CALL TO ORDER - The meeting was called to order at 7:OO P.M.
ROLL CALL - Commissioner Watson was absent.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES
A motion was made to approve the Minutes with the change
on Page 4 showing that Commissioner Woodward was the maker
of the motion for ZC-197. On Page 5 show that Commissioner
Fikes voted "No1' on the CUP-140 motion and Commissioner
Jose was absent.
RESOLUTIONS
(1) Resolution No. 1403, V-272, Gendusa
A motion was made to approve Resolution No. 1403.
Resolution No. 1405, County of San Diego, CUP-140
A motion was made to approve Resolution' No. 1405 with
the following correction in the report to city Council
dated September 30, 1977: Condition No. 3 - Con-
struction of the shredder building shall utilize
materials and design which will insure that noise
levels produced by the project and related activitie,s
to not exceed 60 dB(A) within the public area of the
site or anywhere off the 21 acre site.
WRITTEN COMMUNICATIONS - None
ORAL COMMUNICATIONS -I Commissioner Jose reported that he hac
gone by the Butts' home and care facility and noted that the
yard appeared to have unnecessary trash in the front and in
the side yard. Staff explained that the CUP will be
reviewed when item comes before the Planning Commission as
stipulated in. the CUP resolution.
PUBLIC HEARINGS
(Continued)
.(1) Case No. V-270, Bernie Gilmore -'Request for a Variance
to Section 21.34.110 of the Zone Code to allow the use
of a wood fence with landscaping in lieu of a solid con-
crete or masonry wall to screen outdoor storage.
Mr. Bud Plender, Assistant Planning'birector, stated that
staff had given a full presentation on this case at the
last Planning Commission meeting. He said that the applicant
understood the staff report and does not require another

Mr. Bernie Gilmore, Project Manager of the Palomar Airport
Business Park said 'that he agreed with the findings of the
staff. He felt the fence was erected as a mistake as they
believed they had approval for the fence based on the
original drawings that were submitted and approved:
They would like to have a variance on the back section and
the two sides with the good adobe brick on the front colored
the same as the building. On the dack area they would
work with the Parks and Recreation people to get the right
landscaping. He indicated they are planning to put a
building on the side so that those coming from the south
on El Camino Real would-not see any storage area.

The commissioners were generally concerned-with the
aesthetic sense.of the fencing as it relates to the
intended use of the industrial park under the existing
zoning. They feltithat the durability of the masonry wall
vs. the wooden wall had merit.
The public hearing was closed at 7:35 P.M.
The commissioner.s expressed the opinion that they would
have difficulty making the required findings to permit
the variance. The economic impact'of the masonry fence
to the applicant concerned the commissioners. The opinion
of the commissioners was that the concept was to'have a
plush area in the Palomar Park and to allow the variance
would be destroying it.
A motion was made to deny Variance V-270 based on the I
findings as outlined in the staff'report.
Resolution NO. 1406.
NEW (2) Case No. ZC-186 (A), Ross Winton, et a1 - Request for
approval of a zone 'change from R-1-15,000 to R-1-10,000
on property adjacent to and on the east and west sides
of Highland Drive between Chinquapin Avenue and Adams
Street. The City of Carlsbad has initiated a change
of zone for additional properties in the area.
Mr. Bud Plender presented the staff presentation. As the'
area is now zoned there could be 13 lot splits. With the
change to R-1-10,000 there could be a possible 24 lot splits.
Of the net difference of 11 lots between the two.zonings,
only a possible six o< seven lots could be adequately split
because of the topography.
Mr. Tom Wood, Attorney, Carlsbad,-CA., represente'd Mr..
Ross Winton. He agreed with.the staff report and felt the
impact on the area wou1.d be minimal.
R;:petittion'-was presented by Mr. John P. McGill, 4340 Highland
Avenue with a list of 63 residents in the area who were not
in favor of this request.
In addition to Mr. McGill, the following people spoke against
ZC-l86(A) on the basis that they did not wish the area
'increased in density. by changing the zoning because of the
increased traffic and taxes. They had purchased the property
because the lots were more spacious and they wishedrko cetain

Mr. George Watson, 4424 Highland, spoke in 3avor of the
request. He said the taxes would not increase unless the
property owner split the lot. He felt the impact on the
area would be slight since the net number of lots would be
increased by possibly no more than eight.
The rebuttal from Mr. Wood reiterated the position that the
impact on the area would be minimal.
The rebuttal from Mr. McGill was based on the finding that
the majority of the property owners'did not want a zone change
and had so indicated with the petition presented to the Planni
Commission.
The Public Hearing was closed at 8:55 P.M.
Commissioners Jose and Rombotis both expressed the require-
ment for more information giving the definite lots which
could be split. The information given in the staff report
was based on theoretical lot splits and the impact could not
be correctly assessed without this information.
Staff indicated it would'still be an estimate:
A motion was made for a continuance of ZC-186 (A) with a
request for staff to 'come back with 'input as to how many
lots could actually be split so that the Commissioners could
make a more accurate assessment of the impact which would
be caused by the zone change. The Commissioners would also
like Mr. Winton to come up with another group of lots
which might be feasible for zone change.
The motion did not carky.
Chairman Larson said he was against having a zone change .
when the majority of the people did not want it. .
A motion was made to deny ZC-186 (A) based on the following
findings of the Planning Commission:
1) The present zone is consistent with the General Plan. '
2) The City needs a variety of residential lot sizes and the
present R-1-15,000 zone represents this-variety.
3Y The R-1-10,000 would not be compatible with the existing . lots in the area, .
4) The majority of the people in the area do not wish a zone
change and have submitted a petition stating the'ir . request for denial of this zone change. ,-
5) The impact of increased lots in the area would be

detrimental to the neighborhood by increasing traffic.
(3) Case No. CT 77-13, Harry Fries - Request fbr approval of
. "tract to provide for 15 condominium units on property
generally located on the north side of Juniper between
Garfield and AT&SF Railroad.
The staff presentation was given by Mr. Bud Plender.
Mr. Bob Ladwig, Rick Engineering, represented the applicant.
He stated they were willing to add mre parking spaces if that
is necessary.

Mr. Harry Fries, applicant; tn'answer to the Commissioners
questions said the units ranged in size from 500 to 1,000
square feet - one, two bedroom and studio units.
The public hearing was closed at 9:40 P.M.

Commissioner RoIxlbitis said he had a diffic.ult time letting ..
thfs into a PULI which .is' .the kriteria used as a guideline
in condominium conversions. The commissioners generally
were concerned with the lack of parking spaces and parking
for recreational vehicles. Commissioner Fikes felt it would
be better used as a condominium with pride of ownership than
as an apartment facility.
Mr. James Hagaman, Planning Director, said that to apply
standards you have to use examples and he reminded the
commissioners that the PUD is only an example, and should
be used as guidelines rather than'as the absolute rule.
Apartments are designed for people on the move while a
condominium is designed as a permanent place of residence.
A motion.was made to approve CT 77-13 based on the findings
and subject to the recommendations of the conaitions in the
staff .report.
The motion did not carry.
A motion was made to deny CT 77-13 based on the findings of th
Planning Commission that there exists a lack of parking, '
lack of R-V storage space, and insufficient recreational
facilities on the site.
Resolution No. 1408.

(4) Case No. ZCA-85, City of. Carlsbad - Private Senior. -
Citizen Housing.
Mr. Bud Plender gave the staff presentation. He stated there
were three alternatives for the commissioners to consider.
They range from a very open ordinance approval of senior
citizen housing to close City involvement.Staff recommends '
that the requirement of the conditional use permit to
establish some standards for development but not requiring
full City participation was the alternativi.they felt would
be the middle of 'the road choice.
.Mr. Bob Ladwig, Rick Engineering represented Mr. Bill Rick
who had not been able to attend. Mr. Ladwig said Mr. Rick
asked that Alternative No. 2 be approved.
Mr. Raymond Reed, President of Senior Citizens Housing
Association, stated.that while he could not document the numbe
of inquiries they get.for senior citizen housing, he estimate
he gets .approximately 30 monthly from Carlsbad residents.
He stated that the age of 60 is the area they .are planning
on. At this age the car numbers would be less'according to
senior citizens is needed.

Mr. Plender indicated there may be a problem with density
as contained in Condition No. 7. Hg will check this with
the R-P zone as it relates to the General Plan density.

A motion was made to approve Alternative Nd: 2 of ZCA-85
for the reasons as given in the staff report with the
following corrections and with the recommendation that the
resolution be returned to the Planning Commission on October
26, 1977 before going .to City Council.
Corrections:
(i) The minimum. age and minimum income requirements of the
occupants may be determined by the . . . . . . .
fiii) Last sentence should read:"Each such general public
tenant shall be reviewed by the Director of the Housing
Authority to assure compliance with all limitations on
tenants as may be imposed by the conditional use permit.
Include a no parking charge.
Set forth a clause where revocation will occur if the
conditional use permit is not adhered to.
State that a conversion of the facility will.require
a return to the Planning Commission.
Add the condition that exhibits to the Commission will
include landscaping plans, methods of maintenance, elevations
plot plans, building details and show complete configurations
(x) Insert that the conditional use permit shall be recorded
so that it runs with the land.

(5) Case No. ZCA-86, 'City of Carlsbad - Residential. Estate
Zone.
Mr. Bud Plender recommended this be continued to October 26,
1977.
NEW BUSINESS
(6) Case No. ZCA-84, PUD Amendment Report, City of Carlsbad
.Mr. Bud Plender said he would answer any questions by the
Commissioners.
Commission Rombotis stated that the last line "shall not be
located in required front or side yards" on the first page
should be deleted and add '!the- loca%ion approved by the
Planning Commission." . . I : :
A motion was made to approve ZCA-84 with the correction to
the last sentence of the first page: ."shall not be located
in required front or side yards" to be del'eted,, and add
*, - -4 "the. , location approved by the Planning Commission.
(7) Coordinated Program of Proposed. Public Works _- Finding
of General Plan Conformity.
Mr. Bud Plender gave the staff report.

A motion was made to approve the CoordinatSn Program of
Proposed Public Works - Findings of General Plan Report
with the exception - of Items 21 and 17.
A motion was made to approve Items 21 and 17 of the
Coordinated Program of Proposed Public Works report.
Resolution No. 1411
(8) Temporary Suspension *=School Agreements - :Sari Dieguito
Union High School District.
Mr. Bud Plender stated the moratorium on school letters from
San Dieguito Union High School District does not present
an immediate problem. However, if they continue this policy
it may have major consequences to development in La Costa.
Hopefully they will come up with a new policy by November lst,
and‘the school letters will be resumed. .
The Commissioners were concerned that the developers will
invest large funds when the public facilities finding cannot
be made in the absence of a school letter.
A Minute Motion was made that .the following announcement be .
available for all applicants concerning San Dieguito Union
High School District: The public facilities findings require
I that we make a finding that school facilities are available ar
that historically that has been through a school letter
obtained after the applicant and school have made some type
of arrangement. We have been informed there is a moratorium
on all available agreements in the San Dieguito District and
may result in our finding tha-t all public facilities .are not
available.
(9) Planning Commission Determination - General Plan Consistencv. Children’s Librarv
Mr. Bud Plender gave the staff report.
A motion was made that the purchase of the-subject property
is consistent with the General Plan be.cause of the proximity
.to the existing library and transportation system of
nearness to major streets and bus stops.
(10) Archaeology Requirements for Royal Homes Unit #6 CT 76-2 ,- Mr. Bud Plender presented the st,aff report.
A motion was made finding that the archaeological
investigation of Site W-137 meets the ,requirement of
Condition 17 of Resolution 3902 approving CT 76-2.
