CALL TO ORDER I.
The P.lanning Commission meeting of July 9, 1975 was called to order by Commissioner Jose.at 7:30 P.M.
ROLL CALL -
APPROVAL OF MINUTES
Minutes of June 11, 1'975 meeting were approved with the following.'exceptions: Case No. ZC-156 motion for , approval.was made by Commissioner Dominquez. The second paragraph on the same page indicating E-A zoning for the balance of San Diego Gas & Electric lands was also a motion made by Commissloner Dominquez and unanimously approved.

Acting Chairman Jose'explained that Commissioner Wrencl has resigned.as Commission Chairman and member; inas- much as he has been promoted to a pasition with his company.in aoother .City.

1) .Case No. v-250: Michael Straub (etc.) After . .. hear-ing the explanation given by-Vice-C.hairman Jose Michael Straub asked that his case be.continued for two weeks. Determining there was.no one in the audience objecting to this, the Commissioners' voted anc unanimously approved continuation of this item to July 23, 1975.

It was requested that the agenda be changed and no one in the audience objected.
4a) Case No. SP-l64(A) Larw'in-San Diego, ,Inc. Planning .Director Don Agatep. .gave staff ,presentation, explained graphics, and stated staff's recommendation of approval. Assistant Planning Director Bud Plender ex'p.lained the differences between t-he approved specific plan and the amendment as suggested-by staff. Mr. Plender explained changes in conditions recommended by staff.

conditions. ' He particularly objected to the condition regarding the sharing of the traf.'fic sigrial and the width qf the alleys.. Mr. Stan Morris, Toups Engineer- ing, showed sketches showing the alleys.
Mr. Andersbn read from the C.C. & R's of -the Homeowner's Association, pointing out his opinion that width of alleys does not solve the problem, but c'orrec tion of illegal.parking does. I'f alleys were to remai at 28 ft., then he objected to the garages having to 0 set back 4 ft. Mr. Andersen also indicated minor changes. in wording he would like to see in condition nos. 12,- 20, 22 and 35 of the staff recommendations.
Bob Leger, Vice-president, Tiburon Carlsbad Homeowner' Assn.. stated he was not necessarily ob.iectina to this development, but that provisions fok.52-additional parking spaces was not going to alleviate the problem. Since some of the parking is. going to be allowed along street fron.tage, he wanted the Commission to be aware that not all of the frontage is usable for street parking. Mr. Leqer pointed out that he has made these statements in a letter to the Commission dated July 1. He pointed out that'drainage is also'a problem and did not see a conditi.on sphcifically covering this. .An agreement they could enter into with the City Pol4ce Department to enfqrce Motor Vehicle Dept. codes was talked about.'
Commissioner' L'Heureux asked about walkway lighting. Mr.. Leger said what was meant in his letter was that he .did no't think it was right that-a company .Could enter into an agreement with the San Diego Gas & Electric Company which the homeowners were going to have .to pa.y for.
Dale Littlefield., 2810 Via Astutg, indicated lighting and drainage provisions were his main objections.

Public hearing was clo'sed.
Vincent Biondo, Jr. , City'Attorney, .answered questions raised as to the agreement which.the homeowners could epter into with the City Police Department. .Tim Flanagan, City Engineer, also explained that the vehicle code allows a City.to enter into awagreement with a Homeowner's Association. This has to be in.. writing to the Police Department, and covers mostly 'speeding and parking. It was decided that this should be made a condition..
The questjon of bonding in order for the CI'ty..to . :inspect drainage flas ta7ked.about; however, Mr. Biondo explained that this is imprpctical. .. ..
Mr. Biondo asked why the 28 ft. wide alleys and Mr. Plender explained that even though- this is .more than is required for standard alley, these alleys are used as entrances to most of the units; they are also used for mail, trash and visitors.

The condition regarding the agreement for the traffic signal at Elm Avenue and El Caminv Real w'as ta.lked about. at length. .
Public hearing was reop'ened inasmuch as Mr. Andersen wanted to speak again. His opinion was that most of the units in his development would not be using Elm Avenue and this traffic would .be generated by oth'er properties. His feeling was the' condition regarding the traffic signal was inequitable.

The motion was made and unanimously approved to reco- mmend approval of SP-l04(A) subject to conditions contained in the staff report presented, with the following exceptions: Wherever applicant or developer is indicated add the words "or his successor of interest". Condition #2, delete the words "now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent prope.rties" and place a period after the word "statutes" immediately preceding th'is stateme.nt. There wi.11 be a conditlon No. 6 added stating the applicant or his .successor of interest will provide proper ingress or egress on Appian Way such as may be necessary due to r,ealignment of Appian Way. Condition #12 should, co'ntain the word "alleys" also. A. conditio will also be.added stating that the applicant or his successor,of interest will enter into an agreement wit the City of Carlsbad to. allow enforcement of traffic control and parking regulations. Condition #T4 should read for the second sentence - "Of this total, at leas 25% per unit shall be provided as on-site guest park- ing. Two of.these spaces shall be provided as garages Condi'tion #15 to state in the f,irst sentence that the Tiburon Master Development Plan shall be submitted to the City for approval prior to issuance ,of building permits on s'ubsequent phases. Condition #16 should be Exhibit B, datkd July 9,' 1975. Condition #17 is deleted. Condition #19 to read "irrigate and. landscap all. graded slopes within each construction phase upon completion .....I' and this condition to be also carried over to the tenta'tive map.. Condition #20 to read "privat'e-owned open spaces" and this' to be. the same in cbndition #22. -Condition #22 to be also in the tenta- tive map. Condition #35 is deleted. Condition #36 to read "street trees and a 10-ft. street tree ease- ment ... ...". Condition #35 on Page 5 of the staff report to be deleted from the Specific Plan entirely.
'A condition to be added, if possible, to insure elim- ination of the pondirig .problem or water collection in. alleyways for at least one year after project has been turned ouer .t.o the Homeowner's Association. Commiss- :ioner L'Heureux su'ggested that if a condition could no be made to thi's-effect,' that staff sugges't to, the City Council that additional studies be made'to see how this problem can be handled. The motion was amended and unanimously approved to direct staff to'look. into this study.

4b) Case No. CT:74-25 - Larwin-San Diego, Inc. (etc Planning Director Don Agatep gave the stayf report and .tiis suggestions to-remember that Conditions #19, 22, 3 and 36 contained in the staff report under the Specifi Plan be incorpor.ated in' the Tentative Map.
De'Vere Andersen, Larwin-San Diego, Inc., wanted to ma sure it was aareed that under condition #35, item'(b) - _. ~ - was eliminatei. This was agreed'. Mr. Andersen asked about the park-in-ljeu fees and Mr. Agatep exp,lained. Mr. Andersen asked that in Condition #9 the last sen- tence read "coricurrent with recordation". Tim Flanaga City Engineer, agreed.
Public hearing was closed.
In response to questions raised regarding Mr. Frazee's property, Commissi,oner Jose stated that when this Development was initially adopted by the Pla'nning Commission'and subsequently by City Council that there was ample opportu'nity for opposition to be heard.
It was moved and un-animously approved to' recommend, approval. of CT 74-25 aq outlined in staff report, with the following exceptions: Condition #2, end the sen- tence after State or Federal statutes. Condition #9 shall read "Exhibi.t C" for the Master Plan Development MP-5. Thi.s condition will also read "dedicated to the City concurrent with".. Conditions 12, 13, 14 and 15 will be ad.ded as agreed to from the.Specifi.c Plan staf report. A condition will be added stating that if a retaining'wall shodld be necessary along the Elm Avenu alignment that sufficient planting or landscaping be provided, meeting the satisfaction of th,e Parks & Recreation. Dfrector and Planning Director. , .

2. Case No. CUP-109 - Ojeda (etc) Assistant Planning
Director Bud Plender gave staff presentation,. explai~ne graphics and staff's recommendation for approval.. Mr. Plender stated the last sentence in Condition #2 shoul read "The monument sign. shall not exceed a height of ' 6 ft., or an area of 40 square ft. per sign face". Condition #6 shuld be reworded to read - "A parcel ma shall be rqquired'prior to issuance of building permit and joint easement rights for mutual ingress and egres across the eastern property line shall be made part of the recordation of subject parcel map." Mr. Plender ,explained on the map the portions of subject property to be used by the property owners as retail, storage and distribution; in'answer to a question raised as ta compat'ibil ity of a restaurant with what the owner had .in mind for ,the balance of the property.
Public hearing was clos'ed.
Planning Director answered a few questions such as the are not intending to draw freeway traffic but wi.11 build there as a convenience to industry, and they are preceding industry in that area.
It was moved and unanimously approved to grant CUP-109
with the changes in condition #2 and condition #6 as
explained in the presentation.

3. Case No.'ZC-159 - City Initiated (etcl 'Planning Director Don Agatep ex.plained the procedure o'f the
.overlay "Q" zone and why this was necessary on this
property. Mr. Agatep explained that the Planning Com- mission would have a site de-velopment plan on this project before them soon. Too many signals 'on El Camino Real was a concern of the Commission, and it wa explained that El Camino Real is, depicted in the Sceni Highways Element. of the Carlsbad General Plan and the matter of signals could be reviewed with'.the'implernen- tation of this element.
Warren C. Lefebvre, Executive Vice-president, Rink'er Company, stated that his application had been started two Years aao and he would appreciate any help .the
Comm;'ssion iould give him on'just what .constituted
"Hispanic" in order.to eliminate any problems in com- pleting their appl.ication. The Planning Commission
responded generally.
Public hearing was closed.
It was moved and.un.animously approved to recommend approval. of. ZC-159 as qutlined in'sta'ff's report.

5. Resolution of Intentiow- Case No. ZC-158 - 'IQ'l Zon
CalsPacific. It was moved and approved to adopt the Resolution of Intention declaring'the Commi.ssion's intent to hear this item a,s a public hearing.
DISCUSSION ITEMS
Commissioner L'Heureux stated he objected to app.rov.ing a Resolution of Intention which they did not have i.n . their packets. He also objected to not having 'a site map for Case No. CUP-109 (Ojeda). The Commissi'oners also felt. staff work on the Larwin cases could have been better.
Open-Space Zoning was tal ked about and it wa's agreed by the Commission to concur with City Council in any action which would delete specific properties from .thi! Open-Space Zoning; such as San Diego Gas & Elect'kic
Lands or the Greenwood property. Planning Director Do4
Agatep explained that the City Council can .always
.reduce the scope of any public hearing request. but . cannot increase it'without renoticing it for public hearing. Mr. Agatep will, for.ward a copy of th-is'motiol to the Commission in their next packets.
