Land Subdivision and Planned Unit Developwnt to provide
six single family detached homes on approximately 1.66
acres.
Bud Plender presented the staff report. The letters from the Ieucadia County Water District and the San Marcos Unified
S&ml District were not included in the packet but the . information from the letters was read by Bud Plender at the meting. The school availability letter stated that school
services for this unit will be available in the San Marcos
School District, particularly in view of the fact that plans
are for six single family residences, as permanent res-'
idences, with no children 17 years of age or u@er. The . . LRucadia County Water District letter stated &at based upon current conditions there was sewer service available to the property with certain conditions.
There were several dfications presented by Bud Plender in the findings of the staff report: bbdify finding No. 2 to read: The design or improvemnt of the proposed subdivision is consistent with the General Plan. a) The project will provide orderly residential developtmt; and
b) the project will not cause excessive expansioli of public facilities and/or expense to the taxpayer. Add the following: 9. The subject application has canplied with the requirerents of the Carlsbad Environmental Protection Ordin+c!e of 1972 becayse: a) A Negative Declaration has
been issued for the project based on the following findings: 1) The project is small in scale. 2) The project is in an urbanized area; and 3) the existing street systems will .
10. The proposed tentative tract. map is consistent' with applicable City Public Facilities Policies and Ordinances .because: a) At this tire, all necessary public facilities, including sewer service, are available to serve the subject project as proposed. Hmever, sewer facilities may not be available when -applications are made for building permits. If sewer facilities are not available at the tirru3 of building permit application, building permits will not be issued until arrangemnks satisfactory to the City Couricil can be made to guaranke that all necessary sewer facilities will be available prior to occupancy.

Bud Plender gave the staff report, and announced the follminc
changes in the staff report of March 23, 1977: Under Staff %ccmmendations, Section I, delete Items 2 and 3. Add It&
2 - The proposed change is premature because the existing
houses are generally good and there will be littl desire to
rmve than for multiple family use. Mr. Plender explained that the existing water line (6") is inadequate to provide
fire protection and domestic service to a multi-family use. In addition, Laguna Drive is inadequate to serve the traffic
generated by a change in densities.

James Scanlon, 2955 Elm Street, Carlsbad, CA. did not agree
with the findhgs of the staff report. He did not agree with
the location of the traffic counter nor with theresults OT that report. He stated the property is only three blocks
away from the Fire Department and that two hydrants. at either end of the block have water lines of 8" and 10" respectively. 'Mr. Scanlon said he was requesting this change to permit lag overdue progress in this area.
Jane Hunt, 1239 Knmles, Carlsbad, CA, stated that she felt the proposed change was good action and she was for it.

In opposition, Wger A. Rusch, 1210 Stratford Lane, Carlsbad
' CA., . stated that he and his neighbors feel that they have

Associate Planner Mike Zander gave the staff reprt. He reported that the present uses on the property include offices and an office complex in the center. The request is consister with the 'General plan.

Mike Zander presented the staff report. He stated that both
Items 5 and 6 have similar backgrounds. This-property was
.part of the'annexation several years ago. Our Zoning ordinance requires that where there is no zoning, the (Limited Control) zone be used. Bud Plender added that the
property is basically flat, but drops off steeply td the
east and the only access is fm El Canin0 Real. The Staff recarmends R-A-Q instead of R-A so that developmnt
'concerns such as access and noise could be reviewed.

as requested.

had been awned by the County Airport Division and that it

and the General Plan.

California remarked that the plans were for 48 units which

Henry Thampsm, 330 Chestnut Street, Carlsbad, Ca., said that while he was in favor of the project and felt it muld
enhance the neighborhood, he was concmed about drainage
problems involved with the grading for the new project.
He did not feel that the applicant should be penalized by ;
having to pay Park-in-lieu fees particularly since the 3 , .
beach was two blocks away. He felt his property would be in jeopardy when the parcel was graded. Mr. Thqson was
also concerned with the parking lot plan and access.
. Wzd Plender and Mike Zander explained that this application
was for approval of the tentative mp only and that design
of the mits was not pertinent to the Tract Map.

wanted to know that if the Planning Carmission could not have control over the problems of building development
that she and Henry Thqm .had brought before them, who
wuld be the agency or what muld be the procedure to folluw.
Bud Plerder said that there might not be a Public Hearing by the Coastal Carmission because this particular project W been approved prior to this application, but in case
there was, Bud suggested they contact the Coastal ccrranission. In addition, he told them that the tract mp would be forwarded to City Council for their approval. .
Fby Klema, Civil mgineer, 43i North Hale, Escondido,
stated that they have taken into account that they must
take the water drainage away fram the neighbxSr-property-
and that it must not be allowed to drain incorrectly. The
drainage will be done in a proper way. He stated they may have to grade along the cmmn boundary. Virginia Thqson asked that the Civil Engineer check the city drains; that there must be a new type or mre effective drain.
Fabert J. Truat, Marina Delky, California questioned the parking. The Vice Chairman explained that the parking is

of the conflicting names which caused a problem for the
Fire Deparbnent and the Police Department. The Cannissioners
brought up the question of time allwed after approval of the
.stmet name changes for the citizen involved to g6t the& persmal affairs taken care of. A Minubs mtion was made
to direct the Staff to enlarge on the notices to the citizens
involved in narrre changes to encourage the participation of the citizens in selecting a street name and that the street name changes state that tk name change will not be
effective until 90 days after approval of the change by .
City Council. Staff was further instructed to include a
packet giving the citizen effective steps to take in getting. '
the banks, post office, etc., notified of the change of tkhe street name as well as suggesting &t the newspaper be
used in listing this information.
A mtion was made to approve SNC-I11 in accordance with the staff report dated March 23, 1977 with the condition that
the change will not becane effective until 90 days after approval of the resolution by City Council.

and this is not in direct line with the rest of Chestnut.
This breaks the otherwise contiguous path of Chestnut which is contrary to the City's street naming policy. '

apartments at the northwest aomer of Chinq'uapin and Adams.
Mike Zander made the staff presentation regarding the
developwnt plan which canae back to Planning Cahrmission for
approval. Staff has reviewed all of the conditions of the
Specific Plan and feels the applicant has met or exceeded . all of thm.
A Minute Mtion was made stating th& the Planning Cannissioner
had revim and approved the developnent plan dated Wch 23,
1977, as being a criteria required in Section K, Ordinance
9243.
(13) Research design and proposed methodology for testing of Tract 76-2 (Site SM W137) as per staff recamnendatio
with changes to pexmit developer to sLJxnit a letter
indicating field .work is acceptable, City may then
approve grading permits.
BU~ plender presented the staff report. ~~hn my, .applicant, stated that as soon as the archaeologist diggings were
ccanpleted; there was no .need for the applicant to wait an additional. period for the final report to the City before
starting to do the grading on Tract 76-2.

methodology report for testing of Tract 76-2 dated March 17,
1977, and.& staff report dated March 23, 1977, be accepted,
and upan the completion of the archaeological dig that a statmt certifying that no further archaeological
investigation need be dcne, grading can be ccum-~enced prior to the receipt by the City of Carlsbad of the final
archaeological 'report.
