances had been deleted, in that the zon
ordinance itself includes a variance section which it
was felt would apply. Mr. Olinghouse stated he felt
the original wording for the sign ordinance-and that
wording in the zoning or-dinance for variances was bas
the same in intent, and applicability. After discuss
it was generally agreed that if there was already a
procedure for obta'ining a sign variance, there was no
need to add such procedure to the sign section specif
Mr. Olinghouse stated he could review the State la
regarding variance procedure however, and would be ab
to present a report of this research at a later date.
The motion was duly made that the Planning Director
make such a report on State variance procedure at the
present time. (Note: This request becomes Item 70.19
the 'Continued' items attachment.)
70.18 Minimum Square Footage Requirements: Mr. 0li.ng
house advised .this item could be referred to the Low-
Cost Housing subcommittee of CtC for review and repor
but it was generally agreed this item was no longer
needed and should therefore, be withdrawn. The motio

COMMITTEE REPORTS:
There were none.
Councilman Neiswender advised he wished to speak t
the Commission on this, his last Commission meeting i
fbkt his council term was now complete. He sincerely
thanked all present for their honest and active conce
in the City's future planning and in the handling of
.the various applications before it. He was gratified
in the past decisions rendered by this body and asked
that they .continue to pursue these duties in the same
manner.
ADJOURNMENT:
The motion was made and approved unanimously by vo
vote approval to adjourn the meeting at 9:32 P.M.
