PLACE : CITY COUNCIL CHAMBERS DATE : October 22, 1974 CALL TO ORDER: ROLL CALL 1. Commissioners Watson, Wrench, Fikes, Jose, Casler Commissioner Dominguez APPROVAL OF MINUTES AND RESOLUTIONS 2(a) Minutes of October 8, 1974 meeting approved as amended. (b) Resolution 1105, Hughes Aircraft Co.; This item was moved to the late items on the agenda as a quorum was not present. WRITTEN COMMUNICATIONS 3(a) Chappee - CUP 64 - Planning Director Den Agatep . presented letter from Norman L. Vetter, attorney for Mr. Eugene M. Chappee, regarding a condition- al use permit for an auto wrecking yard issued in January 1973. After substantial discussion, staff was instruct- ed to review this letter and to report recommend- ations at the next Planning Commission meeting. (b) Santa Fe Glens, SP-116, CT 73-2. Planning Director Agatep read a letter from Rick Engineer- ing regarding a proposed Archaeological study for Santa Fe Glens and requested that a presenta- tion by Bernard Maniscalco and Russell Kaldenberg of RECON be .permitted during the Oral Communica- tions portion of the Planning Commission meeting. ORAL COMMUNICATIONS 4(a) Santa Fe Glens, SP-116, CT 73-2 - Mr. Bob Ladwig of Rick Enqineerinq introduced Bernard Maniscalco-then introduced Russell Kaldenberg, Assoclate Env9ronmeatal ScPentist/Archaeologist of RECON who stated he was present to discuss and answer any questions the Planning Commission might have in regard to Archaeologic Investiga- tion to be conducted on the Santa Fe Glens s'ite. Mr. Kaldenburg outlined the 5% sampling method- ology of the archaeological sites found within Santa Fe Glens project site and the proposed program for archaeologic investigation submitted by RECON to the Planning Commission. After substantial discussion, it was moved and approved to accept the proposed program sub- mitted by RECON with the condition that RECON submit 'a repoat to the Planning Commission stating findings and recommendations. Staff was also instructed to forward copies of the proposed program to the, San Oiego County. PUBLIC HEARINGS 5(a) Case No. ZC 142, CT 74-4, EIR' 242 - Leadership Homes. - Reauest for aDDrova1 of a Zone Change from R-1-10,'OOO to R-1-7500 and O/S and approval of a tentative map to allow construction of 234 single family homes on property located southeast of El Camino Real and Route 78. Planning Director Don Agatep stated City Manager Paul Bussev's desire to have this item continued to a 1ater"date until the disposition of the Police Pistol Range, which is within the project boundaries, is determined. After discussion the Planning Commission moved to hold the public hearing and then to continue the case to the November 12, 1974 meeting. Mr. William Ric,k, Engineering Consultant for the applicant, stated his concurrance with the staff report and answered questions of the Planning Commission. Public Hearing was closed. It was moved and unanimously approved to continue this item for public hearing on November 12, 1974 At 8:30 P.M. Commissioner Dominguez was present at the Planning Commission meeting. (b) Case W~..'MPr156.,-~omas'Sa~~a-F~ - Request for 2 approval of a Master Plan to allow Planned Residential development on 410 acres on property located approximately 1/2 mile east of El Camino Real on the north side of Palomar Airport Road. I, ~ Planning Director Don Agatep gave staff pre- sentation and explained graphics. He stated that there were minor changes to be made in the con- ditions that would be further outlined later in thevpresentation. Mrs. Ida Dawson of the Rancho Aqua Hedionda Los Monos explained property boundary lines of the Dawson-Los Monos Reserve area as outlined on graphics. Public hearing was opened. Mr. Lyle Gabrielson of Rick Engineering spoke representina Lomas Santa Fe. He explained and answered questions of the Planning Commission regarding the sewer capacity rights and discussed the future plans of the Palomar Airport and any potential impact the airport activities may have on the future development of the project. -I ~ Mr. A1 Kern, President, Lom.as San,ta Fe. Corp., spoke on behalf of the project. He discussed a model of the- project site and explained the COMMISSIONERS n \ I I d." Y CITY OF CARLSBAD Page 3 - meeting of 10-22-74 relationship of the Master Plan to the proposed grading of the site, the natural areas and slopes He stated that as late as last week there were no indications known to him of the countys plans for the expansion of the airport (second runway) beyond that already discussed in CPO's Land Use Plan for Palomar Airport and that the crash hazarc areas do not effect the Planned Community portion of the project. He gave his opinion of the trail system stating that he did not object to the trail system, but wanted to go on record that the project trail systems should be interconnecting . with other proposed trails planned in the City. He feels that the exact location of the trails should not be required to be shown on the valley floor. He feels that the nature of the community should not support privately maintained trails for public use. Y- ,. 2 I' q Mr. Kern stated his opinion as to the placement 01 the fence, and answered questions directed to him by the Planning Commission pertaining to the trail sewer,Ldeasitg, ekc. He:-.stated his disagreement with the staff report, commenting on what he felt were basic e-rrors. Mr. Kern also discussed densities in Planning Areas A-1 and A-2 and indicated their intent to possibly .amend the Master Plan in the near future to provide for density transfer. Mr. Clarencp H. Dawson of the Rancho Aqua Hediond: Los Monos, gave his views of the project. He specifi.cally pointed out where he felt would be the appropriate placing of the fence, along the east line of the project. He felt the staff should apprai.se the Commission of the actual altitude of the property in the N.W. Corner of the project, the direction of the drainage and the sewer flow. Mr. Kern gave rebuttal as to sewer flow and grad- ing of the northwest corner of the project. Public hearing was closed. After substantial discussion among the Commission it was moved a.nd approved to continue this case to the November 12, 1974 meeting. Staff was instructed to clear up the intent of the position of the fence in the staff report and to be more specific regarding the density's in areas A-1 and A-2 of the Master Plan. ' (-c) Case 8O-.A, E6enezer Church, Request for a Conditional Use Permit to allow construction of a church on a .55 acre site located on the north intersection with Pi0 Pic0 Drive. . side of Oak Avenue approximately 600' east of it' Planning Director Don Agatep gave staff report and explained graphics. John Amos, applicant, spoke regarding the project. He stated he feels that the project meets all requirements of planning, parking, engineering, etc. and that he sees no reason why the Conditional Use Permit cannot be issued. Harold Wagner of Ewald/Wagner Realty spoke on behatf.of the applichnt btating the problems he had in trying to sell the applicant's lot after their first attempt for a permit was denied. He stated there were no offers on the property and when it became obvious that the property would . not sell he suggested the applicant reapply for a Conditional Use Permit . Rev. Amos spoke again regarding his renewed attempt to exchange the property for any location that would be suitable for a church. He answered general questions of the Planning Commission regarding size of congregation, listing price of property, etc. Everett Amos, 4868 Park Dr., Willie Moore, Civil- ian Engineer at Camp Pendleton, Jim Lovick, all spoke in favor of the project stating they did not feel it would be a detriment to the neighbor- hood. Public hearing was closed. The Planning Commission discussed fl in area, traffic generation, street etc. uture zoning condition , After substantial discussion, the Planning Commission moved to return the matter to staff and instructed the staff to prepare the necessary documents of approval for CUP-80-A. The reasons for approval listed by the Planning Commission are: That the requested use is necessary or desirable for the development of the community, is essentially in harmony with th various elements and objectives of the general plan, and is not detrimental to existing uses specifically permitted in the zone i:n which the proposed use is to be located because the church is small and. will not cause any offensive noise or con- gestion in the neighborhood. That the site for the intended use is adequate in size and shape to accomodate the use because the church is amall and the site is adequate for the intended congrega- tion. That alt of the yards, setbacks, walls, fences, landscaping and othkr features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained The required setbacks meet the standards for all other uses in the same neighborhood. t COMMISSIONERS CITY OF CARLSBAD Page 5 - meetfng of 10-22-74 4) That the street system serving the proposed use is adequate to properly handle all traffic generated by a chur.ch of this size. The motion carried Jay a 4-1 vote. There was no neighborhood opposition presented at the Planning Commission meeting. One letter of opposition was read into the record from Mr. & Mrs. Chaplin. ........................... (d) Case No. ZC 149, SP-164, Cal Pacific Properties - Reauest for approval of a preannexational zone ci. change from county E-1-A to RD-M and C-1 and ~PU approval of a Specific Plan to allow construction of a neighborhood commercial and apartment com- plex on property located at the northeast corner of Alga Road and El Camino Real. Mr. John Mamaux, 1393 Basswood, applicant, stated he supported the staff recommendation on the Zone. Change and that he requested the Specific Plan 164 be tabled to work out details of the plan. Mr. Mamaux answered general question of the Planni-ng Commission as to ingress and egress and circulation problems of the project. Public hearing was closed. It was noted that no public protest was filed. After substantial discussion it was moved and approved to grant'ZC 149 based on reasons and conditions as outlined in the staff report. It was moved and unanimously approved to table SP-164. """"""""""""""""""""""""""" (e) Case No. SP-160, CT.74-13, Buena Woods - Request for aDDroval of a Specific Plan and Tentative Map for a'i35 unit deveiopment on property located . on the east side of Crest Drive between Elm Avenue and Eucalyptus Avenue. Planning Director Don Aga.tep gave staff pre- sentation and reviewed the instruction given by the Planning Commission at the October 8, 1974 hearing. The Director restated the staff's recommendation of approval as outlined and for reasons stated in staff report. He also explain- ed the Parks and Recreation Staff Report requested by the Planning Commission October 8, 1974. It was moved and approved to grant CT 74-13 per staff recommendation and subject to changes to the October 8th staff report which were out- lined in the staff report of October 27, 1974. ........................... (f) Case V-244, Freiburger - Request for panhandle variance. Planning Director Don Agatep stated applicant's desire to withdraw request- for panhandle variance It was moved and unanimously approved to grant the applicants request to withdraw his .applica- tion. UNFINISHED BUSINESS 6(a) Approval of Resolution No. 1105, Hughes Compact Carl Stall s. It was moved and approved to adopt Resolution No. 1105 as submitted without further reading. NEW BUSINESS 7. None ~~ LATE ITEMS 8. There was general discussion regarding the joint Planning 'Commission/City Council Workshop to be conducted on October 29, 1974. ADJOURNMENT 9. By proper motion, the meeting was adjourned at 00:05 A.M. to October 29, 1974'at 7:30 P.M. for a joint meeting with the City Council.
