PLACE: Council Chambers CALL TO ORDER , ROLL CALL Commissioners Dominguez, Jose, L'Heureux, Packard, Wrench Commissioners-Fikes, Watson .. PLANNED UNIT DEVELOPMENT AND CONDOMINIUM CONVERSION WORKSHOP - Chairman Wrench explained that this is a continued workshop and that toni.ght's discussion will begin at procedures. However, since Commissioner L'Heureux did not attend the first meeting, a brief review or questions would be beneficial. Commissioner L'Heureux noted that there was a toncern about "the permitted height". Chairman Wrench stated that some Commissioner particularly Commissioner Fikes, felt the height limitation woulc preclude high rise. He then requested Commission's opinion as tc whether this should be deleted. It was the general feeling that any architect could come up with a good enough reason to ask for additional height and,Commissioner Jose felt that additional height would really not .add that much. It was fdlt that perhaps Staff could rewrite this to.note that development should stay within the 35-ft. height limit basically, but permit a high.rise if it is within the judgment of the Staff and the Commission. Cornmi-ssioner L'Heureux. thought it could be stated the height not to exceed the underlying zone unless there is sufficient justifi- cation or specific finding to allow a higher building that will be compatible to the area, and not unduly block the view of surrounding. properties.and scenic highways. .. Application. -Commissioner L'Heureux felt there may be. some legal ramifications by merely stating "by the owner or his agent". May be there-should be a statement signed by the owner regarding responsibility if an agent is -signing the application. Open Space and Landscaping. The question was raised again as to whether or not the, City should require a "licensed" landscape architect. Instead of creating the expense of a licensed lands- cape architect it could perhaps spell out the plant materials, soil -preparation, irrigation and specifics such as this and word it to be acceptable to the Planning Director. 4 Assistant Planning Director Bud Plender ,explained that the reasor "licensed" was required is because many times landscaping plans are very poor. It was the general agreement of the Planning Commission that as long as plans had a predetermined amount of information such as plant materials, the spotting, the size, height and how many, and the'other specifics mentioned this would -be suitable. As there were no other questions on the previously reviewed portions, the Planning Commission continued the workshop dis-. .cussion bebinning with.Processin.g<. Chairman Wrench explained 'that there is a question as to whether the tentative subdivision map. should be required to be submitted at the same time a tenta- tive Planned Unit Development plan. Mr. Plender explained that the only place the City-can require public facilities is by a subdivision map. The rising costs, or how much "frdnt" money, is required by developers was discussed at length, but it was generally, felt that the costs would be lower in the long run by submitting both the Planned Unit Development and tentative sub- division map at the same time. Another advantage would be that the package would be consistent instead of being entirely changec by the time the developer comes back with the tentative sub- division map. Mr. Plender explained that the draft says "review", not "approval"; merely to make certain that all City .requirements are .met. Commissioner Dominguez felt we should not get involved in this too much; the homeowner's associations .that really work are those where the people themselves..involved want it to work, no other way. Com- missioner L'Heureux asked if there could be a sentence stating that C.C. & R's are not the responsibility of the City. Guarantee of Performance was talked about at length, and it seemt to be the qeneral feelinq that perhaps bondinq' should be the onl) form of guarantee of perTormance and' delete the trust agreement - guarantee. Whether or not cost estimates could accurately be required was questioned. Public improvements would not be a problem but privz improvements might be. .The.question was asked if maybe the City should not require anywhere from 10% to twice the amount stated by the developer for private improvements. Conversion to Planned Unit Development was discussed. The quest- ion of a cut-off date'was raised. Mr. Plender explained that in researching 'this there was no logical time to stipulate a cut- off date. The difference' between condominiums and various types of rentals was talked about and what advantages there were in having the common maintenance, the longer residency and. the pridt of ownership rather than renting, and the fact, that a condominiun is usually a bette.r quality project than rentals. The question was asked if the City really wants,a condominium coi version policy and what benefits would the City derive. It was decided there had to be some pol icy, betause the City was going to get applications for this. The Commissioners felt that an olc apartment being converted to a condominium should not be any les! restrictive as far as parking, recreational facilities, storage, etc. than for the developer building a condominium to begin with, If you relax the restrictions for conversions then there would bt no.point in constructing a condominium.in the first place. . . It was unanimously agreed that there should'be no condominium cor versions allowed uriless they met the full requirements of the PTanned Unit Development. It was fe-lt that an amendmen$ could be made in the P-C Zone that would require that a1 1 .Planned Unit Development restrictions'musl be met in that zone also. In answer to a question, Mr. Plender indicated the application ' fees were based,on an arbitrary figure and was not an attempt to :cover the hctual cost- involved in the processing of an applica- tion. Chairman Wrench felt- some other cities should be checked ' to see.what their fees are. Commissioner Domingu.ez suggested that we check with a city of comparable size to Carlsbad and ther check the County fees. Chairman Wrench asked if it were possiblc to tie this fee to size of square footage or someth-ing to..relate it to the work involved or amount of time it takes to process an application. Actual postoffice mailings to property owners within 300 ft. was discussed, and maybe the 300 ft. limit should be expanded to in- clude property owners in a 1 arger radius or maybe even onsite postings along with, the postoffice mailings. ~----".""r~"""~~.""-,rr."..""."".".- -... * "_._ *,~"~- .*.I, ".""..." Whether or not the owner should sign the application,as well as a agent was mentioned .again. It was agreed that ownership is more important now than ever and something should be signed by the owner stating liability, at least. Also, if the owner' is a corp- oration there should be required a list of the principals of'the corporation. - A list of standard conditions should be submitted to applicants and a signed copy for the file stating,that the applicant receive the list of standard conditions. It was unanimously agreed that staff should rewrite the Planned Unit Development and return to the Commission for -review and approval.
