ROLL CALL - Commissioner L'Heureux was:exciised from 7:30 - .r 8: 00 P.M. to attend Library .meeting. PLEDGE OF ALLEGIANCE WRITTEN COINIJNICATIONS - None ORAL COMMUNICATIONS - None . PUBLIC HEARINGS (New) (1) Case No. CUP-146, Otto J. Korver.- Request for approval to construct a church building with Sunday School classrooms in a R- 1 (7 , 500) zone. Mr. Bud Plender, Assis'tant Planning Director, -said there was insufficient data received at the time of application and staff could notemake a recommendation on this case at this time. He asked that it be continued until the December ' 14, 1977 Planning Commission Meeting and explained that the application will be renoticed in the newspaper and to the citizens living within 300 ft. radius of the site. A motion was made to continue CUP-146 to December 14, 1977 fbr the reasons outlined by staff. (2) .Case No. ZCA-91 - City of Carlsbad - Request .for approval of new commercial zone (C-E). ' .$ Mr. Bud Plender asked that this be heard at the end of the agenda in order to accommodate Mr. Ron Roberts whose wife was in the hospital. The Commissioners agreed. Mr. Bud Plender gave the staff presentation. He asked that -tEe Hearing be conducted informally and invite coments and suggestions from the citizens in the audience along with'the questions ahd suggestions from the Codssioners. Messrs. Priestly, came forwarno dzone code amendment with the Commissioners and . staff. _. .x -c" . 21.27.010 Intent and Purpose. All agreed to the wording in 2 this section. 21.27.020 Application. Mr. Robert Knauf said the statement. in the second paTagraph stating the'motor vehicle dealershi1 is about two acres is not sufficient. The smallest size dealership is a minimum of three acres md that has . not proven satisfactory. Mr. Allen felt that five - seven acres would be necessary if the dealership is handling. recreational vehicle sales. 4 .. . . 21.27.030 and 21.27.040 Permitted Uses and Accessory Uses. Commissioner Rombotis was concerned with auctions in Permitted Uses. He felt this would permit flea type auctions operating out of 1,000 sq. ft. buildings. It was decided to hold off on discussing auctions until Site Development- Plans Requirements-21,27.060 was discussed 21.27.050 Uses Permitted By Conditional Use Permit. It alcoholic beverages" should be changed to read "Restaurants with on-sale alcoholic beverages." .was the general opinion of the Commissioners that "on sale 21.27.060 Site Development Plan. Requirements. The Commissioners felt there should be elevations included with the Site Development Plan. It was agreed that the following should be added: The site plan is to contain elevations of plans for information only. Commissioner Rombotis brought'up the problem that this zone would allow large open sales areas and a site development plan is not required unle the building is greater than 1,000. sq. ft. Mr. elender suggest.ed the following addition: "In the C-E zone an approved site development plan is required for the developme of any lot with buildings, structures or outdoor sales or . storage areas greater than ljOOO sq. ft." The Commissioners abeed to this change. 21.27.070 Open Sales or Storage Areas. The Comissioners requested the words 'paving methods" be changed to "surfacing methods." It was agreed that the statement "alternative surfacing methods. can be approved by the City Engineer" would be included. Mr. Knauf did not want the wording 'in this section to be so restrictive that it would take away from staff those discretionary actions which would be .. appropriate. 21.27.080 Lot Area. ,. All agreed to the wording of this secti :$' 21.27.090 Lot Coverage. The citizens and Commissioners felt that 253 in landscaping was too high. Mr. Knauf explainedthat the City is 3% and Car Couritry requires.l5%. Mr. Knauf felt there would be great econhic resistance to 25% coverage'of landscaping in addition to the drought . situation. He felt the ordinance should have a stated objective giving a certain percentage but it should also include a tuning device to tailor the requirements of the individual parcels as far as topography, etc. He said some . lots offer difficulties in placing--%he buildings due to the . irregularities of the size of the lots and the sloping. -2 Commissioner Rombotis said the 'Coastal Commission has a .E% requirement in C-2 zone with.major emphasis on the front where it is,viewed by thepublic.' He felt that the puk view area should have major emphasis on landscaping. Commissioner Watson felt there should be a mihimum of 5% with efforts to strive towards a 10% program.and that language should be included to cover topography and screening requirements. Commissioner Fikes requested that the relation between landscaping and water copervation be considered. It was agreed by the majority that staff I should work on i5% with emphasis on public view and deviatic or reductions can be approved by Ohe Planning Director. The Commissioners requested that 1)a) be changed to read "Front yard: 50% of the front ten feet." . The sentence "However, the total area of required landscaping shall not be yeduced'" should be deleted, Commissioner Fikes requested that there be a reauirement that the landscaping and irrigation plans should be 'reviewed by the Water District in relation to- the drought. It was the opinion of all that drought resistant landscaping should also be a requirement. 21.27.120 Front Yard. Mr. Knauf stressed that flexibility was very necessary due to unique problems on individual parcels. The Commissioners felt there should be- something which determines the use of the front yard. Mr. Plender said this wuld be discussed in Section.150 Placement of Builc 21.27.130 Side Yards. Commissioner Rombotis was concerned with this section as it relates to fence height which is not included in the report. The difficulty of going over si, feet in fence height is that it is then defined as a structure according to Mr:Plender. An alternative would be to eliminate this section. Another suggestion would be ' to state. under .150 Placement of Buildings that no buildinl or structure shall occupy the required yard except for fence? Then include in Section .170Fences and Walls that fences over six feet are permitted. The majority agreed that eliminated side yards would be appropriate. Commissioner Fikes was concerned with the zero lot line as it relates to security of the buildings. He feels it might be a potential security risk with the increase of burglaries in the North County area. I ' '%Zl. 27.190 Rear Yards ., All agreed to the wording of this Sect ion. 21.27.150 Placement of Building. Reference l).Mr. Plender said that free standing signs and walls to enclose storage areas may be permitted in. a required yard. Signs would be in the front or side streets and walls in the rear' yards. ' No. 2) should be changed to read "Parking -and vehicle I$$' display may be in the front yard." No; 3) should have added "Placement of buildings and uses on site." Add No. 4) Mr. Knauf stated that landscaping and/or fencing arq;und the . parking.areas forcar storage was helpful from a security standpoint as they have had cars stolen frm lots in Car Country. 21.27.160 Parking., A general discussion was held regarding . Chief of Police to review building €or seourity purposes. .- . . .. . . the parking ordinance. It was the general consesus. .r; that the code should be updated; The Commissioners ,stated that the burden of proof should be on the applicant as to how.much parking i's required f0r.a new dealership. Tht par-g adequate, but the minimum will be what is present required in the Code. : section is to require the applicant to prove the proposed ' 21.27.170 Fence and Wall. Commissioner Watson said-that chain link fencing is excellent as it rel'ates to security; Mr. Knauf said that in areas in the back .wher& it cannot be seen Car Comtrjr has allowed chain link for security reasons and because of the reduced,cost. Mr. Knauf also suggested flexibility. The Planning Commission felt outdoor storage needs to be screened by SolidLwall that could exceed six feet. Commissioner Fikes requested consideration on the disposal of chemicalS,in the refuse containers. 21.27 .'190 Mechanical Equipment. The first sentence is corrected to read "All roof and mechanical equipment used to service the building shall be substantially screened from public view to the satisfaction of the Planning Direct0 Commissioner L'Heureux questioned the meaning of the word "subst8ntial." . . ._, .A motion was made to continue ZCA-91 to December 14, 1977 Planning Commission Meeting with instructions.to staff to bring it back to the Planning Conmission in ordinance form. The Public Hearing will remain open for further review. (3) Amendment to SDP 77-2, Ron Roberts Mr. Bud Plender gave an oral staff presentation as there was not enough time to get this to the Planning Commission with . the amendment changes and still allow the applicant time to apply for the sewer allocation. Mr. Plender stat,ed the approved plans aslowed a restaurant with 10,511 square feet and a double row of parking to the north. The change is that one row of parking is eliminated to the north and . aaed to the east and the size of the building is changed to 9,283 sq. ft. with an alteration in the design of the building to a more elongated building rather than a square building. The original approved plans called for 32 parking spaces in the area being changed. The new plans have an ..% total of 25 parking spaces. However, because the building has been reduced in size, the actual amount of parking required has been reduced so that there will be a. higher ratio of parking per floor area. The only condition staff would suggest is that the modifications be incorporated into the final Site .Developmen Plan on file in the Planning Department. Comnissioner Rombo said there was a potential conflict over signal lights and h answer to a "question about the two driveways on El Camino Real that one of them might be closed if'the traffic was a .ty would abstain. Mr. Tim Flanagan, City Engineer, satd in . hazard- kn the future. .. c The Commissioners questioned the grading changes which the applicant Mr. Ron Roberts, SGPA Architects, 440 Yucca Street, San Diego, representing Hughes 1nvestment.said had been'cbnged from the original pl~. The grading is 2% ' with .the new plans. There will bcno impediments from talking to one area to the other and no ramps will. be .A required. Mr. Roberts explained that the first phase . from the zoning line to the north,-would begin construction within the next few weeks. The Comqissioners discussed ' . the adequacy of the parking and.the general opinion was that it would be compatible with other uses in the near areas. There is.no exclusive parking on this site. A motion was made to approve amendments to SDP 77-2 as . . presented orally from staff with the added copdition ! that the motifications be incorporated in the Site Development Plans on file in the Planning Department.
