PLEDGE OF ALLEGIANCE
A motion was made tQ approve the minutes of March 8, 1978,
with the exception of an amendment on page 1, item 1 to
reflect that instead of having Mr. Vitello as the applicant.,
to indicate him as the owner of the Nu-Way Laundry.
APPROVAL OF RESOLUTIONS
(1) Resolution No. 1436, CUP-147, Prest Best Corporation
A motion was made for a second reading of Planning
Commission Resolution No. 1436 to be continued to the
meeting of April 12, 1978,.with the additional of
a cdndition no. 8 for Planning Commission timing to
indicate that "CUP be reviewed by the Planning
Commission within.6'months after the date of occupancy
of the requested use to determine if the subject use
is adversely affecting the health and safety of the
area. If a determination is made that the use does
have an adverse affect, the Planning Commission shall
order the opening of a public hearing to determine if
the concerns are valid, or mitigating .conditions should
be added or the application be denied."
(2) Resolution No. 1438, V-276, J. Scott Carter
A motion was made to APPROVE Resolution No. 1438 with
the following corrections: Page 1, item l(a) to read:
"The development of Ocean Street which permits this
type of development originally was very
intense, and recently similar variances have been
granted to continue this type of intense development."
Page 2, Item No. 2(a) to read: "Other properties
along Ocean Street enjoy 5' sideyard setbacks."
Page 2, Item 2(b) to read: "It has been determined for
property along Ocean Street a 5' sideyard' will provide
adequate access for safety services. Page 2, Item
4(a) should be reworded to reflect what the Commission
meant about the parking area and the entrance into the
project without the variance. Page 2, condition no. 3
to be deleted.
(3) Resolution No. 1439, CUP-148, Circus Vargas
A Motion was made to APPROVE Resolution No. 1439.

Commissioner L'Heureux, scheduled a party for Commissioner
Watson, Commissioner Fike's and his replacement at his
house for Sunday, June 11, 1978. Commissioner Jose suggest€
-that we start working on Commissioner Fike'S'plaque.
Bud Plender. Assistant Plannina Director, announced the
resignation of SF O'Donnell. Chairman Rombotis, indicated
that we would present her with a Resolution of
Appreciation for all of her fine services to the Planning
Department and the Planning Commission.
NEW PUBLIC HEARINGS
(1) Case No. ZC-198, "Q" Overlay, City of Carlsbad -
Request for "Qll Overlay on property located on the
east side of El Camino Real, north a5 Palomar
Airport Road.
Mr. Don Rose, Associate Planner, gave the staff presen-
tation and indicated that the property boundaries, zone
boundaries and general boundaries didn't coincide.
Bud Plender, Assistant Planning Director, stated that it
was recommended at this time to place the "Q" Overlay Zone
on the presently zoned "M" property and that if the
Commission wished to change the boundaries that this
should be a separate action at a later date.
Bud Plender; Assistant Planning Director, in response to
Commissioner Fike's question, in regards to what the "Q"
Overlay Zone gives staff. He stated that it gives staff
the ability to plan for a greater area than just one
site, it gives staff the ability to plan for more concerns'
than just the developers immediate desires. He indicated
that in this particular piece of ground that there was
reason to have further planning discretion. He also
indicated to the.Commission that there would be no
architectural control such as deciding on material textures
and colors.
Dennis Alleco, Beckman Instruments, Fullerton, California,
Indicated that Beckman Instruments owns a plant in the
zone and was very interested in the surrounding develop-
ments. ,.
I A motion was made to approve ZC-198 based on the findings
as outlined in the staff report. z

A minute motion was made to have staff review the site for
General Plan cansistency zoning and report back to the
Planning Commission in the near future.

(2) Street Vacation, Portion of Jefferson Street
Tim Flanagan, City Engineer, gave the staff presen-
tation. He indicated that this action was consistent
with a 1971 agreement between the City and the property
owner of the adjacent parcel to the east and that the
realignment of Jefferson Street in this area was
completed some years back. This realignment was part
of a larger project, the Plaza Camino Real Expansion,
and was addressed in the EIR for that project. He
stated that the improvement on the portion of Jefferson
to be located have already been removed. However, the
right-of-way is still being used for utilities and
further future use for utilities is expected and
easements over this right-of-way will be retained. He
indicated that the-easements may include the entire
right-of-way, but that this has not yet been resolved.
He indicated that the site was within the coastal
permit area. He indicated that there has been
significant citizen concern over the use of this site
and other properties in the immediate vicinity because
of its relationship to the lagoon and its inhabitants.
He stated that the primary role of the Planning Com-
mission in this case was to make a finding that the
proposed street vacation is consistent or not consisten
with the General Plan. He stated that the Planning
Commission would have to decide whether or not the
subject street vacation is consistent with the entire
General Plan, Land Use as well as circulation, and in
doing so the Planning Commission should examine the
results of vacating the subject right-of-way.
Henry Thompson, 330 Chestnut Avenue, Carlsbad
Henry Thompson indicated that he was puzzled about the - two statements regarding the entire environmental revie
and how they interacted with each other. He also
stated that we would be creating-a traffic monster
because the road is narrow as you come down Jefferson.
Also, that we would be getting a considerable amount
of traffic because of the usage by the public at the
duck landing. He indicated that it has been degraded
abused by the development there and also a traffic
hazard. It is very poorly situated, further the
whole area there has been degraded, neglected by the
City in my opinion.

A motion was made to DENY the street vacation because it
was not consistent with the General Plan Circulation
Element because the street can be used and should be used '
for pedestrians, bikeways, and possibly public parking. .

Commission, at 8:35 P.M., Chairman Rombotis declared the . meeting adjourned.
