APPROVAL OF MINUTES:
The minutes of the regular meeting of 11-9-71 were approved as submitted.
The minutes of the regular meeting of 11-23-71 were approved as submitted.
WRITTEN COMMUNICATION:
The secretary read a letter from Mr. Perry Lamb,, 5171 Shore Drive, Carlsbad to the chairman of the Board of Supervisors of San Diego County dated Nov. 19, 1971. The letter was in reference to recent action by the Board of Supervisors to have legislation drafted for the purpose of preserving, protecting, and restoring Batiquitos and San Elijo Lagoons. According to Mr. Lamb, the Environmental Development Agency's presen- tation proposing the legislation was largely based on the conclusions reached in the recently published Cal Poly-Pomona report entitled "The Coasta'l Lagoons of San Diego County". Mr. Lamb made various comments and quotations in reference to specific findings of the report.
The.commissioners made comments regarding the letter. Mr. Bob Williamson of 2040 Basswood also made various remarks in reference to the lagoons and state legisla- tion.
The secretary read a letter fvom Russell W. Grosse, President of Fred C. Sproul Homes, Inc. dated 12-6-71 requesting a ninety-day extension of the conditional use permit on the proposed mobile home park located near the southeast intersection of Interstate-5 and Palomar Airport Road, owned by Andrew W. McReynolds.

Mr. Olinghouse informed the commissioners that this matter had been discussed, and that according to the ordinance, any change must go through public hearing procedures. Therefore, the planning commission has no authority to extend the-conditional use permit.
Mr. Taylor, counsel for Sproul.Homes, Inc. was present and requested any temporary assistance possible so they could proceed with a grading permit.
Mr. L. A. Moer City Attorney, commented that the ordi- nance permits the conditional use permit to be issued under certain circumstances and conditions, and that the.commission possesses no power within the ordinance to extend the expiration date.
Mr. Taylor made several other coinments and said he would like to meet with Mr. Moe to discuss the matter.

ORAL COMMUNICATION:.
Commissioner Jose sugg.ested that the election of new officers for next year be considered at this time.
Commissioner Jose was elected Chairman, Commissioner Forman was elected vice-chairman, and Commissioner
Dominguez was elected secretary for the year 1972.
PUBLIC HEARINGS:
(a) Continued - REQUEST FOR CHANGE OF ZONE - Reclassi-
fication in Zone from R-1-7,500 to R-3 on certain pro-

Mr. Agatep presented the staff's report of 12-14-71, which covered the situation re location, allowable den
Sity versus general plan density, and reasons and con- ditions of approval.
Discussion ensued re the proposed amendment to the general plan. It was decided that Mr. Mantle's reques
should not be acted upon until the proposed amendment is outlined and discussed.
A motion was made to continue the hearing until Januar
25, 1972, and at that time, a presentation be made
in regards to the proposed general plan amendment.

Mr. Agatep read the staff report dated 12-14-71, which outlined the applicants' request in reference to
location, development criteria, and reaso'ns and con- ditions of approval.
Mr. Agatep made comments on the renderings showing possible development. He also illustrated a rendering of a conceptualized auto center which was done by staff.
Mr. Agatep-further stated that these renderings had nothing to do with the specific plan--that they are only conceptual ideas. The specific plan sets only developmental criteria. A specific plan of develop- ment will be presented when the applicant comes in with his first development proposal.
Commissioner Jose 'recommended an added condition to I read as follows: "That all wMeoked automobiles be obscured. from the public view."
The applican.ts' representative, Mr. John Mamaux, 1393 Basswood, was present to discuss the request and answe questions. He introduced several of the.gentlemen in- volved in the proposal, including the architect, Mr. Jack Lanphere. Mr. Mamaux requested clarification of
condition #15, which reads as follows: ''Access rights
to Cannon Road shall be dedicated to the City of

delete condition 15.
There was no one present to speak either in favor or opposition of the proposal. The public hearing was closed at 8:47 P.M.
The secretary read two letters in regards to this
proposal. The first letter was written by Paul and Magdalena Ecke dated Oct. 11, 1971 authorizing the Tri-City Auto Dealers Association to seek the change
of zone and j-oining with the association in seeking
commercial zoning. The second letter, dated Oct. 26, 1971 was from G. A. Bishop, Supervisor, Governmental Right-of-way, stating that S.D.G. & E. has no objec-
tions to the proposed zone change since it does not . seem to be detrimental to their present land use.
After further discussion, a motion was made to adopt Resolution No. 737, A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL A CHANGE OF ZONE FROM R-A-10,000 TO C-2 (GENERAL COMMER-
CIAL) ZONE, AND ADOPTION OF A SPECIFIC PLAN, ON PRO-
PERTY LOCATED EAST OF INTERSTATE-5 BETWEEN PALOMAR AIRPORT ROAD AND CANNON ROA6, subject'to reasons and conditions as outlined'drt staft: report*of 12-14-71 . plus an added condition as outlined above .in previous discussion. Also that condition #15 be- deleted.

Mr. Agatep introduced the staff report of 12-14-71, which discussed the progress of the rezoning applica-
tion since the Planning commission first denied it on September 14, 1971. The report also gave reasons and conditions.of approval of the zone change and specific
plan.
Mr. Agatep also read Resoluti.on No. 740 which is the
specific plan proposed.
Mr. Nick Sauer was present to make several comments. He said he was in favor of the staff's recommendations with a few exceptions. He disagreed with the conditio which limits the uses allowable under C-M zoning. He urged the commission to adopt a zone change and then, judge each specific plan separately as the property owners submit plans for development.

Discussion ensued among the commission re the allowabl uses under C-M zoning, 1egality.of the specific plan proposed in reference to conditions, and the normal C-M uses which were deleted in the specific plan.
The commissioners felt that some of the uses which had been deleted under the proposed specific plan were compatible uses for the area. Commissioner Jose suggested that staff expand the list of allowable uses in the specific plan.
The commissioners felt that the specific plan was not the best solution to the problem.
The following persons spoke in favor of the proposal:

After hearing those wishing to speak in favor of the proposal, Commissioner Jose made a motion to recess for ten minutes. The public hearing was resumed at 10:09 P.M.
The following persons spoke in opposition to the pro- posal :

The secretary read the names and dates of 12 letters submitted in opposition. A letter dated December 14, 1971, submitted by Bessie W. Prengle, was read by the
secretary.
The public hearing was closed at 10:22 P.M. I

The commissioners discussed the proposal at length. The overall feeling was that nothing had changed since they had denied the proposed zone change at a previous meeting. They agreed that the area concerned should be upgraded, and felt a continuance would be in order to give the staff and an appointed committee of 3 commissioners (Forman, Dominguez, Palmateer) time to have a work session and develop a plan for the entire area, arriving at a zone that would be compatible with the entire area.
A motion was made to continue until January 25, 1972 for further study by staff and commission. I
(d) REQUEST FOR CHANGE OF ZONE AND ADOPTION OF A MASTER PLAN - Reclassification in zone from R-1-10,000 to .P-C (Plapned Community) and adoption of a master plan on 112- acres, for a 1,120 unit retirement community; Applicants: Financial Scene, Inc.

Mr. Tawfiq Khoury was present to represent Pacific Scene. He said that they were in agreement with all of the conditions of the staff report. He further
stated that they have no intention of building a mobile home park or gas stations. They will cater to the elderly and wish to create a development that will
be a desirable place to retire.
The following persons spoke in regards to the proposal
ROBERT MEANS spoke in favor of the proposal.
DR. ANDREW MCREYNOLDS, an adjoining property owner, had questions re the road alignment and how it would affect his property. The- staff clarified his ques- tions. He stated that other than the road system, he was in favor of the proposal.
No one was present to speak in opposition. The public hearing was closed at 11:15 P.M.
The commission expressed concern over height restric- tions. They were informed that the-height will be
limited to review by the Planning Commission when
specific plans of development are presented.
After a short discussion, a motion was -made to adopt

The commissioners discussed the proposal, but decided to cintinue the hearing until December 28, 1971, so ' that several questions could be clarified and so a report by the School Board could be reviewed pertainin to the number of children the development would add
to the school system.

Discussion among the commission resulted in a suggeste continuance until January 11, 1972 so that several
items could be added to the ordinance, i.e. treatment of nonconforming parking. Mr. Agatep asked that the commissioners submit their comments regarding the required number of spaces.
A motion was made to continue until January 11, 1972.

Mr. Agatep read a memorandum ,from the Planning Direct0
outlining the status of the request for annexation,
and notifying the Planning Commission that the matter will be discussed at the regular meeting of 12-28-71.
The commissioners made several comments re this annexa tion request.
Items 7 and 8 of the agenda were continued until 28 December 1971 due to the lateness of the meeting.
ADJOURNMENT: The meeting was adjourned by proper voice vote approval at 12:40 A.M.
