APPROVAL OF MINUTES AND RESOLUTION
The minutes of the adjourned meeting of May 7, 1975 were approved as submitted, with the exception that under the heading "Open Spac,e and .Landscaping" the word "comprehensive" should be. added.
The minutes of.the meeting of May 13, 1975 were approved as sub- mitted, with the exception of the vote on Page 4 should read

Prior to considering the approval'of Resolution No. ,1153 (Case No.
V-250 Michael Straub)', ,the Commission heard the request for a neb
hearing. Assistant Planning Director Bud Plender indicated the staff memorandum explaining the options which they would have to consider. Mr. Plender pointed out that there was also before the Commissioners a letter,signed by Dave Minnich as agent for the applicant reiterating the'reasons why they requested a new heari.ng
Commissioner L'Heureux stated that even though he had voted for ' . denial of the application he would not accept this resolution as mitten. . ' .
The Commission instructed staff to set a new public hea.ring for
June 25, 1975.and to consider Resolution No. 1153 null and void. .

accept the.letter as an offer to pay residential.unit fees under protest. He further stated land was offered sometime ago in lieu of fees and they are asking for a proration of that land. They have no. hesitation about a continuance.and would like some guidelines from the Commission as to their opinions-of a desirable project.
Bill Lusk, President, John D. Lusk & Son, stated that they have walking greens, different configurations, etc. in an attempt to come up with something new. He was not ready to commit himself to any one design, but felt that with a continuance they could work with staff and submit something they would approve of. Mr Lusk felt that the denial rec.Ommen ed based on existing street system not being adequate was not correct. The condition pertaining to a solid noise barrier 'he felt was perhaps not strong enough; inasmuch as they use Dr. John K. Hi 11 iard, acoustics expert for' the County of Orange Planning Department, and he may recommend something better than the condition states. He felt that condition #10 referring to exterior architectural treatment of all coaches was unfair because. his company has no control over how the manufacturers finish.their trailers. He felt the condition stating the proposed entrance abutting Poinsettia 'ane shall be for. emergency access onJy was perhaps tpo strict Commissioner Jose mentimed he was familiar with the develop- ment south of this proposed one and they have a similar' conditions which is working wuite well for them.
After determining there was no one in the audience'wishing to speak, the Commi'ssion voted unanimou.sly to continue this' . item to June 25, 1975 to allow applicant and staff sufficient time to.work out a-possible redesign, noise problems, etc. and also allow applicant time to, enter into an agreement with the school.
2) Case No. CT 75-3 Dale Elkins - Request for approval of a tentative subdivision map .providing'six condominium units on 0.392 acre, one lot parcel, generally located on the northwest corner of Gibra.lter Street and Jerez Court, zoned RD-M. Three of the six units are under construction as apartments.
Assistant Planning Director Bud Pl-ender gave staff presen'ta-- tion and recommendation of approval, explaining that.this . application addressed a one-lot subdivision onTy. The question was answered that even though this applicant is
* asking for approval of a six-unit condominium, the tentative map approves the lot only, not how many units. Mr. Plender noted that under conditiops of approval No. 2 should be deleted completely ,since it is a duplication of No. 1 and.
. condition #1 should read eighteen months instead of one year. .\
Harry Truax, 'Brian Smith Engineers , 2656 State Street, , . stated'he would agree with the meaning of approval for the lot only. If the Planning Commission approves the tentative map this means they can build' up to six units on the lot but cannot exceed that number.
Paul Bussey, City Manager, stepped to the podium with an
explanation that what is being approved is merely the building site, never the building locations. Mr. Bussey felt it might be wise to attach something to the condition referring to the Map stating this approval is for the lot only.

The Commission voted unanimously to recommend to. City Counc approval of CT..75-'3 with the following chang.es recommended conditions submitted: Condition No; 1 should be changed to
. eighteen months. A sentence should be added stating that this Exhibit A is for the lot only, not approval of locatio of buildings. Condition No. 2 should be deleted and all remaining conditions renumbered.

3. Case No. CUP-108'- Louis A. Sciarra (Boy's Club Carnival) - Reauest for adDroval of a Conditional Use Permit to allow t a"" ~ -~ "I I - ~ utilization of a portion of the Plaza Camino Real parking 11 for.the annual Boy's Club Carnival from June 11, 1975 throul June 16, 1975.
Assistant Planning Director Bud Plender gave staff presenta tion, explained graphics and recommendati.on of approval as outlined in the staff report. Mr. Plender explained that since checking with all departments involved and having had no problems in the past with this application, one of the conditions grants this permit for five years.
Commissioner Jose felt this area might be built up consider ably before the' five-year permit expired and conditions may not .be the same. Commissioner Watson felt the Boy's Club would be very happy wl'th three years and it was determined the applicant had. not asked for anything other than one yea

4. Case No. SP-l22(A) - Covinqton Brathers - Request for appro, Val of a ,Specific Plan allowing construction'of 300 dwellin! units on a 61-acre site,located at the southeast corner of Poinsettia Lane and Interstate 5.
Assistant Planning Director Bud Plender explained'that the
. amendment was for a reduction of the lake area making it TU)\ more of a greenbelt area;. lots remain the same as does the . . road pattern. There is no school letter stating any agree- ment had been-.reached. A telegram was received here tonigh, asking for a continuance, apparently with the idea of a school letter coming.

George Flanders, 3765 Yvette Way, asked about the dedicatio' of land to the City and wondered if this would be land dedi' cated to the City a.s a park and if so would the City get land that again cannot be used but merely has to be main- tained by the' City. City Planner Mike Zander.explained to Mr. Planders that. that particular area has already been' dedicated as part of their park-in-lieu fees.
The Commission'voted unanimously to continue the public hearing to June 11 , 1975 to allow applicant time to enter into an agreement with the school district.

Chairman Wrench asked if there was anyone in the audience wishing to speak on this item. After determining there was not, Mr. Wrench said they had a request from' the .City Manag to continue this matter.. It was unanimously approved to co tinue GPA-31 to June 11 , 1975.
UNFINISHED BUSINESS
6. Case No. ZC-153 - John Mamaux, for William Canning, C.W.C.
Development - .Request for approval of a preannexational zon change from County E-1-A to RD-M on a 13.9 acre si'te locate
north of Alga Road.. Staff originally recommended denial of 'the RD-M zone and approval of a P-C zone instead. Planning Commission denied the zone change without prejudice. City
' Council has returned ZC-153 to the Planning Comiss'ion with the intent of approving the P-C Zone.
I on the east side of El Camino Real approximately 2500 ft.
. Assistant Planni,ng Director Bud Plender explained that this original request was denied without prejudice because of a concern over sewer service. City Council has heard the request and has now returned it to the Planning Commission
.. with the inten,t'- of approving the P-C Zone recommended by staff on the original application..
Commissioner Dominguez wanted to know how the sewer questio was resolved; and Tim Flanagan, City Engineer, stated that -Leucadia County Water District has included this in their district.
After being.satisfied that sewer service would be available
. the Commission approved the P-C Zone unanimously,. .
NEW BUS I NESS
Commissioner Dominguez, wanting an answer as to whether or not a' application should even be considered if public facilities had not been met, read from Planning Commission Resolution No.. 1003, dated 11/27/73. .He mentioned that City Council had adopted a similar policy, although they have not recognized Planning Com- mission policy. Commissioner Jose felt they should .know how the two policies differ. Various solutions were offered ranging fro1 having the applicant sign a check 1 i.st stating these things had. to be in the Commission's hands prior- to'public hearing, deletint s.chool facilities from the public facilities, not .hearing the item at al.1 and lettjng the applicant know ahead of time it woull not be heard, etc.
Commissioner Watson made a minute motion, approved unanimously, to continue along these lines and have staff consider the .di.s- cussion here at hand, 'discuss this with school representatives,. etc. and come back with a solution to the problem. DISCUSSION ITEMS
7. .Case No. ZC-64 - Final Review of the Planned Unit Develop- ment and Condominium Conversion Ordinance. Ass-istant Planning Director Bud Plender explained how he interpreted Commissioner's suggestions and how he complied with them. He pointed out that staff is still working on the section for guarantee of performance. Mr. Plender asked that they adopt Resolution of Intention No.. 109 stating the Commis- sion's intention to hold a public hearing but not specify a

George Flanders., 3765 Yvette Way, felt a suriey of. planned
. communities and condominium conversions would be in order. Commissioners felt this would be of limited value because dependiug on what interest was held by the firm- doing the survey it would be.slanted to show their interest. In other words , a real tor, a developer or an economic group would eac come back with a different perspective.
Tony Howard-Jones; 2785 Roosevel t, mentioned it was not practical to assume that any conversion could meet the stand ards for dev-elopment that a new condominium would be require to meet. He felt conversions served a very real purpose; especially in the downtown area and serving the elderly who
. are .required to live near services. When asked why conver- sion of a one-bedroom apartment to condominium ownership would be in the public interest, he answered entirely price; ,a lot of people prefer to own than to rent. Commissioners felt there was no way 'to assure the sale of these condomin- iums , if approved, to 01 der persons without automobiles .
Chairman Wrench .stated Mr. Howard-Jones' comments were good and perhaps something cou'ld be written into' this zone c.ode amendment that would permit flexibility for certain types of .housing programs, such as HUD sponsored.
There was some discussion about subdivision maps be.ing filed with the description "not a part of". City Planner Mike Zander explained that there has to be a minimum parcel size remainder before the applicant can exclude. It was felt tha

Under application forms, the Commission wanted it'spelled ou more strongly that the application would not be approved unless public facilities .were satisfied. Also, the Commis- sion mentioned the fact that if anaowner was a corporatfon, corporation officers should be listed.
Conmissioner L'Heureux commented that perhaps something -should be stated regarding energy-reducing methods used. Mr. Flanders spoke frQm the audience and felt instead .of
. pointing out any particular construction methods, merely . state the highest form of the art available, because this would take care of new methods coming up.
The Conmission unanimously approved Resolution of Intention
No. 109 stating their intention of bringing ZCA-64 to a
pub1 ic hearing .

9. Panhandle Lot Policy. Assistant Planning Director Bud Plender explained that copies of the panhandle lot policy were sent to the Commission as an information item. Staff is working on the first draft of a new policy; however, it
