PLACE: CITY COUNCIL CHAMBERS ROLL CALL: City staff,members present: E. 3. Olinghouse, D. A. Agatep, J. E. Spano APPROVAL OF MINUTES: The minutes of the regular meeting of 8/24/"71 were approved as corrected. WRITTEN COMMUNICATION: The secretary read a memorandum from City Manaqer to the Planning "Commission re the council's JecisiGn to reverse the commissionts decision to recommend approval of a request by Donald MacDonald for a zone change and adoption of a specific plan. Mr. Olfnghouse suggested that the other two memos be deferred until thc "Old Business" section of the agenda. ORAL COMMUNICATION: None PUBLIC HEARINGS: a * 5(a) REQUEST FOR CHANGE OF ZONE, ADOPTION OF A SPECIFIC PLAN, AND CONDITIONAL USE PERMTT; Applicants: Hall Griswold, Nilsen Mr. Agatep presented the technical staff report of 9/14/71, which covered the particular situ-ation re location, present land use in the area concerned, and traffic volume on the on and off ramps on Las Flores interchange. The repox alsoFontained information fro1 a staff study which compares total capacity of the service stations of Carlsbad against what they are actually pumping. The study shows that at the present time, a need'for more service stations cannot be estab- lished. The report gave staff recommendations and reasons for denial. Mr. Agatep showed graphics which illustrated the location to the commission and the 3udience. The secretary read a cover letter attached to a petition with 245 signatures of Carlsbad residents who are opposed to the proposed development by Hall, Gris- Mold, and Nilsen. The secretary also read letters from the followTng persons opposing the development by Hall, Griswold, & Vilsen: Richard L. and Mar.ilyn Stults, 2371 Cipriano Lane J. S. A. LIBBY, Box 213, Carlsbad Mr. DONALD SMITH, 6346 Decantur Street, San Diego, was present to represent the applicant. He stated th.at because of the monetary investment involved, he felt th proposal was worthy of lengthy consideration. He made comments on several parts of the staff report. He stressed that although the restaurant and service stati have the same location, they are completely separate entities. The applicant also commented on an article by Mr. Christianson re the development of Carlsbad. HE informed the commission that he had contacted Warren Jones, who stated that the land next to the freeway shauld not be used for residential development, . Acco'rding to the appLicant, Mr. Jones endorsed a develc ment such as the restaurant-service station complex for the subject area. Mr. Smith also challenged the staff' qualifications in establishing an economic need for gas stations in the -Ci.ty of Carlsbad. Mr. Smith talked' to the Division of Highways re the capability of the Las Flores interchange in handling increased flows of traf. fic. He was informed that the Las Flores interchange was a different type interchange. City engineering department, however, felt the interchange could not handle the increased traffic flow as staff reflected in their report. The question was brought up re children using the service station crossways in going to school. Mr. Smith had several photographs taken of children on their way to school in severql areas of the City and various hazards. He also showed photographs of the subject property from various locations, i.e 1-5, etc. The applicant discussed his proposal for a lengthy period of time. During that time, he stressed resultin economic factors, and how he felt the City .would benefi monetarily. The chairman asked if anyone was present wishing t speak in favor or opposition. .Mr. Harry Truax, 4125 Harbor Drive feels this development would be the best use for property in this area. Mr. Raymond J. Ward, service station operator, fec that the people are using their children's safety as an excuse. Mr. Thomas D. McMahon, 3551 Higkland Drive, belie+ that zone changing will detract from Carlsbad's beauty. Mr. Charles Spencer, 1270 Yourell, is strongly against any commercial development in that area. would be a 24-hour operation. When informed by Mr. Smith that it would, he told the commission that he 1l'u next to a 24-hour restaurant (Aplhy's). He told the commission the problems he faces because of the noise and lights all night long. He urged the commission to realize what the adjacent residents are in for if this proposal is approved. Chairman Little thanked those who spoke and asked that because of the time, those opposing the proposal display a show of hands. There was a substantial number of persons present who are opposed to the development, The public hearing was closed at 8:43 P..M, Chairman 'Little asked for discussion among the commission, He started off by saylng he feels it is an efficient operation and that he has looked at the similar operation in Tustin. But he feels there- are sufficient stations in Carlsbad at this time, Commissioner Jose feels that thts property could possibly be developed into a park by the state for tourist stopover. (not overnight). He also believes that Carlsbad has-enough drive-in restaurants, and that the area in question should be developed in some way that would not be detrimental to the surrounding resi- dential properties, Commissioners Dominguet and Forman agreed with the other points made in that they don't-feel this type of development would be right for the area. Commissioner Hermsen commented that the children use this route in access to the beach in the summer and school during the year. -Because of this, he believes the traffic congestion would be too dangerous for the children. After further discussion, a motion was made to adopt Planning Commission Resolution No. 720, A RESO- LUTION OF THE CARLSBAD CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE DENIAL OF! A CHANGE OF ZONE FROM R-1-7,500 TO C-2 (GENERAL COMMERCIAL) ZONE AND DENIAL OF A SPECIFIC PLAN ON PROPERTY LOCATED ON THE SOUTHEAST QUADRANT OF INTE'RSTATE 5 AND LAS FLORES DRIVE Another motion was made to adopt Planning Commis- sion Resolution No. 721, A RESOLUTION DENYING A CONDI- TIONAL USE PERMIT FOR A FREEWAY-ORIENTED SERVICE STATION AS PART OF A FREEWAY SERVICE FACILITY ON PROPERTY LOCA- TED AT THE SOUTHEAST QUADRANT OF INTERSTATE-5 AND LAS FLORES DRIVE I I. 5(b) CHANGE OF ZONE FROM R-P TO C-M - Reclassification in zone from R-P (Resi-entia1 Professional) to C-M ~~ Commercial-Limited Industrial Zone)'on certain roperties located on the westerly side of Roosevelt, outh of Laguna Drive and north of Beech Avenue; pplicant: Frances M. Staff illustrated location, surrounding land uses, and general plan requirements wi graphics. The re ort listed the recommendations and . reasons for deniay given by' staff. Mr. Agatep read the uses allowed under C-M zoning at Commissioner Dominguet.'s request. Commissioner Domin- guez was informed by staff that the majority of the businesses operating under C-M zoning were on the light end of allowable uses. The secretary read a cover letter of a pet'ition containing 95 signatures of Carlsbad restdents Q osi'ng the -proposed rezoning. A letter from Harold 9. iYai:ne, Lyon Van Lines, Inc. was read which opposes the rezonin to C-M, but stated a zone change to C-1 or C-2 might not be so objectionable. , A note from. Ellen M. McCall, who recently inhertte the property at 624 Laguna Dri've, was read which oppose the zone change, The applicant's representative, Mr. Ntck Saeur, 2965 Roosevelt Street was present to represent all pro- perty owners in the area concerned (except Mrs. Christ0 pherson). He informed the cornmisston that the people only want to be able to do somethfng with their propert They want to be able to develop the property. Mr. Saeur said the Reese's had applied for a H.U.D. loan, but were turned down because -of unfavorable location, A letter form Mr. Bob Coles, Carlsbad Housing Assistanc Officer, was read to that effect, After some further discussion regarding the zoning, Mr. Saeur urged the commission to approve a rezoning to C-M so the property owners could develop their land. I The following persons spoke in opposition: I G. L. Southwell, 2411 Buena Vista Circle wanted to ask Mr. Saeur what the Dr0Pert.y would be used for l'f the rezoning was obtained.' He-was informed that the property is now for sale, but that a lease was underwa for cement contractor and heavy equipment storage. ' Mr. Olinghouse suggested the CBDAC be given a change to review the plan prior to any decisions re rezoning. According to Mr. Olinghouse, A Framework for Remedial Action for the Inner City prepared by Duncan' b Jones suggested that a developmental poli'cy plan be accomplished for the inner city prior to any rezoning, Discussion ensued among the commissioners. It was felt that the location could not handle any additio traffic and that a heavy commercial use would not be suitable so close to residences, However, the feeling was that the commission has been lax in the past for no do-ing something sooner in this area. A motion was made to adopt Planning Commission Resolution No. 724, A RESOLUTrON RE.COMMENDING- DENIAL (RESIDENTIAL-PROFESSIONAL) TO C-M (.HEAVY COMMERCIAL - LIMITED INDUSTRI-AL ZONE) ON CERTAIN'PROPERTIES LOCATED ON THE WESTERLY SIDE OF ROOSEVELT, SOUTH OF LAGUNA DRIVE AND NORTH OF BEECH AVENUE TO THE CITY COUNCIL OF A CHANGE OF ZONE FROM RIP 5(c) TENTATIVE MAP - To consider approval of a tentativ subdivision map for Richie-Qlen subdivision, Carlsbad Tract 71-3; applicant: Bee Cee Company Mr. Agatep introduced the staff report of 9/74/71 which covered the situation. The report gave staff recommendations and reasons and conditions of approval. The secretary read a letter from Dr. Howard C. Harmon, shich estimated the development would add approximately 15 students in kindergarten through the twelfth grade. The applicant, Mr. Howard Baumgartner, 3437 High- land was present and concurred with the staff report. There was no one present to speak in favor of opposition, so the public hearing was closed at 10:24 P A motion was made to adopt Planning Commission Resolution No, 727, A RESOLUTION OF THE CARLSBAD CrTY PLANNING COMMISSION RECOMMENDING APPROVAL TO CITY COUNCIL OF THE TENTATIVE MAP OF H, L, ANDERSON AND BEE CEE COMPANY, RICHIE GLEN SUBDIVISION, CARLSBAD TRACT 71 NEW BUSINESS: None OLD BUSINESS: (a) Staff recommended that the public hearing date for Resolution of Intention No. 80 to change the title of Planned Community to Planned Residential Development be changed to September 28, 1971, because the notice was not published in time for the 9/14/71 meeting. The secretary read two memos from the Cfty Manager to Planning Commission. The first memo was tO tnform the commission of an appeal by Robert Means. The decision of the City Council was to grant the appeal subject to certain conditions. The second memo informec the commission that the City Council reversed the decision of the Plannlng Commissfon to grant a request by Charles Thompson for zone change and adoption of a specific plan. After a short discussion, the Chaikman asked that a letter be drafted to the City Council informing the council they had read and discussed the memorandums. There were several questions from the audience re Robert Means app.ea1. These questions were answered by commission and staff. The Commission asked staff to review the ordinance re property owners within 300 feet being notified for proposed zone changes, etc. The feeling among the residents was that 300 feet was not a large enough radius, especially when large lots were involved as on Highland. The commission instructed staff-to obtain any information possible in regards to the blrds that are dying in the lagoon.
