DATE: November 26, 1975 f CALL TO ORDER ': I The meeting was called to order at 7:30 P.M. PLEDGE OF ALLEGIANCE ROLL CALL APPROVAL OF MI FIUTES The minutes of the November 12, 1.975 meeting were approved. (Commissioner Fikes not present when vote was taken) WRITTE'N COMMUNICATIONS Planning Dit-ector Don Agatep advised the Commissio.n that they each had a letter from the Carlsbad Unified School District in their packet informing them that Pacesetter Homes, Inc. (CT 73-59) had cancelled its agreement with the school district and any future development of the property would require a new letter from the school district. ORAL COMMUNICATIONS Commissioner Dominguez called to the attention of the Commissioners an article on Page 3 of the Huffman Newsletter regarding a Supreme Court decision. I PUBLIC HEARINGS I Case No. ZC-154 and SP-167, San Diego Pipeline - Request for a zone change from L-C (Limited Control) to P-.U ('Pub-lic Utiliti.es1 and approval of a specific pian. tQ -allow- 9 pi:peIi.'nYle b'ooster pump.statTon. Za'nder gave the staff presen- tation statlng- that tke proposed pump station would be on one acre of a 5.12 acre parcel and the applicant had requested that the one acre parcel be rezoned from L-C to P-U. On September 11, 1973, a CUP was granted for the pump station, but since construction did not commence within the time limitation, the CUP became voi'd. Staff recommended to the applicant to apply for a Zone Change to bring the zoing of the property fnto consistency with the General Plan, and to also avoid the. time limitations of a CUP. Plannfng Director Don Agatep pointed out to the tommission that SP-167 is consistent with the new Zone change that is proposed in that all the facili- ties and requirements of a Specific Plan under the old zone are consistent with the requirements for Land Use, landscaping, etc. There was discussion of this project by the Commis.- sloners and they were particularly interested in . the amount bf noise that would be generated by this type of installation. , :4r. H. V. Corrodi, San Diego Pipeline Company, 610 South Main Street, Los Angeles, CA 90014, stated that noise is minimal as they are electric motors. He said that they had a larger booster station than the one that Is proposed and there have been no complaints from the apartments that are nearby In Norwalk. PLACE: COUNCIL CHAMBERS Page 2 Corrodi also answered questions regarding whether or not they were associated with SDG&E (they are not: and what types of fuel would be transported by this pipeline (refined petroleum products, i.e. gaso- line, diesel, turbine fuel). He also said that they have a 15 foot easement on the San Diego Gas and Electric Company's right-of-way easement which is 150 feet wide. It.was moved and approved to recommend approval of ZC-154 based upon the findings as outlined in the in the staff report. It was moved and approved to recommend approval of SP-167 per staff recommendations and conditions with the following amendments: add to Condtions 4 and 5 "to protect the eventual development of the residen- tial area". Adoption of Goals Statement (GPA-37) and Minor Amend- ments and Additions to the Land Use Element (GPA,-36) of the Carlsbad General Plan. Associate Planner Mike Zander gave the staff presen- tation. He stated that the presentation would be in two parts (GPA-36 and GPA-37). GPA-36 affects the Land Use Element in two ways. One it-would modify the textual description of the Public Utilities Classification (the textual change to the 'IU" classification would clarify the types of opera- tional functions permit'ted in that designation.) and add a description regarding "Unique and Special Uses" (this added section would generally cover those uses permitted by a CUP, i.e. cemetaries, churches,. golf CQUrSe.S, pub1 i c uti 1 i ty operati:.ons) . .Second, I't woul make four minor amendments to the Land Use Plan to fi the above descri'ption modificattons and for zoning cmsiste..ncy purposes (Ill former KOA site; C2) portior of. Pslomsr Airport Busi:ness Park; (3) CMWD Office; and (4) Batiquitos Substation Site. A minute motion was made and approved approving GPA- 36 of Resolution 1205 for the reasons outlined in the staff report and the inclusion of an overall goals statement and general policy statements would cl.arify the General Plan's overall function. GPA-37 - The major part of this amendment involves "examination of the proposed Goals Statement of the General Plan. This document, including the over,all goals statement and general policy statements .was approved by the Planning Commission on December 10, 1974, but the City Council tabled .this item until all Elements of the General Plan were adopted. On November 20., 1975, the Goals Committee met to consider GPA-37 and made three suggested changes. A minute motion was made and approved approving * the three .recommended changes listed, below to GPA-37: -1) Under the overall Element cloals, place an asterik (*) after Conservation an'd Open Space and note at the bottom of the page that these Elements have been combined into a single document. 2) Reword Pol icy #1 "Each goal contained within the General Plan reflects the destres of the community. There was then a great deal of discussion regarding Exhibit 6. (Councilman Skotnicki's proposed goal statements for the Land Use Element.) A minute motl'on was made rati.Tyin.g the goals state- ments already adopted in the Land Use Element; and if the City Council wishes to amend those goals con- sistent with one of ther member's comments, it isT their perogative. A motion was then made and approved recommending approval of Resolution 1205 adopting Exhibits 1-5 . with Exhibit 6 to be deleted to reflect the Commis- sion's last minute motion. NEW BUSINESS ZCA-78 - Commercial-Limited Residential Zone planning Director Don AqateD told the Commission r that no-action was required'of the Commission at this point, and that this item was on the agenda merely to notify them .that the City Council instructed the staff to set for public hearing a proposed Commercial Limited Residential Zone. This zone is in direct response to the Land Use Element hearings of some residential, commercial and professional uses in the area south of Elm Avenue in the area around the rail- road tracks and Madison (more specifically the commercial areas around Roosevel t). Mr. Agatep ad- v1se.d the Commission that in the not too distam.t future they would be conducting public hearings ,on this proposed Commercial-Limited Residential Zone. OLD BUSI'NESS 1976 Planning Commission Calendar - Planning Director Don. Agqtep advised the Commi:ssi.on that tkere was no legal-0.r legislative reguir'ement to adopt a calendar except to set some proce'dural things in motion so that the Commission can represent to their contempar- ies and constituents what the normal processing time is under normal circumstances. The processing time is about 40-45 days. This calendar is a guideline . for the Commission and staff to use. It was also pointed out that there would be certain projects that would not strictly adhere to the deadlines. A motion was made and approved to adopt this tenta- tive schedule for the coming year. Commission meetings during the Holidays - There was a discussion about whether there would be meetings on the evenings of December 24th and December 31st. A motim was made. and approved to announce to t'he newspaper and all concerned that the Planning Com- mission does not in-tend tb conduct a P.C. Meeting on the second P.C. hearing date in December.
