" APPRavAL OF RESOLUTIONS: Resolution No. 1329 - CUP-132, Hcpne Federal Savings and Lroan Association of San Diego Approved with a change in Condition B.3 to delete "fronting on El Camino Real" and a change in Condition B. 4 to add "top of" between "the" and "signt1. Assistant Planning Director Bud Plender stated that the school availability.letter for CT 74-4 was not incl.uded in packet, but was being given them at the rrreeting. PUBLIC HEARINGS (Continued) (1) Case7-B. Grosse - Request for approval of a revised tentative tract map to provide a 244-dwelling unit, 246-lot subdivision on approximately 83.3 acres. Associate Planner Mike Zander'gave the staff report, and announced the follming changes in the staff report of mch 9: On page 1, Finding 3 should be changed to read: "At this time, all necessary public facilities, including sewer service, are available to serve the subject project as proposed. However, sewer facilities may not be available when applications are made for building permits. If sewer facilities are not available at the time of build- ing permit application, building permits will not be issued until arrangements satisfactory to the City Council can be made to mantee that all necessary sewer facilities will be available prior to occupancy. PIACE: COUNCIL (3mmlms Page 2 A new Page 3 of the staff report was distributed. The carm7issioners *re requested to change the nunbring on pages 4 and 5 to correspond with the* new page 3. Mr. Zander ex- plained that the new Condition 10 puts a time limitpf-& to April 19, 1977, as the period required for obtaining the I slope rights frm the adjacent property owner to the south. This request for slope rights would allow a second access stub to this project, which muld be beneficial to the appli- cant and to present and future adjacent residents. Mr. Zander stated that Condition #11 had been deleted from th March 9 staff report. Also New Condition #16 (replacing Old Condition #17) will relieve traffic congestion on Chestnut ' .Avenue by 970 vehicular trips per day. On Condition 20 (c) , 1148 I II shuld be changed to ''44' . Also, on New Condition #23 (Old Condition #24), change "supercede" to "amend" and add ''to include the new conditions and the new map." In answer to questions, Bud Plender said that Old Condition, #23 was included to inform the applicant of the wishes of the Carlsbad Municipal Water District. City Ehgineer Tim Flanagan explained that sewer connections could be tied in with the Vista/Carlsbad trunk line which the Serena mrena p~nnp station ties in with. There is also a sewer line available in the myal Hones subdivision. There is. howver, a missing link which will be eliminated when the Carlsbad Meadows Develomnt is constructed. This project could then tie in with that line. In answer to Camissioner L'Heureux's question, Mr. Zander, ' referring to New Condition #lo, stated that very little .&tenance will be required of the City- since the new Open space Policy of the City alluws for the natural look, with the original vegetation left on slopes. Bud Plender. explained that Condition #4 does not give the public the right to use these lots. The Condition so states when this is the case, by using "public easemnt" or "for public access. I' In this case, "open space" simply means that the owner canr)ot build on that portion without the City's concurrence. Tim Flanagan stated that erosion control has been an autmti condition in obtaining City permits over the past 2 years. Cliff-Burford, Director of Planning,*.IDM , 5850 Avenida @cinas, Carlsbad, stated that they are savinq the mature t&s, and will house them in a d-bn strip along Elm Avenue. - J.-Federhart, Traffic Engineer, 5252 Balboa, Suite 709, San Diego, 92117, said that since the Elm Avenue Ektension muld pretty much & parallel to this project,. other access than mestnut AV~~W will $e' possible. He further stated that the street system is not adequately provided for in this plan. In reference to the EIR for CT 74-14, he believes that 100 g.p.d. sewage from this project is erroneous as the Public- Wrks Director has since stated that is is 120 'g.p.d. He questioned whether sewage service was available or adequate., based on the Public Works Director's statarmts to the City Council on March 8. A motion was made to approve CT 74-14(A) (Resolution No. 1333) based on the aed findings and conditions in the Wch 9 staff report. '.-(3) Case No. SNC-I, City of Carlsbad - Request to consider reOarrmenaing to the City Council that certain conflictin street names in the City of Carlsbad be changed. Bud Plender gave the staff report, explaining that SNC-I (1) , (3) '(41 and (5) had been approved at the February 23rd meet- . ing but SNC-I (2) had been continued to notify property own- wb might reside on Lagoon Lane, and to research possible alternatives to the originally suggested "Bracken." The staff is mw recamending a change to Batiquitos Lane, because the road goes to the Lagoon, even though it is not in the group of horticultural names the City Council Policy set up for this area. A motion was made to approve the recarmended change to Batiquitos Lane. (4)Case NO. CT 76-15-6, Ibuglass-Southwest Corporation - Request for approval of a revised tentative tract map and planned unit developrznt to allow 135 single-family detached dwellings on 43.99 acres. ?%Ihiissi&er Rmbotis stated that he wished to abstain from participation on this itan because of due to 'property mnership in the area. Bud Plender gave the staff reprt, stating that the applicant had substantially changed the tract map noticed previously, so it was renoticed to reflecttkchanges. These changes involve allowing no access onto Tamarack whereas the first may provided such aces. There is also a new park system, with 3 private parks, with much usable open space. There is, in the-new plan, a'recreational vehicle storage area. Mr. Plender read a finding change into the record. A finding should be added as follows: "At this time, all necessary public facilities, including sewer service, are available to serve the subject project as proposed. Tim Flanagan explained that the General Plan shms the de- qhasizing of Chesmut, with mre qhasis on more intensive use of Cannon; Tamarack and Elm.. John Douglass, 186 E. Cordova, San Clmte, Dedaper of the project, gave various lot and pad dimensions proposed for the project. Reed Langlois, 110 West "A", San Diego, 92101, Attorney representing Ronald Schwab, owner of property adjacent to the subject project, saidhis client wants certain conditions included as part of tl-e approval. He explained that the proposed Tamarack Avenue extension to SHJlhe Drive, which _, is necessary for the devklopmnt of this project, goes across one-third of Mr. Schwab ' s property They are concerned with impacts such road-building would cause to their property, particularly frOm the standpoint of ingress/egress rights, grading, drainage and the road itself. They wish these 4 problems resolved at this level of the approval process. Don Worley, Attorney-at-law, representing John Douglass, 600 B Street, San Diego, 92101, stated that this is a private matter to be settled out of public hearing. John Stevenson, 4930 Avila &&rue, Carlsbad, expressed con- cerns that proper fire vehicle access might not be a part of this proposal. He wants 3 factors narrm down as part of the approval: (1) Fire Marshall's re?*; (2) comnitment of a definite connection to Tamarack f r& Neblb; and (3) An explanation of why there is such a difference in width of proposed Tamarack Extension from one end of intersection to the otha. A motion was made to approve CT-76-15/PD6 (F&solutioi.ls Nos. 1335 and 1336) accordance with the findings and conditions in theMarch 9 staft report, with the, notation inserted, in the resolution that the attorneys representing the app1icant"and Mr. Schwab were present ahd expressed the desire tohegotiate reqarding the proposed. extention of Tamarack to Skyline. (New) (5) Case No. SP-115 (A) , Douglas-Southwest Corporation - Request for an an-mdmnt to Specific Plan No. 1x5 and de letion of the approved portions of CT 76-15. and PuDa. A &ion was made to approve SP-115 (A) (Resolution No. 1337) . . (6) Case No. SP-144 (C) , San Diego Gas & Electric - west . for approval of an amrdmnt to the Specific Plhn for the.Pawer Plant site to all& the construction of water trea-t facilities and a maintenance building. Mike Zander gave the staff report, stating that the EPA re- quires this construction to et all state and federal. public health requiwments. He also said that the Depart- ment of Public Health has requested that the last sentence under Condition 2 be deleted: "The enforcement and mainten- ance of this condition -shall be by the San Diego. Case No. CT 77-4, S C L mterprises - Approval of a 1-lot, 6-dwelling unit condaninium project. ccarmissioner Fikes stated that he would abstain frm participa- tion on this item. Mike Zander gave the staff report. He noted that the new 'City Public Facility statepnent sbuld be inserted in the resolution, Findings 5.a.2 and 6.b. He also pointed out that this project already has Coastal Conmission approval (Finding 5 .a. 3) . He also explained that th& project meets all the requirements of Title 20. If it were a 6-unit apartment house, it wuld.not be caning before the Planning ccarmission and the City Council, but since it is .a condminium developrent, it does before them, giving the City the advantage of collecting park and sch3ol fees. Farris .E. Wankier, 13985 Mira Monte Drive, Del Mar, CA 92014, applicant, stated that .this project meets all Coastal. corrmissic standards as to density, appearance, size and height. Mrs. Mravec, 155 Chestnut, Carlsbad spoke of the traffic con- gestion already experienced in the area. Mr. Zander, in answer to questions, explained that the City rm has a Public Facilities Ordinance which requkes certain irprovemtnts at the time of building permit issuance, so it is no longer necessary to include such conditions in the condi- tions of asroval. He also explained that the bikeway dedication will be a part of the building pennit issuance a& not a part of the tract map, since the City is sWtting an application to '80 for funding.
