A motion was made to approve the minutes of June 14, 1978.

A motion was made to approve Resolution No. l448, as submitted.
(V-280, Arthur H. Gerhard, Applicant, request for variance to
reduce required rear yard setback from 17' to 7l).
CONTINUED PUBLIC HEARINGS
(1) ZCA-94, Condominium/Condominium Conversion - Request to
approve an amendment to Title 21 of the Carlsbad Municipal
Code to add regulationsoconcerning condominium standards
and condominium conversions.
Mr. Don Rose gave the staff presentation.
commissioner L'Heureux inquired as to whether or not'the problelr
Df the unsightly water meter bank could be alleviated by
placing.it in an enclosed space to the rear or side of the
building. -.
Zhairman Rombotis commented that the problem remains with the
axcessive costs of individual meters, but added thak this proble
is overwhelmingly outweighed by the benefits of the amendment.
Bart Lef ferdink, 5476 Cove Drive, Carlsbad, reiterated his
previous opinioqthat the imposition of many of the regulations
contained in the amendment were unfair as well as illogical.
A motion was made recommending APPROVAL of ZCA-94, based on the
'staff report and subject to the following corrections: .
Section 1, paragraph 4 - change dwnership -to owners.
Section 11, paragraph (7.) - delete words "defen&ble space"
Section 13, paragraph (111, subparagraph (1) add word
"water" after "gas". a.
Section 13, paragraph (11) , subparagraph (5) "delete complet
subparagraph.

Avenue between msevelt and Magnolia Streets.

suggested said street vacation in order to provide private
sewer lateral

(4) CUP-153, Wkheed Marine Laboratory - Request for a Conditional Use Permit to allow three teqorary office trailers to be placed in the northeast comer of the property behind the rear parking area.

A mtion was made to APPROVE CUP-153, based On
the findings and conditions of the staff reprt.
(5) ZCA-99, City of Carlsbad - Zone 'Code Amzrhent -ding
Title 21 of the Carlsbad Municipal Code by the addition 0:
Chapter 21.55 relating to the provision of interim
school facilities by requiring didicatiob of land and
fees.
Mr. Don Rose gave the. staff presentation.
Ccannissioner Larson questioned the City's right to receive
payrent for holding mnies in trust for..,% Schl District.
City Counsel, Vince Biondo, was available for questions.
camnissioner Schick related concern over there being no time
limit included in the amendment in which the School District
is obliged to reply to the City regarding fees.
Camnissioner Wrench questioned the relevancy of including . .
a Single Family Residence in the definition of Residential Developent, and also the possibility of excluding 'non mater variances frcm school fee impositions.
Mr.'Biondo, City Counsel, related tllat the above referenced matters should be resolved betseen'the City Council and the
School Board in that the City Council muld be the ultimate autbrity .

to Single Family Residences.
.A time limit should be included within whia the School.

modified to appropriately include condminium conversiom with applicable escape clauses for apartments and to
avoid double charging for subsequent conversions.

(6) ZCA-98, Public Facilities Sewer Availability, City of Carlsbad - Zone Code Amendment amending Title 21,
Chapter 21.44 of the Carlshad Municipal' code by the amendment of Section 21i44.020 to condition the
developt of all.property in the city upn the City
Council's determination that sewer service is available pursuant to such sewer allocation system as the Council may adopt.
Mr. Dan Rose presented the staff report.
conmissioner L' Heureux asked if a permit would be issued to build a building not needing a sewer.
A mtion was made to continue the'mtter of ZCA-98 to the meting of July 12, 1978 to allow further staff research into alternatives 'to sewers.
NEW BUSINESS
( 7) PCF-15, Priestly Lincoln Wrcury - west for review of plans to determine carrpliance with Specific Plan No. 19 (car country).
Mr. Don ~se gave the staff presentation.
Carmissioner L'HeureLur expressed concern over the daninqnce
of the roof area and as to whether or not the main building
was higher than surrounding structures in Car-country. He also felt that the signs as proposed might be out of place.
Mr. aDbert Knauf, 810 'Mission Avenue, Oceanside; representing
the applicant and Tri City Auto Dealers, related that the height of the building was. 28' 6'' at 'its highest point. This is canpared to an average height of 30 can p throughout Car Country. He further stated that the Coastal Chfnission is in the process of making reconmmdations regarding the signing of the project ard that any sign construction would be su3xnitted on a future application for review by the coarpnission
An option to raise the building a IMX~ of 3' if sewer complicatians mandates was discussed.
A mtion was made to APPRIW the concept of PCF"15 with tk;e' understanding that this approval in no way indicates approval of any signs or sign applications to be suhnitted.
A discussion took place mng the Comnissioners regarding ,
the changing of the time and frequency of the Planning ccarmission meetings. It was generally agreed to table this
matter until the next meeting.
