5. CASE NO. CUP-93 - REECE S. MONEYHUN, for CARL KARCHER ENTERPRISES, INC. (Carl's Jr. Restaurant) requesting approval of a Conditional Use Permit to allow a Drive- thru Restaurant on Elm Avenue adjacent to service station on northeasterly corner of Elm and Harding.
Paul will lams gave staff report outlinllng Standard Conditions 1 thru 16 and the property located at 952 Elm consisting of 2,558 square feet structure with 9% bui 1 ding coverage.

Real Estate Manager forCar13Jr. Restaurants
He passed out a brochure showing picture of
the proposed restaurant, gave a'brief
history stating the restaurant is not a .-franchise, but company owned and would
seat 88 people. He told the Commission
they had been in business 33 years.
Mr. Moneyhun agreed to conditions 1 thru 16
17, 18, 19, 20 and regarding 21 on signage, he did indicate he would need a menu board in rear of restaurant for customers to order from. Commissioner Jose asked Paul Williams if he had since discussed any further reduced signage and if so had .any agreement been reached on this. Mr. Williams stated he could assure si.gnage with our ordinance and proposed to do such in compliance to C-2 Zone. The City Attorney was asked for an interpretation on signage obdinadce. He stated he had looked at materials in staff report and stated staff has indicated the correct ordinance 'and he could not say it was unreasonable. If Staff needs further in-
vestigation he would be happy to provide it.
Mr. Bit1 Palenscar spoKe=in opposition to a Carl's.Jr, ,Restaurant. He indicated he
had n,othing to gain financially, but merely wanted to make a statement that he felt a restaurant of this type would be bad for Carlsbad.
Commissioner Jose stated Carlsbad had 7 eating establishments within a three mile ar*ea. He and other members of the Commiss- ion felt Carlsbad has adequate eating places of this type and one more would overpopulate the area. Commissioner Jose said he would like to see a finer type
restaurant.
.Motion was made that the Planning Commissio DENY the Application for A CarlSJr. Restau- rant CUP-93 due to the circulation element
and that adequate establishments of thts

(b) CASE NO. CUP-94 - CARLSBAD LIONS CLUB. Carlsbad Lions Club Requested a Conditional Use Permit for a carnival to be located at the ,. southwest corner of Monroe and Chestnut Avenue to be held from April 24-28.
A list of 10 people was presented to the Commiss ion by Mrs. Frolander. -They did. not object to having a carnival in their area. Two letters consisting of 18 names opposing the carnival were also presented, indicating the 'reason wa.s becau'se of noise, lighting, crowds, trash permeating the area and a parking problem.

interested property owners, the Commission DENIE[ the r.equest for the following reasons: Noise, Lighting, trash perm'eating the area, parking problem and children passing the area on their way to school.
Commissioner Wrench suggested the Holiday Park site because the freeway is near and the people are accustomed to the background noise. However! an administrative error caused the Holiday 'Park site not to be properly noticed. On recommendati of Staff, Holiday Park was' not considered. As part of a subsquent motion, the Planning Commiss- ion requested Staff and City Manager to meet witt the Lions Club representatives in order to pro- cure the potential site east of El Camino Real, north. of Marron Road.
The second part of the motion, Commission was requested, to. ask City Manager to .investigate the potential for the parking lot as a site. The Commission stated they would be on call for a special meeting at any time prior to April 24th in order to consider a new CUP application.

[c) CASE NO. GPA-24 - LAND USE AMENDMENT NO. 10 The Land Use Amendment involves the revision to , the ordinances of the Civic Center as presently shown on the 1965 General Plan boundaries and a revision,to the Land Use designation on several parcels in the vicinity of the Civic Center *from Low Density Residential to Professior Administrative Commercial. *I .
Paul Williams rptesented Staff Report to Commissic stating t.he first thing would be to establish boundar'ies shown in blue on wall graphic. Commissioner Wrench asked if the blue on the wall graphic implied total scope of Civic Center. Mr. Williams did go on to say this could be changed as l.ong as it is proposed in legal ordinance manner.

Chairman .Casler opened Public Hearing with Scanlan, 2955 Elm speaking in favor of Low Residential. He said he didn't see how we get any lower than R-1. He thought it wou a tremendous improvement.

Mr. Hefner, 1280 Laguna spoke in favor telling the Commission he bought property in good faith and stated he would ,be happy to see it cleared up and knpw what we may do with the property.,.
Mr. Nornholdt,4025 Baldwin Lane, spoke in opposi- tion indicating he had property on Laguna and Pi0 Pic0 and was happy to see the amendments. He stated he had read the staff report which was attached to notice of January 8th. He had a question on sev.era1 things on Page 3 - B-2 and B-4 on Civic Center'where it was originally planned for expansions in two areas along the

the City Council approve the Land Use Amend- ment. Subject amendment involves properties identified by the Ellsworth application as well as property identified in the Civic Center Overlay Zone.
Chairwoman Casler requested a change in text of staff report, that the zone change "one lot below Highland" be. inserted on Page 1 of text, after west of Highland.
The Planning Commission recommended that the proposed General Plan Amendment be certified as prior compliance with regard to environ- mental considerations. Amendment to the General Plan with Land Use Amendment No. 10 added. This will be recommended to City Council for approval.

(d) CASE NO. GPA-25 - LAND USE AMENDMENT
' NO. 11: 'This Land Use Amendment con-tem- plates a change in. land use designation from Low Density Residential to Professional Administrative-Commercial. The application submitted by the property owner requested a change in designation to Commercial. The staff report to the Planning Commission stated a number of reasons why commercial land use designation was not appropriate anc that professional-administrative-commercial was a more suitable land use. After dis- cussion between Commission and Staff, the representative, Chan LeFevre, stated that tc implement such a land use designation he wou1.d recommend that the City consider adopbing a zoning ordinance which addresses specifically provisional uses, administratic of.fice uses .and appropriate commercial uses. They asked that the ordinance be adminis- tered in a manner similar to that of plannec development concepts.
The Commission took no action on Mr. LeFevre's recommendation, but did instruct 'Staff to investigate potential zones which would implement the Professional-Adminis- trative-Commercial Land Use designation;

Dr. McReynoIds spoke in favor of the Land Use Amendment. He had nothing more to add un1.e.s~ the Commission had questions to ask regarding his property. Commissioner Barrett asked if there was sufficient water supply. He indicated he understood water on this side of freeway is not as much of a problem as east of freeway.
There were no oppositions.
Motion was made after discussion that it be recommended to City Council that Land Use Amendment No. 12,be approved,

(f) CASE NO: GPA-27 - LAND USE AMENDMENT NO. 13. This request consisted of Environmental im- pact Report and a land use amendment change from 213.6 acres located on the northerly side of Palomar Airport Road from open space public and semi-public parks'and a residential low density 0-2 dwelling units per acre to planned 'industrial Justification is based on the preliminary report submitted to the City of Carlsbad by C.P.O. on :I Palomar Airport Land Use Plan. After discussion, the staff and the Commission in consideration of testimony given by Mr. Clarence Dawson, the adjoining property owner, moved to continue consideration of the E.I.R. and acquisition land use amendment and to continue for a period of two weeks until April 23. Instruction to the staff consisted of the expansi0.n of mitigative measures to be used as a result of depleting,200 acres of open space and park land from the existi general plan.
The valley floor and stands of Oak trees along the nor-therly side'of subject 233 acres are also to be identified in the revised staff report.
Motion was made that this be noticed in the news- paper for Item B and be placed on agenda for con- tinuance in two weeks on April 23rd. """""""""""""""""""""""""-

7. The Plannin'g Director presented a report to the Planning Commission. The report outlined recommended changes to the Agriculture Ordinances as indicated by ,the City Council; and suggested several other alternatives which would provide separation of cattle, sheep, goats and swine production from habitable structures. The report also addresses separation of poultry, rabbits, chinchillas, and hamsters for the same reason. After discussion by the Commission and staff, the following recommendatio'n is being forwarded to th City Council for their approval :

Section 21.07.020 (a) Cattle, sheep, goats and swine production, provided that the number of any one or combination of said animals shall not exceed one (1) animal per half acre of lot area. Said animals shall not be located within 50 ft. of any hab'itable structure on an adjoining parcel zoned for residential uses; nor shall they be located within 100 ft. of a parcel zoned for residential uses; nor shall they be located within 100 ft. of a parcel zoned for residential uses wher a habitable structure is not involved. In any event, the distance from the parcel zoned for residential uses shall be the greater of the distance so indicated.
Section 21.07.020 (9) Poultry, rabbits, chinchillas, hamsters and other small animals, provided not more than twenty-five or any one or combination thereof shall be kept within 50 ft. of any habitable structure; nor shall they be located within 300 ft. of a habitable mi
residential uses when a habitable structure is not Tnvolved'. In any event, the distance from the parcel zoned for residential uses shall be the greater of the distances so indicated.
The Planning Commission is in concurrence with the City Council's recommendation that Section 21.07.040 (e) be deleted, and Section 21 ..07.040 (h) be revised to read:

The staff reported it was in receipt of a response from the City of La Puente and it was attached for information only. No further action was taken by the Commission.
