CALL TO ORDER
The meeting was call ed to order at 7:05 P.M.
ROLL CALL - All present, with Commissioner Nelson arriving at 7:08 P.M.
APPROVAL OF MINUTES - The minutes of January 72, 1977,' were approved, with the chanqe suqqested b.y staff that Nicholas Banche's-remarks on page 2 regarding'5PA-40 and the uses of the TS designation be expanded.

It was ascertained that Comnissioners Fi kes and Watson were el igibl e to vote on this i tem.
Acting Planning Director Bud P1 ender gave the staff presen- tation on this. In answers to questions regavding the . possible costs of this project to the Carlsbad taxpayers, Mr. Plender explained that the City had not required an Economic Impact Report on this project as they are not doin! a new Master Plan. A1 so an Econ0mi.c Impact Report is not required because this is being devel oped through the Planned .Unit Development process.
Bob Ladwig, Rick Engineering 3088 Pi0 Pico, Carlsbad state( that they are in agreement with a1 1 the conditions contai ne( in the Staff Reports. He stated that there.wil1 be addi- tional costs for utili ties, but the costs. will be borne entirely by residents in this project, with no assessment .to outsiders.
It' was noted by staff that Condition 27 had been omitted from the staff report of January 26th. Condition 27 states 'that "A 4-fOOt sol id wall shall be constructed at the top of. the slope- on lots backing up to Tamarack Avenue, to the satisfaction of the Planning Director, prior to the first occupancy permit issuance for those affected- sites .Ii This wall was suggested in the Environmental Impact Report for noise attenuation purposes.
Commissioner Nelson spoke against approval of this 'project because of (1 1 its semi-remoteness; (2). the questionable quality of education that the school 'district might be able to provide for future students in this area; *and (3) the additional costs to the taxpayers.
A-motion was made to approve CT 76-12 for.the reasons out- lined in the Staff Reports (Resolution No. 1314).
A motion was made to approve PUD-4 for the reasons out- lined in the Staff Reports (Resolution No. 1315).

(2) Case No. CUP-1 28, City of Carlsbad - Request for approv of a conditional use permit to all ow the uti 1 i zation of .the old St. Patrick's Church site for recreational activities and meetings.
Tom Hageman gave the staff presentation. He spoke to issues the Planning Comnission had previously brought'dp: (a) fire fighting; (b) parking faci1,i.ties; (c) adequacy of existing structures; and (d) what was anticipated as far as renovation of existing structures. He read excerpts from Parks & Recreation Department's report listing options that the building could be used for. He stated that the Fire Marshall & the City Building Inspector had found that the property meets City standards . ..
Bud Plender pointed out that this CUP is only coming before the P1 anning Commission because it is to be used by the City If a private applicant, other than a Church, had bought the property it would not come under a CUP, since it is was considered to be a 1 awful , existing, nonConformi.ng -use.
A Motion was made to approve Resolution No. 1316 (CUP-1 28) in accordance with Conditions 1 and 2 in the January 26th Staff Report, but with two added conditions: (3) that this project be reviewed annually by the Planning Commission and (4) in case this property shall be u.sed for City functions, an amendment to the CUP will be approved.

(3) Case No. ZCA-83, City of Carl sbad - Creation of a
Bud Plender gave the staff presentation, explaining that the property must be large enough to contain 1 major business (5 acres minimum) and would have only 3 permitted uses: motels, restaurants and hotels with related accessory uses.
A Motion was made to approve Resolution No. 1317 (ZCA-83).
Commercial Tourist Zone (C-T)
(4) Case No. V-267, J. R. Meadows - Request -for a variance to a1 1 ow encroachment of parking and carports into the front yard and side yard setbacks.
City Engineer Tim Flanagan said that perhaps the City wi 11 have to have an assessment district to adequately control the flow of traffic in this area. He also said that there is presently a sewer moratorium on Ocean Street and no new hook-ups will be allowed until the sewer capacity can be increased. He said the decision will be made in March as to how to deal with the sewage problems in that area.
A Motion was made to approve Resolution No. 1318 (V-267).
(5) Case No. CUP-131, Encina Joint Water Pollution Control Faci 1 i ty - Request for a conditional use permit to allow a 12 x 42"foot modular temporary office.
Tom Hageman gave the staff report. He explained that the permanent Encina plant manager needs a place for an off ice since faci 1 i ti es are only large enough. for the pre- sent staff. A modular structure meets a1 1 bui 1 ding codes, ' whereas a mobile home does 'not, but comes under the. vehicle code. Since work may have to be done in' the future on some sewer lines under the proposed location for ttie ' structure, they will be able to move a modular structure at that time, whereas, with a permanent building, they could not.
Les Evans, General Manager , Encina Joint Sewerage Faci 1 i ty, 6200 Avenida Encinas, Carlsbad' stated that enough funds had been a1 located to construct a nice bui 1 ding, about . $30 per sq. ft.

(6) Case No. SP-38(A), City of Carlsbad - Request for ADDroval of a sDecific plan amendment to Permit deletion of certain property included with PUD-7
Bud Plender explained that La Costa had decided to subdivic a. portion of Vale and include it in a CT instead of an SP. This is merely a clean-up item because the SP portion wasn noticed properly before previous hearings.
-George Flanders, 2168 Chestnut Avenue, Carlsbad stated tha. developers sometimes use the PUD to get around the more stringent requirements under R-1 si ngle-fami ly, development PUD's can be good but not if they are used to.get smaller, narrower lots, with zero lot 1 i nes .and more units . , *
Coninissioner Nelson stated that in the future, PUD's shoulc be more stringent as to open space, recreational, parking and street systems - more like an interwoven community instead of small-1 ot development.

NEW BUSINESS
(7) Report on Adobe Ruins at the Santa Fe Knolls Site
Bud Plender mentioned some short-term measures that could be taken to protect this site, but suggested long-term measures also. For instance, a 6-foot fence wi 11 keep somc of the vandals out, but not all. 6-foot is the maximum height allowed without getting into a great many problems. In answer to a question, he explained that barbed wire is illegal in some sections of the City.
Commission Nelson suggested that if there are penal ties for vandalizing historical sites, then this should be put on a sign and posted at the site.

Dr. John Ford, 4906 Refugio Avenue, Carlsbad, a profession, a1 archaeologist, spoke in favor of both the long-term .. and the short-term measures because cultural resources of the USA must be preserved. He felt that a fence would probably be adequate as a short-term measure, as Mira Costl has done in Oceanside. For long-term measures, the historical monument could be used. He stated that the Planning Commission should think more seriously about archaeological resources, as San Diego County has the most important archaeological resources in the world. He pro- mised to send the Commis-sion an analysis Of his opinions as to the preservation of such sites .
At the request of Chairman Larson, Dr. Ford promised to come. to the City Council when this i tern appears before them.
Commissioner Watson felt that the City Council should consider creation of an ad hoc committee to evaluate. long and short-term' planning with regard to these sites.
Commissioner L'Heureux stated that the City should en- courage private donations for. this purpose and play a bigger role in disseminating information-about these sites to the public. This will help bring in funds. He further said that these si tes are often destroyed through ignor- ance' and lack of education.

(8) Resolution of Intention No. 135 - Elm Avenue Street
Bud Plender explained that this was a request from the Chamber of Commerce. Staff did not approve of the names suggested by the Chamber, and had come up wi.th an alternati list.

A A Motion was made to return Resolution No. 135 to staff for further study, with a review of it again in one month.
(9) Resolution of Intention No. 136 - Conflicting Street. : Names ..
A Motion was made approving Resolution of Intention. No. 136 to hold a public hearing on changing certain street names.
(10) Appointment to Undergdround Uti 1 i ty Advisory Committee
Comnissioner L'Heureux was appointed.
(11 ) Report on South Coast Asphalt's Conditional Use Permit
Bud Plender gave the staff report, saying that the City has to consider whether the degree of impact of this Plant could warrant a reconsideration of the CUP. As only part of the Plant is in Carl sbad, City has no control over that portion in Oceanside. Oceanside is doing an environmental assessmen now on this project. The City would like to hold off making any decisions until that assessment is made.The City may then upgrade their requirements based on the assessment.
Vernon Myron, , 3737 Balboa Drive , Oceansi de, a member -of the Architectural Committee at Costa Serena, says they have a petition with 83 names from people in the area protesting the noise from this plant.
Frank Reed, 3724 Magellan Circle, Oceanside,said that he has been a resident in Costa Serena for 5 years, said that in 1976, the Plant started operating at night, and the people have been having trouble sleeping.
Robert S. Walwick, 322 N. Nevada, Oceanside said that curren contract commitments force them to operate. until 8:OO P.M.
Donald M. Hickethier, Vice President, South Coast Asphalt Products Co., P.O. Box 218,Carlsbad says that CALOCEA inspec them regularly and f i rids them operating correctly.
A Minute Motion was made that the Planning Commission retommend to the City Council .that they accept this report, or that :they ::request that Staff report back after the Environmental Assessment by Oceanside is complete,. or in 6 months.
