1) Case Nos. CT 76-12 and PUD-4 - Calavera Hills, Robert Ladwig, Agent - Request for approvat.:o,f' a' ' tentative tract map and planned unit development. to provide a 138-lot dwelling unit, 142-lot subdivision on approximately 63 acres.
Acting Planning Director Bud Plender gave the staff presentation. He called attention to the new wording (Condition 23). This new wordinq was adopted recentl) by the City Council. It allows the Council to decide the type and level of maintenance after adoption of a maintenance policy. Council will hold a workshop on 1/25/77, to which the public is invited, to discuss open space maintenance.
Mr. Plender indicated that the EIR suggested walls along Tamarack Avenue to reduce noise; however, staff is not too concerned about potential sound problems, but a uniform wall or fence along the property ljne would reduce an unattractive conqlomeration of differ- ent types of fences along Tamarack Avenue.
City Engineer Tim Flanagan said that full street im- provements would be required on Tamarack when the vehicle capacity reaches 5,000 vehicles per day. Only 1 signal has been funded for this development, but as more phases are constructed more funding will be required.
Bob Ladwiq, Rick Engineering, 3088 Pi0 Pico, Carlsbad responded to concerns about the half street improve- ments by pointinq out that the 5,000 vehicle per day requirement fits in we'll with the Master Plan. On the noise concern, he pointed out that the uniform building code requires certain sound levels to be complied with. They agree with all of the conditions in the Staff Report, and asked the Commission to approve this subdivision.
In response to questions on slope problems, Ladwig said that there will be a maintenance district for landscaping this project.
On the question of recreational vehicle parkinq, he pointed out that the. City Council took no position on this, at their January 4, 1977 meeting, because they felt there was no practical way to police it.
&S tG. the availability of water, Ladwiq stated that the Carlsbad Municipal Water District says water is available. There may be a problem in getting it to the project, but there is a possible aqueduct from Ouesthaven Road to the south which might bring it in.
He pointed out that this project could not legally take water away from another part of the City.
Commissioner Nelson asked what the applicant is doing to carry out the energy-saving suggestions in the '.

replied that he has been working with SDG&E on the best way to use energy to the maximum efficiency.
They may offer alternative sources such as water and space heating, if the future residents cari'afford it.
Mr. Ladwig, responding to severa1"questions on recre-
ational open areas, said that their open space areas would be well located and practical, with no fancy
club houses, etc. ?; 1,
Commissioner Rombotis feels that since the .Coastal Plan will slow down development west of El.Camino Real, that this is the logical area to develop rte.xt..' There was some discussion for and against this concept,
Commissioner L'Heureux expressed concernsabout the pressures upon intervening property owners, since some of this property is in agricultural use; also that the schools could not adequately provide for this development; and that the 1974 Master Plan might be somewhat outdated.
He feels that in the past, where the City has allowed development in otherwise undeveloped areas, there have been-some problems.
Mr. Ladwig responded to questions about possible lack of public facilities by pointing out that the EIR indicates that facilities are very close, such as schools, shopping centers, etc..
He further stated that the tentative map conforms to the phasing schedule in the Master Plan as set forth by the Planning Commission.
He noted that the County Assessor doesn't consider
land adjacent to this property agricultural for tax i purposes - but residential. i
A Minute Motion was made to continue Item Nos. CT 76-12 Ayes X X X and PUD-4 until January 26, 1977, to enable the two absent Commissioners to be present.
Mr. Ward invited the Commissioners to have a meeting on the site sometime before the January 26th meeting. i The time and place will be decided later.
