Resolution No. 1142, S. L & B Service Corporation, was approved with the following change: Line 17 should 'read "The proposed map is not consistent with the Circulation Element of the General Plan. .. ." '1 WRITTEN COMrlUNICATIONS
Planning Director Don Agatep mentioned that written communi- cations all had a connection with items on the agenda and would be discussed at that, time.

Planning Director Don Agatep suggested the items on the agenda be changed to expedite the meeting., Item 6 should be third, item 5 should be fourth and item 3 should be fifth. The Commission accepted this order of priority.

Planning Director Don Agatep notec that staff is conducting meetings with property owners of the block in which the applicant's property is located to consider future purposes for development. A full report on these meetings will be made at the continued public hearing on Apri 1 8.

After hearing the request by letter from the applican. requesting this item be filed until technical diffi- culties with all affected agencies could be worked ou' and after determining there was no, one in the audiencc wishing to speak on this item, the Commission voted unanimously to close and file this item without takin! any action. If the applicant wishes to continue, he must file a new application and pay proper fees.

3. Case No. CT 74-25 - Larwin-San Diego, Inc. - Request for approval of a 211-lot tentative subdivision map over 47 acres located on the east side of ELCamino Real between Elm Avenue and Marron Road.
At the applicant's request, the Commission voted unanimously to continue this item to April 22, 1975

4. Case No. CUP-107 - David and Olivia Maldonado - Reque for approval of a Conditional Use Permit to allow con, struction of a greenhouse using sheet plastic on property located at 1590 Basswood Drive. '
Assistant Planning Director Bud Plender gave staff presentation, explained graphics and recommendation for approval as-outlined in the staff report. Mr. Plender explained that the nearest residence was approximately 140 ft. from the greenhouses. .4pprovin{ a greenhouse would help preserve agricultural lands. The only.problem with this application is that the City ordinance 1 imits building coverage on "R" zoned property to only 40% and the applicant's plan shows building on approximately 70% of the lot. Therefore, one of the conditions of the Conditional Use Permit would have to specify building coverage on only 40% . of the jot.
The question was raised pertaining to condition #5, .
. what doqstaff envision in the way of periodic revie\ to keep plastic.greenhouses in repair. Mr. Plender explained that this would be simply by way of neighbor's concern. With this condition spelled out, the City would have the leverage to act if there was a complaint; whereas, without the condition the City would have no way of requiring the applicant to compl: other than requiring a new public hearing.
Phi.llip G. Espinoza, 1026 H.ermes, Leucadia, spoke for the applicant's concern regarding the 40% building coverage restriction. . A discussion followed on whether to hear the application this evening in order that development would be feasible on the 40% and what avenues might be open to the applicant. Condition #4 regarding the view-obscuring fence or hedge was discussed, also. The question was asked whether the applicant could use a ground cover over the balance of the lot to start his plants in order to give the Commission and.applicant time to proceed further, and the answer was no. It was deci-ded to proceed with this application and perhaps hear a

David L. Peterson, 1531 Basswood, pointed out,his DroDertv which ad.ioins to the west, and stated he was I. very cokerned about drainage from-this lot affecting his property. Planner, Dana Hield, explained that thc applicant's lot had been graded and now sloped gently in a southerly direction or towards Basswood.
Ted Ackerman, 3320 Highland, pointed out two lots he owns and explained the grading of the property in question, the slope of the lot now and the fact that iceplant has been planted. Mr. Ackerman felt that the) had already been quite a lot of money spent on the project, and he, for one, felt like he would much rather look at a greenhouse than a high density housi' project. When asked if this project would affect his property, he stated it would not and they were very much in favor of it.
. Public hearing was closed.
The applicant was asked if he would have any objectio to a condition being stipulated on.the drainage. The condftion specifying the 40% total building coverage and the time limit for conditional use permits was disc'ussed briefly.
The Commission approved the Conditional Use,Permit unanimously with a change in wording of condition #6 and adding four more conditions. These are:
Condition #6 - The applicant shall limit building coverage to tJat permitted by the appl icable zone.
Condition #7 - No-night lighting shall be permitted for the purpose of growing .. flowers.
Condition #8 - The property shall be so graded so as to drain to-the south to Basswood.
Condition #9 - Any access road from Basswood be surfaced with a suitable material to cut down dust.
Condition #lo- This permit will be reviewed on'a .five, year increment basis from the date of approval.
It was also moved and approved to direct staff to 'prepare a Resolution of Intention for a'request for a zone code amendment to be heard at the next meeting deleting greenhouses from the "R" zone building coverage restrictions. """"""""_""""""""~"""""""""""~"""

from the workshop meetings with the two Commissioners and staff. Questions were asked concerning Page 4, t "effective date of order" and the "appeal process.", a whether or not this complies with State law.
There was no one in the audience wishing to speak.
Commissioner Dominguez expressed concern about digres ing from State law on specific plans, inasmuch as the County has had some experience along this line. Mr. Plender explained that he had attended meetings with the consulting firm for the County and was of the understanding that the County, as well as the City, would be using a new form and procedure for specific plans. Sections 21.06.015 and 21.06.090 were dis- cussed and changes in wording were agreed on.
It was moved, seconded, but not carried, by a 3-2 vot to approve-ZCA-65 with the following changes:
A. 21.06.015 - "It is intended that the "Q" zone br placed on properties with unique circumstances. Examples of situations that are considered uniql

B. 21.06;090 - #9 should read "Time period within which the project or any phasing of the project shall'be completed". Also, delete No. 3, "Harmony" from the last number .listing in this

By direction-of the Commission, staff was instructed to prepare an ordinance for their approval. Staff was also instructed to have the City Attorney's opinion of the legality of Sections 21.06.130 and 21.06.140. Commission also requested a'comparison of state laws to what is contained in the Exhibit B.

6. Case No. ZCA-66 - A recommendation that ZCA-66 be approved deleting Specific Plans from the time limitation set forth for Variances and Conditional Us Permits. ..
.. Assistant Planning Director Bud Plender explained the reason for asking that Section 21.42.040 be deleted from the Ordinance and Section 21.58.020 should be amend ed .
There was no one in the audience wishing to be heard.
The question was asked if this item had been approvec by the City Attorney and his approval was confirmed.
It was moved and unanimously approved to recommend tc City Council the deletion of Section 21.42.040 from the Ordinance completely and the amending of Section 21.58.020 as per staff recommendation. Staff will prepare a Resolution.

mitted. Since item #1 could easily take most of the meeting and items #2 and #3 could also be quite lengtk it is possible'that there may not be sufficient time for the balance of the agenda. Commissioners request€ staff, if there was sufficient time, to obtain for tl staff and/or City Manager input as to the City Counc, concern in these areas that they could be thinking about; especially items #2 and #3.
NEW BUSINESS
8. Memo to City Council regarding consideration of mobi' home park standards and moratorium.
Planning Director Don Agatep explained that the Plannina Commission meetinq of March 11 was adjournec to a workshop meeting for the purpose of discussing this item; inasmuch as one of the cases nas continuer at that meeting that has a direct relationship on City's policy regarding mobile home parks. This memorandum to City Council was an expression of the Commission's desires.
The Commission voted and unanimously approved the memorandum and directed staff to finalize and forwarl this to the City Manager, with one change requested: an indicati'on that mobile home park applications . a1 ready presented but not completed should. be

9. Notice of open pub1 ic hearing concerning proposed ai port development at Palmar Airport, Carlsbad,
Cal ifornja.
Planning Director Don Agatep explained that the Counl has instructed staff to report the impacts of the master plan as it relates to the City. This report will be presented to the City Council on'April 1 and to the Planning' Commission on April 8. Since'it was felt one of the Planning Comniissioners should be at the presentation, Commissioner Wrench stated he woulc
