PLACE: COUNCIL CHAMBERS - " CALL TO ORDER The meeting was called' to order at 7:30 P.M. ROLL CALL All present but Commissioner Dominguez .. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Minutes of June 9, 1976 - Approved APPROVAL OF RESOLUTIONS Resolution No:1252, Bill Dominguez Commendation Resolution No. 1259, ZCA-72, Pa-nhandle Lots - Approved with, two changes: 1) Subsection (8) 'of Section 21. 08.080 and Section 21.10.080 - add "to the street'' at the end of the first sentence. 2) Subsection (10) of Section 21.08.080 and Section 21.10.080 - add "Excep for mail boxes" at the first of the second sentence. '1 Reso.lution No. 1260, Harry'J. Asher - Approved with two changes: 1) .Page 3, No. 4 should read as follows: "All of the following existing improvements will remain as required in original approval of the application:" 2) Page 4, Commissioners Jose and Dominguez listed twic? under vote. WRITTEN COMMUNICATIONS - None ORAL COMMUNICATIONS Chairman L'Heuruex told the Commission about a recent Supreme Court ruling that allowed citizens of a communi,:y to vote regarding zoning changes rather than leaving thc decision to the Council - no land can be rezoned withou,; 55% electorate vote. The decision was to leave the power with the people rather than delegating it to the Council. This was the first time in 40 years that the Supreme Court has addressed a zoning case. PUBLIC HEARINGS Continued Case No. ZCA-79, Monument Signs - Zone Code Amendment to provide for additional free-standing signs in the C-2 Zone and to provide for Community Identity Signs. Assistant Planning D.irector Bud Plender gave the Supplemental Staff report in response 'to questions raised by the Commission on June 9, 1976. The major questions addressed were: 1) How does the Ordinance affect freestanding sign relationship between a common I property line? 2) Is there any way to restrict monu- ment signs to a distance of 200 feet between signs on adjoining lots? 3) How can new car dealerships be grant ed a freestanding sign for each auto franchise? Page 2 Mr. John Loy, Attorney at Law, 801 Mission Avenue spoke on behalf of the dealers at Car Country and reiterated what he had said at the previous hearings on this matter. The Com.mission and Staff then discu’ssed the following aspects of the sign ordinance: 1) it was felt that our present sign ordinace gives ample identification, 2) must look at the sign program from the point of aesthetics, 3) should look at freestanding signs in all commercial zones and not just the C-2 zone, 4) felt that Car Country would conform to the amended ordinance and would do a good job, but the Commission feared that there would be a proliferation of signs in other parts of‘ the City. It was agreed that Section 1 of the proposed amended 4 ordinance regarding Freestanding Signs should be separated from Section 2 which pertains to the Community Identity Sign Program. A motion was then made to delete Section 1 .from the Motion X I proposed amended ordinance, thus denying it. . Ayes X xx x *. Ayes x xxx x X Absent. x New Case No. CUP-121, Carlsbad Printing Company - Request fo-- approval of a Conditional Use Permit to a!low operation of a print shop as required by Se-ction 21.42.010 (4b) of the Zoning Ordinance. Assistant Planning Director Bud Plender gave the staff presentation stating that the applicant has operated his print shop across the street from the project site for many years. His request for a business license at the proposed project site prompted this application. Staff feels that the use is appropriate in its new location for the reasons outlined in the Findings in the staff report. Staff also fGlt that the CUP requirement for printers is too broad for the types of printing establishments currently doing business. The requirement undoubtedly dated back to the time when printing was done with heavy equipment. Frequently this printing was done by news- paper publishers, which poses additional patential nuisances. Printing technology has since undergone many changes which have led to the establishment of smaller commerical printers. These operations do not normally involve nuisances uncommon to other commercial . uses. For the record it is noted that the applicant was pre- sent, but had no comments to make. A motion was made approving CUP-121 per the recommenda- Motion X tion, findings and conditions contained in the staff . PLACE: COUNCIL CHAMBERS Pase 3 - Case No. SP-l46(A)(Supp), Santa Anita Development Corp. Request for review of modification to SP-l46(A) site de- velopment plan (Security Pacific Bank) and approval of arc.hitectura1 style of building elevation for Security Pacific Bank and adjoining commercial building withi-n proposed Carlsbad Shopping Center. Planning Director Don Agatep gave the staff report point- ing out the changes that had been made and were to be reviewed by the Planning Commission. Security Pacifix Bank would have a drive-through facility and the proposed architectural style of elevation for the Bank and adjoin- ing buildings are the same as the major facilities as pre- sented to the Planning Commission on February 25, 1976 (the notable exception is that the Bank does not have a mansard or tile roof but provides a flat roof). 4 Bill Hughes, Santa Anita Development Company then showed various architectural renderings dep-icting the elevatipns , style, etc. He stated. that they would have a problem with the condition requiring a landscaped barrier separat- ing the Standard Station from the westerly driveway of - Haymar Drive, but providing for a two-way ingress-egress in that they would be willing to provide for the land 1 scaping, but it would be a slow process going through I/ Standard Oil company to get permission to build'this barrier on Standard's land.. A Minute Motion was made to approve the architectural ele-Motion vations subject to the applicant providing the conditions Ayes x >.x IX outlined in the staff report with the exception of Con- Absent X dition No. 1 pertaining to the barrier separating the Standard Station. This condition to be deleted and to be incorporated into the Specific'Plan Amendment to be heard by the Commission on July 28, 1976 (the City will work with Standard Oil with the applicant in initiating the use of their land). Case No. SP-l46(A), Santa Anita Development Corp. - Request for approval of a sign program for the Carlsbad Plaza as required by Condition 16 of City Council Ordinance 9419. Assistant Planning Director Bud Plender gave the staff presentation stating that their proposed signing was of a Hispanic motif and met all requirements of the City. A supplemental report was given to the Commission whi'ch gave the Commission alternate conditions which were re- quested by the applicant (specified types of signs and areas to be covered in more detail). Ron Roberts, SGPA, 440 Upas Street, San Diego, CA. showed renderings of the type of signing to be used and also requested that certain areas be designated not to have signing (would not fit in with their overall view of the project). He also passed out copies of the staff report with many changes made - basically restrictions on their tenants. He asked that these changes be made a part of the resolution approving their sign program, that certain areas be removed from any signing and that under Condition 4(d) "4" square feet be changed to "5" square feet. Mr. Don Albert of Home Federal Savings requested that Hoae Federal Savings be allowed a freestanding sign. Mr. A1 bert was advised that the project was a1 lowed only one freestanding sign and that was the one approved for Von's and Pay Less. Under the present ordinance, there can only be one freestanding sign per lot and that until the Council acts of ZCA-79 or a future sign ordinance, they will not be allowed 'a freestanding sign. *. , r I - "" "" \ \ Paqe 4 \' I A Minute Motion was made approving the sign concept as presented by Santa Anita Development Corp. for the Carls- bad Plaza and directed staff to prepare a resolution in- corporating those changes agreed to by the Commission, Staff and the Applicant for approval on July 14, 1976. DISCUSSION ITEMS It was determined that workshops for the Planning Com- mission should be set up to study two areas of concern: 1) Develop changes to present ordinances concerning drive through facilities other than restaurants; and 2) Develop criteria concerning the Hispanic Corridor along El Camino Real and study traffic circulation patterns. July 25, 1976 from 4:30 to 7:OO p.m. was the date and tim agreed upon to host a party for Commissioners Packard and Dominguez. Planning Commission, City Council and Depart- ment Heads to be invited.
