i f WRITTEN COWlUNICATIONS: NONE I ORAL COMMUNICATIONS: Commissioner Jose stated he had observed 1 the NO LEFT TURN sign placed at the east entrance of the Standard Station on Elm Avenue, and found that it was a particularly dangerous situation with persons making that turn at night. He inquired of the City Engineer if it would be possible to place reflectors on the NO LEFT TURN portion of that sign, for safety sake. The City Engineer stated he would look into the matter and report back to Comnissioner Jose in the near future.
PUBLIC HEARINGS:
5(a) CONTINUED: E.I.S.#190, Specific Plan-129, CT 73-26, 'for ALGA HILLS: Request for acceptance of Final Environmental Impact Report, Adoption of a Specific Plan and consideration of Tentative Map, to allow a 408 unit condominium development on 66 acres of land, generally located at the southeast intersection of A1 ga Road and A1 icante Road , suhi tted by LA COSTA LAND CO.
The Planning Director read a request by Staff to Table this item as the parks program and possible redesign for this project had not as yet been accomplishedr
Mr. Robert Ladwig, representing the applicant, 509 Elm Avenue, advised the Commission they were in agreement with the request to Table.

(b) CONTINUED: EIS-197, Specific Plan-135 and CT 73-23, for HESTER DEVELOPMENT CO. - Request for acceptance of Final Environmental Impact Report, adoption of a Specific Plan and consideration of a Tentative Map to allow for a 190 unit condominium development, on property 'located at the northeast i i icorner of the intersection of Lowder Lane and Poinsettia Lane.
Associate Planner, Paul Williams gave the Staff report and 1 an additional report which was prepared 9-25-73 recommending this !
item be tabled. He explained the.Master Plan map for this project ' 'and stated he .was not sure Lagoon Lane' should be extended as a part;, ,of this project. Commissioner Casler stated she felt Batiquitos i 'Lane should go half of the distance past the civic facilities, past the park and end at the Jr. High School site, otherwl'se, any cars 'going to the south will have a long way around to go. Public Hearing was opened and Mr. Ken Wassman of Occidental
Petroleum, 4201 Birch Street, Newport Beach, spoke giving a brief history of the project. He stated he felt they had worked
very closely with staff, but were still not able to understand why a workable solution to some of the minor problems had not been worked out. He stated it was their feeling it was best for the the City if they would agree to dedicate both school sites an( all land not brought into the development, for park sites. He
stated that the requirement for 59 ft. half street improvements to Poinsettia as opposed to 51 ft, had possibly come about as it was felt the State may require 6 lane development in that area.
Mr. Wassman stated he did not feel they should have to improve
any property that was dedicated to the City.
Mr. Agatep advised that the precedent for improved property dedicated to the City was set by developments such as Tanglewood and Carl s bad Pal i sades.
Commissioners Dominguez and Jose suggested this matter should be given more time tor Occidental/Hester and staff to go over
the matters not yet felt resolved.
Motion was made to continue E.I.S.#197, Specific Plan #135 and Tentative Map CT 73-23, to the regular meeting of October 23, 1973.

(c) CASE NOS: Specific Plan#138 and Tentative Map CT 73-39, for SEA RANCH: Request for adoption of a Specific Plan and approval of a Tentative Map, to allow for a 331 lot subdivision on 80 plus acres of land generally located on the east side of Lagoon Lane between Poinsettia Road and Batiquitos Lagoon, application submitted by RANCHO LA COSTA.
Paul Williams read the request to withdraw the Specific Plan, continue the Tentative Map, and advised the Commission the applicant would be submitting a request for a zone change.
Mr::Robert Allan, Standard Pacific, 7670 Clairmont Mesa Blvd, representing the applicant, stated he concurred with staff
recomnendations.
Motion was made that Specific Plan #138 be withdrawn, and Tentative Map CT 73-39 be continued to October 9, 1973.

i i Commissioner Jose questioned the width of Tamarack, and as if the sewer lines would still be the same as in the original pla He also was informed there was a 28 ft. right-of-way as a circu- lation route within the project, and a 6 ft. high wall around the devel opment.
Commissioner Casler questioned the adequacy of the parking
spaces and was advised that the parking exceeds the requirements
of the parking ordinance.
The Public Hearing was opened, and Mr. John Crosswhite,
from Pace. Engineering, representing applicant, advised that he
concurred with the recomnendations of Staff. He suggested that
the berm along the railroad track be used instead of the 6 ft. high fence. He stated Condition #1 did not show or refer to pati
walls and fences, and stated they would put fences around each
residence to create a private patio atmosphere.
the Planning Director interjected that when this plan was first presented to the City, discussion was held regarding the park site at the north of the property, prior to the park bond issue last fall. The City was given the option of buying the property and fai 1 ed to do so.
When asked about a park site to the north of the property,
Public Hearing was closed and Commissioner Little stated he felt this particular development was more pallitable than the previous proposal that had been presented. He stated he felt for
the safety of the people in the area, a fence along the top-of
the berm should be mandatory.’

With no further discussion of this item, a motion was
made that Ordinance 9283 be revoked, and Specific Plan-136 be approved per justifications and conditions 1-18, with conditions #1 and #3 as amended, and the request for deletion of fencing be denied .
A second motion was made that Carlsbad Tract (CT 73-38)
be approved for reasons outlined in staff report, per conditions
1-10 as outlined.

The Planning Director gave the staff report for this item, which was in the form of a memo outlining the action taken by the City Council for the appeal of the zone chan e. Department would be instructed to initiate an Overlay Study for the Civic Center zone , and it was stated that the Planning Commission would have to adopt a Resolution instructing staff to do this study, and at this point in time, the only requirement to be complied with on this Change of Zone was a report back to the City Council on their action (Planning Commission action) takc this date.
Motion was made to report back to the City Council that final action on the change of zone from R-3 to C-2 be taken , with justifications based on staff recommendations and con- siderations of the Planning Commission as outlined in memorandum presented this date.
Motion was made that the Planning Commission adopt a Resolution instructtng-the Wanning staff to initiate action necessary to place the Civic Center Overlay Zone into being at the earliest possible date, and return before the Planning Commission not later than December 31, 1973.
Public Hearing was opened and Mr. Bob Ladwig, Rick Engin- eering Company, representing the applicant, stated he was in agreement with the 19 conditions on the Specific Plan as had been prepared by staff. He .advised the Commission that they would not be placing any large signs on their building, and any signs they did use in the future would definitely conform to our sign ordinance as may be in effect at !that time.

The property is generally located on the southeast corner of Elm Avenue and Pi0 Pic0 Drive.

5(g) CASE NOS: E.1.S.-167, SPECIFIC PLAN-116 and CT 73-20, for SPANISH VILLAGE: Request for acceptance of the Final Environ- mental Impact Report, adoption of a Specific Plan and approval of a Tentative Map, to allow the construction of a 26 lot con- dominium development, said property generally located southerly
of and adjacent to La Costa Avenue, immediately westerly of the present westerly most extension of Levante Street. Applicatton submitted by La Costa Land Company.
Associate Planner Paul Williams gave the staff report and explained the Specific Plan Map for this project, as well as touching on the E.I.R. and Tentative Map portions also. Commissioner Casler inquired as to the school district for this project and was advised it was in Encinitas. Commissioner Jose inquired as to the slope of the open space, stating it was very unstable to be used for either a path or just visual effect. Public Hearing was opened and Mr. Robert Ladwig, Rick Engineering at 509 Elm Avenue, representing the Applicant, stated they felt thts roject does conform to the La Costa Plaster Plan and feels P!t ! 1 6elp wi'tFi €Re cl'rculatton element in that area. Commissioner Wrench asked if the applicant.was prepared to accept all other conditions pending approval of the tentative map and was advised positive. Commissioner Casler inquired as to the archeological site that had been discussed in the E.I.R. and was advised it had been salvaged. discussed the many ways the Commission or the Planning Department could present a more definitive way of clarification to the City Council for items that have been denied and appealed. It was suggested possibly a Planning Commissioner could attend the meetings and state the reasons for denial, a more definitive report could be given, written or oral. After consideration discussion on this to ic, it was suggested that at the present time, on thl's particu P ar l'tem (Ponderosa Homes], that the Planntng Department present a more expll'cl't memorandum to the City Council. It was suggested that this matter be pursued further at the next workshop meeting.
