I APPROVAL OF MINUTES:
The minutes of regular meeting of April 14, 1970 were
approved as submitted by a motion receivi,ng unanimous
voice vote approval.
I WR I TTEN COMMUN I CAT IONS:
(a) Memorandum from Chief Building tnspector dated
4/22/70 re Zoning Ordinance Section 1400 and permits
for Carnivals and Circus' in the City.
Mr. Osburn was present to discuss the background
circumstances precipitating his request for guidance
in subject memorandum. He stated there had been an
incidence in which a carnival was proposed and permits
were requested of the City, but coordination had been
poor and little time allowed for proper handling. He
cited from the code for City of National City, whereby
prior notification and time element were written in Po
any cover.ed/midway-type carnival or cir.cus event.
After discussion, it was generally agreed this ite
should be referred to the city manager for his further
preparation of what the Ctty's zoning ordinance for
such requests should be, to elaborate on Section 1400
for carnivals and circusE.

Mr. Olinghouse read the staff report dated April
22, 1970, presenting the necessary background informa-
tion to this matter, the staff recommendation to deny
said request, and reasons for such recommendation.
C. A. HELTIBRIDGE, 1520 Hunsaker, Oceanside, and
representive in this matter, was present and stated
they felt there should be some signing allowed on Elm
'Avenue, since the State Highway widening program had
forced their relocation of this business. He further
stated this sign request was like that finally granted
should be allowed. They could incorporate wall or
canopy signs as previously recommended by the Plann'itng
Department, but it was felt this was not attractive to
thei-r new buitling, nor is the pole sign as requested
considered detrimental at this location. Mr. Heltibrid
confirmed this sign would not be visible from the free
way, but the one large pole sign they were allowed as
a freeway facility is still located as previously and
is visible.

There were none in the audience to speak in favor
or opposition and the public hearing was closed at 7:48 P.M.
Mr- Olinghouse and others attempted to clarify for
Mr. Heltibridhe the circumstances of the Shell Oil Co.
application, denial by Planning Commission and subse-
quent appeal to 'the Council, which was approved, It
was felt this application was a different situation
and, in fact, represented a completed new facility
which had beem built in a new location as a result of
the widening program. The Shell Oil application was
for relocation of two signs only for freeway wi.dening,
and the moratorium on their signs is still valid.
It was also generally agreed by the Commission tha
,this application should be treated in a like manner to
other requests for excessive signs, and that no appar-
ant unusual circumstances existed requiring a variance
It was felt to do otherwise would weaken the City's
sign ordinance and it's enforcement,
The motion was duly made and unanimously agreed to
deny subject application for sign variance, for the
reasons set forth in Staff Report dated 4f22P70, and
the applicant was advised he could appeal thts decisi:or
if he desired.

Mr. Olinghouse presented the Staff Report of April
20, 1970, containing a technical report on the details
of this application, the staff recommendation to ap-
prove same, and reasons and conditions of approval. He
also referred to Exhibit A displayed on the wall, depi
ting the acreage, densities involved, and Parcels A, B
.and C, with thru-streets that will serve the area.
The or.igina1 application from 'L.R. Partnership for
under discussion, as these three parcels had intention
been deleted from this former application, for this
later development under the P-C zoning concept. The
secretary read correspondence received from Pannonia
Investment Company, in which they stated P-C zoning wa
proper for this property, but provisions should be-mad
for adequate roads within it in order not to endanger
development of internal property, which involved their
holdings. Mr. Olinghouse attempted to clarify on the
request of Pannonia as to easements for utilities on
any roads in this general area, but he stated the late

Specific Plans coming to.the Planning Commission for
approval on this development, would show what roads,
etc. they propose.
The applicant/representative, MR. JERRY ROMBOTIS,
3505 Charter Oak Drive, was present and stated the
proposed deve1op.ment for these three parcels conforms
with the tentative map previously filed, as the P-C
Zone was not yet available in the City and this develo
ment was held for such planning. He further felt this
zoning was needed for this particular property at this
time and it conformed with the open space corridor as
proposed by the City; also, it conforms to the'Master
Plan for the area. Mr. Rombotis was questioned as to
futupe development of Park Drive southerly and he stat
they would develop this road all the way. He also
clarified that Parcel C was some 600 feet from Shelter
Cover, to a point where the tidal flats begin.
MR. DON JOHNSON, 4065 Sunnyhill Drive, stated whil
he had no particular objections to this P-C developmen
in an area some distance from his residential area, he
did want the Commission to be aware that there have
been meetings to discuss a future proposed P-C zone on
the Briggs property which lies within his residential
area. It is felt the approval of this.'P-C zone might
influence the approval of a later P-C zone for the
approximate 45 acres in question and many residents in
this R-1 area are opposed to such development. There
were no others wishing to speak and the pub1Fc Rearing
was closed at 8:15 P.M..
The Commission questions following covered what th
Engineering Departmentks pol Icy was regarding requtre-
ments for improving streets, En parttcular Park Drive
in this case. Mr. Spano was prese.nt and stated thFs
would depend on where the property line was. t'n this
case, one-half was on the present appl?cant"s property
and the City could not require he completely improve
Park Drive all the way. This could make for a situatfo
whereby Park Drive was not completely improved for som
time, depending on the plans or needs of the other
property owners involved.' Mr. Spano pointed out what
portion of Park Drive was already improved, what porti
of the full 68 ft. width would be improved by thts ap-
plicant, and what would remain incomplete. If this
street became a problem area the City would have to de
-what was to be done.
Additional digcussion covered the Planned Communtt
:concept being utilized in this area and it was stated
this appeared the best planning for it, in that it is
somewhat removed from major residential developments
and would no doubt prove an attractive additton to tht
area. It was felt there had been some good planning
for development of the whole area and the P-C zontng
would lend itself to that, while the developer had-an
excellent opportunity to do an outstanding job in tR?s
location. The motion was made and unanimously agreed
upon to recommend this change of zone and adoption of
master plan to the City Counctl, for the reasons shown
in Staff Report of 4/20/70 and, subject to the Conditf

70.3 Buena Vista Lagoon Study: Mr. Olinghouse reporte
on the meeting of April 16th, but stated Mr. Bagley,
Planning Director of Oceanside, was. not present. He
r~ould attempt to set another meeting with Mr. Bagley
prior to the next meeting. He had talked with Mr. Rudi
of their Engineering Department, who confirmed no forn
resolution from Carlsbad had been received in Oceansid
regarding retention of Lagoon lands. Mr. Oltnghouse
confirmed this and understood that the Council had dec
to see.what Oceanside wanted to do befo're transmittal

the property owners, explain the rezoning application,

discussed and Mr. Olinghouse explained that while the:
meetings, contacts, resolutions of intention from the
Commission, etc., were very time consuming, this was
the only way the present residents can understand what
can be done through rezoning, the application of '701'
funds, and HUDls Neighborhood Development Program. HE
also could not state when this phase of the project
could be completed as the formation of the CIC commltt
has been a critical need, but this work can now be .tur
over to them. He would report from time to time to tt
Commission on the progress. Mr. Olinghouse was questi
what the Neighborhood Development Program entailed anc
how it would be beneficial to such an area. He clari
this was primarily a "renewal programt' under HUD. Ther

that if it was not yet clear what these programs involved,
if funding is or will be available, OF how they can be
applied to our particular problem areas, how could the
facts be made known to the residents? It was agreed
this project wou-ld be turned over to the CtC for their
further handling.

NEW BUS I NESS:
(a) Memorandum from Chief Bldg. Inspector dated 4/22/73
requesting decision for House Move application; Appli-
cant : Ray Wh i tehead.
.Mr. Osburn was present to explain the circumstance5
of this second request for house move approval from Mr.
Whitehead. The first request was not completed for othe-
reasons and Mr. Whitehead has located another piece of
property, which the Building Department has checked out
prior to this request. The recommendation of the Building
Department was to approve this move and since all re-

Center recently opened at Pine Avenue School, three day;
aweek and manned by CIC members.
