CALL TO ORDER - .The meeting was called to order at 7:05 P.M.
ROLL CALL - All Commissioners were present. I
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES - The Minutes of August 10, 1977 were
approved as read.
WRITTEN COMMUNICATIONS
Memorandum dated 8/24/77 from Redevelopment Coordinator
Jack Henthorn to Planning Commission. Subject:. Request For
Findings of General Plan Conformity Acquisition.
Mr. Jack Henthorn, Redevelopment Coordinator, said this
request for findings of General Plan Consistency was the
result of the City desiring to purchase property on the
northwest corner of State and Grand. He said the zone
designation on the property is C-2 and the General Plan
designation is CBD. The property is locgted within a
special: treatment area called out in the General Plan.
The ultimate use of.the property has not as' yet been
determined.
A motion was made to approve Resolution No. 1395, PCD-4
maklng a finding that the City's purchase of the property ik consistent with the General Plan because the City
can use the property to promote central business use in'this
special treatment area.

(1) Case No. GPA-49, County of San Diego, - Request for a General Plan Amendment to change the Land Use
designation from OS' (Open Space) to G (Governmental)
to enable construction of a Solid Waste Shredder and
Transfer Station.
Mr. Bud Plender, Assistant Planning Director, gave the
staff report. The reason this case had been continued was
to allow time for the Board of Supervisors to approve the
environmental impact program. The Commissioners expressed.
concern about rezoning this area to G as it would pertain
to future governmental uses, and they expressed
dissatisfactions with the mitigating measures of the
environmental impact report. The County became the lead
agency for this project because €key are the applicant
and the deveioper.
Mr. Joseph Remly, County of San Diego, applicant, said he
would .be happy to answer any questions. There were no ' .
questions for Mr.: Remly.
The public hearing closed at 7:35 P.M. '
The Commissioners felt that rezoning thi.s property to ''G"
would force all future governmental uses to this location.
The general opinion was that the analysis was not complete.
Since this property is the geographic center of Carlsbad,
they did not feel they would neceksarily like to see an
operation of this type placed there.

Mr. Joseph Remly stated in the rebuttal that the County was
interested in using this property for this one use. In his
opinion the County had submitted a good analysis in the EIR
He stated that they have application-and believe they will
get the three and one-half million dollars to build this
installation but the timing will be all important in taking
advantage of it. The public hearing closed at 7:45 P.M.
A motion was made to approve GPA-49 changing the designatio.
from OS to G based on the findings as outlined in the staff
report.
The motion did not carry.
Commissioner L'Heureux stated that because of the timing of
the grant he would be willing to change his vote.
The Planning Commission noted that the legal map needs to bl
changed for clarification by removing the site marking
of the proposed solid waste transfer station.
A motion was made to approve GPA-49 approvi.ng the
designation from OS 'to G based on the findings in the
staff report.
(2) Case No. CUP-138, H. W. Butts - Request'.for a
Conditional Use Permit to operate a residential care
facility for six persons at .property located at the
southeast corner of Kelly Drive and El Cimino Real.
Mr. Mike Zander, Associate Planner,.made the staff
presentation.
Condition No. 3, Page 2 does not reflect the decision of
the Commission regarding lcUP enforcement. It was decided
that it should read that the condtional use permit shall be
reviewed 45 days after approval and reviewed every six
months.thereafter for three years. At the end of' the three
year period-the Planning Commission will determine
future review periods.
Commissioner L'Heureux reported that the metal shed'had not
been moved as Mr. Butts had agreed to do at the last
Planning Commission meetfng. The Co.mmissi.oners agreed that
both meta1,sheds should be moved to the east side of the
house.
Staff was requested to get the reports on this facility
from the County approving agency for the next period.
A motion was made to approve CUP-138 to operate
a residential care facility for six persons at property
located at the southeast comer of Kelly Drive and El
Camino Real based on the findings and subject to the
conditions listed in the staff report with the following
additions and corrections: Condition 4 shall be added
as shown on staff report supplement dated June 22, 1977
with the correction that it read that the two metal sheds
shall be moved to the east side of the house. Add Condition;
5 and 6 as'shown on the memorandum dated August 10, 1977
and change Condition No. 3 listed on the staff report dated
June 8, 1977 to read that the coqditional use permit shall

be reviewed 45 days after approval and refiewed every six
months for three years thereafter. The Planning Commission
will determine fu.ure review periods at the end of the

(3) Case No. CUP-139, John R. Mock - Request for a
Conditional Use Permit to construct the St. Elizabeth
Seton Parish Community consisting of an education
center, church, social center, rectory with support
buildings and structures on property generally located
on the north side of Alfanje Street between Alga Road
and El Fuerte.
Mr. Mike Zander gave the staff presentation. He said that
the standard sewer condition had been omitted and should
' be added to the staff report.
The Commissioners noted that there was no condition whereby
the applicant would waive access road to Alga Road and they
would like a condition to that effect. They stated there
were no water conservation measures incladed, which they
would like to see.
Three freestanding signs are permitted because the ordinance
states one sign on each street. The size of the signs
to be in order.

(4) Case No. GPA-48, William F. Burnett - Request for a
General Plan Amendment to change the Land Use
Designation from TS (Travel Services Commkrcial) and
0 (Professional’ and Reiated Commercial) to C .
(Community Commercial) .
Mr. Mike Zander gave the staff report.
The Commissioners questioned staff as to the actual size of
the parcel which is approximately 12 acres in size. The . San Diego Gas and Electric would have to approve parking
under the transmission easement although the problem is thai
the area under the transmission easement has poor soil
conditions as well as steepness of grade which makes it
doubtful they would be able to cut back into it very much.
William Burnett, Pacific Mutual Building, 523 West Sixth
Street, Los Angeles, California 90014, applicant, stated thl
he would like to explain that his applic9tion was for a
neighborhood commercial me. He had to request Community
’ Commercial because of the zone ordinance. He felt it was
proper because of th-e size of the parcel itself, the
location of it with two major streets, the fact that it did
meet criteria of serving at least 5,000 families, but
most importantly, under a neighborhood commercial use,
0; site sale of liquor would be precluded. One of the
uses he had planned was a restaurant that would sell
alcoholic beverages. Mr. Burnett addressed his remarks
to the three findings of denial in the staff report.
Mr. Burnett read a lktter addressed the Planning
Commission with reference to the proposed neighborhood
shopping center from Mr. James Stewart, Vice President,’
Von’s Supermarkets. A copy is in the Planning Department
files. The letter was in favor of the shopping center at
that location.
Mr. Nick Banche, 3464 Ridgecrest, Carlsbad, representing
the owner of the property, urged approval of the General
Plan Amendment.
Mrs. Mary Grant, 4056 Skyline, Carlsbad, .California,
stated the TS zone was in her opinion no good. She .felt
the zoning was too limiting in nature. She was in f.avor
of the application.
Mr. Fred Morey, La Costa Land Company, stated that he was
object to the proposal.

A motion was made to approve ZC-196 to place a Q overlay . on the C-2 zoning on the property based on the findings
that the site'plan would be a method to mitigate possible
impacts and give the Planning Commission the ability to
review the site development.

(6) Case No. V-270, Bern'ie' Gilmore Request for a Varianct
to Section 21.34.110 of the Zone Code, to allow the us(
of a wood fence with landscaping in lieu of 9 solid
concrete or masonry wall to sc,reen outdoor storage.
A motion was made to continue V-270 to September 14, 1977

(7) Case No. CUP-141, Robert Colburn - Request for a
Condifional Use Permit to allow a retail nursery
to be located in a C-2 zone.
Mr. Mike Zander gave the staff report.
Mr. Robert Colburn, 5025 W. Point Lomas, San Diego, CA.,
applicant, explained that the 32-15 parking spaces ailows
for their needs except on some hours on the weekends when
60 spaces would not accommodate the traffic. Based on the
average.use, the parking provided is sufficient.
Public Hearing was closed at 11:.30 P.M.
A motion was made to approve-CUP-141 to allow a retail
nursery to be located in a C-2 zone based on the findings
and subject to the conditions as outlined in the staff
report. Resolution No. 1401.

'Mr. Mike Zander gave the staff report.
A motion was made to approve ROI-153 to conduct a public
hearing on ZC-186 (A).

(9) Case No. ZCA-84, PUD Amendment Report.
A motion was made to continue ZCA-84 to the next regularly
scheduled meeting on 9/14/77 due to the lateness of the'
hour of the meeting.
The meeting was adjourned to September 7,' 1977 for the
purpose of conducting a Redevelopment Workshop at 11:50 P.M.
