CALL TO ORDER
The meeting was called to order by Chairman Marcus at 7:00
P.M.
ROLL CALL
Present - Chairman Marcus, Commissioners L'Heureux, Jose,
Farrow, and Rombotis.
Commissioner Schlehuber arrived at 7:06 P.M.
Absent - Commissioner Friestedt.
Ex-Officio members James Hagaman, Planning Director; and
Dan Hentschke, Assistant City Attorney, were also present.
Staff members present were:

PLEDGE OF ALLEGIANCE was led by Chairman Marcus.
CONTINUED PUBLIC HEARINGS:
Bill Hofman referred to the memo of July 22, 1981 from the
Planning Department to the Planning Commission, with regard
to some additional conditions for items on the agenda; and
indicated that if there were no problems, Staff would be
recommending approval of the Resolutions with these added
conditions.
1. CT 81-15/CP-161, RUSSELL. Request for a 9 unit
Tentative Tract Map and Condominium Permit on property
located on the north side of Home Street between
Jefferson Street and Hope Avenue in the R-3 Zone.
With the aid of a transparency showing the location of the
project, Bill Hofman gave a report on the matter, essentially
as contained in the written staff report.
Commissioner Rombotis pointed out that this property- abuts
the Redevelopment Area, which is across from sub-area 8, and
calls for more intensive residential use from the General
Plan densities. He added that he does not see how Staff can
justify their concerns of the higher density.
Bill Hofman stated that the project is not in the Redevelop-
ment Area, and Staff has to look at same like any other
project within the City, and their intent was to review each
project consistently.
Chairman Marcus opened the public hearing at 7:07 P.M., and
extended the invitation'to speak.
The Commission recognized Paul Russell, 2525 "K" Jefferson
Street, Carlsbad; the applicant. Mr. Russell gave some
background on the project, and stated his opinion that same
will be beneficial to the surrounding neighborhood. He added
that Staff's only recommending to the applicant was to drop
a unit or two; however, he indicated that dropping one unit
does not greatly benefit the project. He stated that in
losing one unit, he would have to raise the price of each _
unit a minimum of $10,000.

Mr. Russell continued to explain that by dropping one of the
units, they would gain 564 square feet of open space, compar-
ed to over 14,000 they already have, which includes the
driveways.' He added.that they did upgrade the plan to
accomodate three and a half more guest parking spaces. There
is also 559 square feet of flat and usable recreation area,
which is well above the 200 square feet required; and there
is 760 cubic feet of convenient storage space per unit, as
opposed to the 480 cubic feet required.
Mr. Russell stated that they were able to obtain the extra
recreation area by three main changes, and he explained
same, which provided more open passive and open active area.
He added that on the original plan, Staff counted 100 percent
of the rear open area as recreation space; however, in
coming back with' the amended plan, Staff decided to count
only small areas around each bench and barbeque. This is
what resulted in Staffs' 325 square feet per unit, versus the
applicants' 559 square feet per unit.
In conclusion, Mr. Russell continued to explain the design
of the project, along with the various amenities; and
requested approval of same.
In response to Commission query regarding the landscaping,
Mr. Russell described same briefly.
Commissioner Jose inquired if there was any possibility of
staggering the buildings, to add to the esthetics of the
units. Mr. Russell explained that there was not, and
indicated that they have tried that approach; however,
staggering would not be feasible on this lot. He also
pointed out that if staggering was possible, some of the
views would be lost.
Discussion then reflected the use of concrete, versus black
top for the driveway.
Since no one else wished to speak on the matter, Chairman
Marcus closed the public hearing at 7:20 P.M.
Commissioner Farrow pointed out that the building covers
30 percent of the land, and stated that the recreation area
per dwelling unit is 325, which supercedes that which is
required. He added that the complex has two passive areas,
and feels that same is compatible with those in the
surrounding area. He also stated that he is not concerned
with the high density use, and is in favor of the project.
Commissioner L'Heureux expressed concern over the discrepancy
between Staff and the applicant in figuring the recreational
area. He also stated that he does not see the justification
in the objections and concerns that Staff has raised with
regard to density.
Bill Hofman explained that in figuring the recreational area,
Staff looked at only the usable area; which included
the pool area, the deck, the balconies, and the area to the
rear which was usable. The applicant, on the other hand,
included planter areas and all unusable open areas which
cannot be counted according to the Condominium Ordinance.
Commissioner Farrow pointed out that the applicant is also
over the requirement for storage area, and all the parking
is under cover with the electric garage door openers. He

With regard to the density issue, Bill Hofman explained that
the General Plan does establish criteria that Staff looks at
when they approve a project over the minimum that is
specified by the General Plan. If the applicant wishes to
go above the density, there is criteria listed that relates.
to topography, amenities, and lot configuration. He added
that this is the criteria Staff has been using on all
projects.
Bill Hofman continued, indicating that the reduction of one
unit would make a difference. He stated that Staff's
primary concern is the density, and the justification of
same, as Staff has to go by the General Plan guidelines.
Mr. Hofman stated that Staff also has concern with the
design of the project, and discussion reflected same.
The Commission directed Staff to bring back a Resolution
with conditions of approval for CT 81-15/CP-161, to include
the following: the driveway in concrete, requiring the
textured areas, elimination of the walkway to the rear, and
specifications for the size of the trees
The Planning Director indicated that there are concerns in
this area and site which the City Council and Planning
Commission have not expressed before; and Staffs'
recommendation is based on a consistent history of how they
have treated these kinds of projects throughout the City.
Mr. Hagaman suggested that the Commission hold a workshop to
discuss the differences that have occurred, with regard to
the new areas that have not occurred in the past. He added
that a workshop would help in providing better consistency
and direction for both Staff and applicants'. The Commission
concurred.
Chairman Marcus indicated that a request has been received
for the withdrawal of Item No. 4, CUP-203, Unity of Carlsbad.
4. CUP-203, UNITY OF CARLSBAD. Request for approval of a
Conditional Use Permit to allow a church with weekly
and holiday assemblages at 3138 Roosevelt Street in an
existing office/retail development in the C-2 zone.
The Commission accepted the withdrawal of CUP-203.
Chairman Marcus indicated that the applicant has requested
a continuance on Item No. 9, MS-532, Harkins.
9. MS-532, HARKINS. Request for approval of a Minor
Subdivision to create three lots, two of which are
panhandle lots, on the north side of Pine Avenue between
Pie Pica and Highland in the R-1-7500 zone.
At the applicant's request, the Commission continued MS-532
to the meeting of August 26, 1981.

NEW PUBLIC HEARINGS:
2. CT 81-2O/CP-165, SUNRISE PACIFIC. Request for a 24 unit
Tentative Tract Map and Condominium permit on property
located on the north side of Pirineos Way, La Costa in
the RD-M zone.
With the aid of a transparency showing the location of the
project, the staff report was presented by Bill Hofman,
essentially as contained in the written staff report.
Commissioner Farrow identified such statistics as dwelling
units per acre, building use, recreation area, and storage
requirements; and stated that he cannot justify the
consistency in this project, as related to other projects,
and requested clarification of same.
Bill Hofman explained that it is difficult to compare two
developments within two different General Plan.areas, and
covered some of the amenities in the project, as they relate
to other projects. He added that Staff feels they are
consistently reviewing all projects.
Mr. Hofman pointed out that staff report did not indicate
the actual recreation figure on the Sunrise Pacific project,
as it is quite a bit more than the required 200 square feet
per unit.
Commission discussion reflected on the consistency of this
project, as related to other projects.
Bill Hofman indicated that the PUD Ordinance Committee will
be recommending flexibility on setbacks, and they are going
to try to include condominium projects.
Commissioner Jose referred to Resolution NO. 1834, Condition
No. 23, and expressed concern over the wording of same. He
stated his feeling that it should be stated that they are
or are not required.
Chairman Marcus opened the public hearing at 7:54 P.M., and
extended the invitation to speak.
The Commission recognized Dennis Sloan, 20944 Sherman Way,
Suite 215, Canoga Park. Mr. Sloan pointed out that the
storage exceeds the requirement by approximately 30 to 40
percent, and expressed the willingness to respond to any
questions. In response to Commission query, Mr. Sloan
indicated that the applicant is in agreement with all the
recommended conditions.
Since no one else wished to speak on the matter, Chairman
Marcus closed the public hearing at 7:55 P.M.
Commissioner Rombotis expressed concern over the parking,
and inquired if Staff looked at the three parking spaces
that are being required on the street.
Bill Hofman stated that the parking issue is a legitimate
concern; however, usually on a cul-de-sac where there is no
through traffic, the parking does not become a real
problem.

The Commission approved the Negative Declaration issued by Marcus
the Planning Director and adopted the following Resolution L'Heureux
recommending approval of CT 81-2O/CP-165 to the City Council, Jose
based on the findings and subject to the conditions contained Rombotis
in the staff report; with the addition of the following Farrow
conditions: Schlehuber
1) "Pursuant to the provisions of Section 20.20.050(l)
of the Carlsbad Municipal Code, a parcel map may be
filed in lieu of a final map. Whenever reference
is made in these conditions to a final map, the
reference shall apply also to a parcel map filed in
lieu thereof."
2) Approval of this tentative tract map shall expire
eighteen months from the date of City Council
approval unless a final map is recorded. An exten-
sion may be requested by the applicant. Said
extension shall be approved or denied,at the
discretion of the City Council. In approving an
extension, the City Council may impose new condi-
tionsand may revise existing conditions."
RESOLUTION NO. 1834, RECOMMENDING APPROVAL OF A 24
UNIT TENTATIVE TRACT MAP AND CONDOMINIUM PERMIT ON
PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PIRINEOS
WAY. APPLICANT: SUNRISE PACIFIC - CT 81-2O/CP-165.
3. zc-239, KELLY. Request for a Preannexational Zone
Change from County C and R-4 to the P-M-Q Zone for
property located on the south side of Palomar Airport
Road immediately west of the SDG&E power transmission
lines.
With the aid of a transparency showing the location of the
project, the staff report was presented by Bill Hofman. He
indicated that Staff has discovered two issues with the
project that were not addressed in the staff report. The
first relates to the minimal lot sizes allowed in the P-M
zone, which currently requires that all lots have a minimum
lot area of one acre, unless a Specific Plan is approved on
the property allowing smaller lot sizes.
Mr. Hofman continued that one of the parcels is less than
one acre; therefore, approval of the zone change would create
a non-conforming situation. Staff is therefore proposing a
condition to the re-zoning, which will require that the lots
be consolidated, or a lot line adjustment be approved,
creating minimum one acre lots. In lieu of this condition,
the applicant could submit a Specific Plan for the entire
site; in either case he would be meeting the P-M zoning
requirements.
The second issue relates to the fact that the parcels are
owned by two different,people, and could be developed
independently of each other. Because of the unusual lot
configuration of the two parcels, and the problems with
access onto Palomar Airport Road, Staff feels that both
parcels should be developed under one Site Development Plan.
Staff is therefore recommending that an additional condition
be added, requiring the submittal of one Site Development
Plan application for both parcels.
Mr. Hofman concluded that with these conditions, Staff feels
that-all the findings for approval~of the zone change can be.
made, -and-they are recommending approval of same.

Chairman Marcus opened the public hearing at 8:00 P.M., and
extended the invitation to speak.
The Commission recognized Jean Jensen, 2406-C Altisma Way,
Carlsbad; Planning Consultant for the applicant. Ms. Jensen
indicated that she brought the issues referred to during the
sta.ff report, to Staffs' attention earlier this date. How-
ever, she stated she does not accept the condition that the
Site Development Plan application be made as one for both
parcels. She added that time restraints do not work when
two owners are involved, and asked that the Specific Plan,
which is in the Ordinance, be adhered to. She stated that
the applicants agree to all other conditions, and expressed
the willingness to respond to any questions.
The Assistant City Attorney inquired as to Staffs'
justification for Condition No. 2 under the Ordinance.
Bill Hofman explained that it is a planning justification,
and stated that Staff is very concerned that if the two
properties develop independently, there will be two accesses
along Palomar Airport Road , which could become a real
problem. He explained that the only way to control same,
would be to have one Site Review for the entire project.
Ms. Jensen pointed out that one of the properties is very
small and would have to have access; however, the other one
is approximately 11 acres, and could have access at the
other end.
Michael Holzmiller explained that he approved the report,
and until today, he did not realize that there were two
separate ownerships. He stated that it was. always the
Department's intent in reviewing the re-zoning, that there
would be one Site Development Plan for the whole.property.
He added that since the applicants may be opposed to
consolidating the property, Staff felt that there needed
to be a coordinated plan in order to make the small lot
suitable for P-M zoning.
Discussion reflected the issue of access onto Palomar
Airport Road.
Since no one else wished to speak on the matter, Chairman
Marcus continued the public hearing.
The Commission continued ZC-239, Kelly, to the meeting of
August 12, 1981; and requested additional clarification and
report on the matter.
5. CT 81-17/CP-163, LA COSTA VILLA. Request for approval
of a Tentative Subdivision Map and Condominium Permit
to develop 15 units on the north side of Gibraltar
Avenue between Jerez Court and Romeria Street in the
RD-M Zone.
With the aid of a transparency showing the location of the
project, the staff report was presented by Michael
Holzmiller, essentially as contained in the written staff
report.

Chairman Marcus opened.the public hearing at 8:12 P.M., and
extended the invitation to speak.
The Commission recognized Mike Mauer, representing ENA
Development Corporation, P. 0. Box 834, Cardiff. Mr. Mauer
expressed the willingness to respond to any questions.
Since no one else wished to speak on the matter, Chairman
Marcus closed the public hearing at 8:13 P.M.
The Commission approved the Negative Declaration issued by
the Planning Director, and adopted the following Resolution
recommending approval of CT 81-17/CP-163, based on the
findings and subject to the conditions contained in the staff
report; with the addition of the following condition:

6. CT 81-ll/CP-156, LA COSTA GREENS. Proposed Tentative
Subdivision Map and Condominium Permit to develop 22
units on the north side of Navarra Drive east of Viejo
Castilla Way in the RD-M Zone.
With the aid of a transparency showing the location of the
project, Bill Hofman gave a report on the matter; essentially
as contained in the written staff report.
Chairman Marcus opened the public hearing at 8:15 P.M.., and
extended the invitation to speak.
The Commission recognized Charles Peinado, 6615 Caminito
Scioto, La Jolla; one of the partners of the La Costa Green
Project. Mr. Peinado introduced the Architect, Allen Duber,
who continued the presentation.
Mr. Allen Duber addressed the Commission, and with the aid
of a scale model, he explained the design of the project.
With respect to the putting green surface on the top of the
roof, Mr. Peinado indicated that Staff is requiring a sod
roof; however, the applicant is requesting rewording of the
condition to allow for a feasibility study of using astroturf
rather than the sod.
Commissioner L'Heureux inquired what type of sound atten-
uation measures the applicant will provide. Mr. Peinado
responded that this is one of-the factors that will be
looked at in the detailed design of the building; however,
they have not yet decided what the structure will be. He
explained that sound, waterproofing, and structural strength
are all aspects taken into consideration.
Bill Hofman pointed out that sound was one of the reasons
that Staff was requiring the sod, as astro-turf is only a
mat over the roof, and provides no buffer. The sod would
provide azcushion and a noise barrier.

Mr. Duber showed the Commission a front view sketch of the
project, and continued to explain some of the amenities of
the project. He also explained the accomodations for
visitor parking, and. security.
Discussion reflected the feasibility of using astro-turf,
versus sod. \
Mr. Peinado requested that the Commission require the
applicant to study the feasibility of astro-turf, rather thal
requiring the applicant to use sod.
Since no one else wished to speak on the matter, Chairman
Marcus closed the public hearing at 8:32 P.M.
Commissioners Rombotis and L'Heureux expressed concern with
the parking. It was pointed out that the applicant is
intentionally devising the amenities to be oriented towards
the golf course, and their design is going to attract guests
which makes the visitor parking a real concern;
Mr. Peinado indicated that the parking issue is a new issue
to the applicant, and in working with the Staff, they have
had the understanding that the parking as they have devised
it was reasonable, and met the criteria of the City.
The Commission approved the Negative Declaration issued by
the Planning Director, and adopted the following Resolution,
recommending approval of CT 81-ll/CP-156, based on the
findings and subject to the conditions contained therein;
with the deletion of Condition No. 15, and the addition of
the following condition:
"Pursuant to the provisions of Section 20.20.050(l) of
the Carlsbad Municipal. Code, a parcel map may be filed
in lieu of a final map. Whenever reference is made in
these conditions to a final map, the reference shall
apply also to a parcel map filed in lieu thereof."
RESOLUTION NO. 1839, RECOMMENDING APPROVAL OF A
TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT TO
DEVELOP 22 UNITS ON PROPERTY GENERALLY LOCATED ON THE
NORTH SIDE OF NAVARRA DRIVE EAST OF VIEJO CASTILLA WAY.
APPLICANT: LA COSTA GREENS.
7. ZCA-134, CITY OF CARLSBAD. An Amendment to the Zoning
Ordinance to allow administrative review of certain
Variance applications of panhandle lots.
Bill Hofman gave a staff report on the matter, essentially
as contained in the written staff report. Mr. Hofman pointer
out a correction to the staff report, on page 1, the last
paragraph, the first sentence should read, "The Commission
should be aware that all property owners within 300 feet of
property upon which a variance is requested would be notifiec
15 days prior to any decision by the Planning Director." -
Chairman Marcus opened the public hearing at 8:43 P.M., and
extended the invitation to speak. Since no one wished to
speak on the matter, the public hearing was closed.

The Commission approved the Negative Declaration issued by
the Planning Director, and adopted the following Resolution,
recommending approval of ZCA-134,,based on the findings
contained therein:
RESOLUTION NO. 1834, RECOMMENDING APPROVAL OF A ZONE
CODE AMENDMENT, AMENDING TITLE 21, BY THE AMENDMENT OF
CHAPTER 21.10, SECTION 21.10.080, TO ALLOW PLANNING
DIRECTOR REVIEW OF PANHANDLE LOTS IN THE R-l ZONE, AND
BY THE ADDITION OF CHAPTER 21.51 TO ALLOW PLANNING
DIRECTOR REVIEW OF CERTAIN VARIANCES. APPLICANT: CITY
OF CARLSBAD.
RECESS
Chairman Marcus called a recess at 8:46 P.M., and the
Commission reconvened at 8:57 P.M., with six members present.
DISCUSSION ITEMS
8. MS-546, JASMER. Request for a Minor Subdivision creating
four lots, two of which will be panhandle lots on the
west side of Valley Street between Basswood Avenue and
Oak Avenue in the R-1-7500 Zone.
With the aid of a transparency showing the location of the
project, Michael Holzmiller gave a report on the matter,
essentially as contained in the written staff report.
Discussion reflected the future of James Drive.
Leonard Jasmer, the property owner, addressed the Commission,
and explained that the property to the south of him has
dedicated, and he is proposing to dedicate the rear of his
property.
Discussion included the San Diego Gas and Electric easement,
and Mr. Jasmer explained that the hub is in the center of the
pole, and the property line runs down the poles.
The Commission adopted the following Resolution, recommending
approval of MS-546, based on the findings and subject to the
conditions contained in the staff report:
RESOLUTION NO. 1840, APPROVING THE CREATION OF TWO PAN-
HANDLE LOTS AS PART OF A MINOR SUBDIVISION LOCATED ON
THE WEST SIDE OF VALLEY STREET IN THE R-1-7500 ZONE.
APPLICANT: JASMER.
Commissioner Farrow indicated that his abstention was due to
the fact that he feels there is a lack of information as to
where the easement is, and he is uncertain as to how many
houses line up on the property.
10. MS-533, SPANGLER. Request for approval of a Minor
Subdivision to create three lots, two of which would be
panhandle lots, on the north side of Park Drive, between
Marina Drive and Adams Drive, in the R-1-15,000 Zone.
With the aid of a transparency showing the location of the
project, Bill Hofman gave a report on the matter, essentially
as contained in the written staff report.
Commissioner Rombotis inquired if under the conditions of the
minor subdivision, if the City will require the improvement
of Park Drive. Richard Allen explained that the City would.

Jean Jensen, Planning Consultant for the applicant,
addressed the Commission, and requested clarification of
Commissioner Rombotis' concern of the improvem&ts on Park
Drive. She indicated that otherwise, the applicant is in
agreement with all the conditions.
Cominissioner Rombotis explained that they were pot adding
a new condition, as the improvements are required. He added
that under some of the minor subdivisions they took a future
street agreement, and he did not want same to occur here.
The Commission recognized Raymond G. Spangler, 3774 Skyline
Road, Carlsbad; owner of the property. Mr. Spangler
inquired if they would have to make the improvements now,
or just agree to.make them. Commissioner Rombotis responded
that he should make the improvements now, and referred to
Condition No. 10 of Resolution No.,1838. He also pointed out
that Ms. Jensen agrees with the condition.
The Commission approved the Negative Declaration issued
by the Planning Director and adopted the following Resolutior
approving MS-533, based on the findings and subject to the
conditions contained in the staff report:
RESOLUTION NO. 1838, APPROVING THE CREATION OF TWO PAN-
HANDLE LOTS AS PART OF A MINOR SUBDIVISION LOCATED ON
THE NORTH SIDE OF PARK DRIVE BETWEEN MARINA DRIVE AND
ADAMS DRIVE. APPLICANT: SPANGLER.
11. PCD/GPC-12, CITY OF CARLSBAD. Finding General Plan
Consistency for proposed outfall water line.
With the aid of a transparency showing the location of the
project, Michael Holzmiller gave a report on the matter,
essentially as contained in the written staff retort.
The Commission adopted the following Resolution:
RESOLUTION NO. 1832, FINDING GENERAL PLAN CONSISTENCY
FOR PROPOSED OUTFALL WATER LINE. APPLICANT: SAN

12. ZCA-136, CITY OF CARLSBAD. Request to allow mobile
homes within single family zones.
Michael Holzmiller gave a report on the matter, essentially
as contained in the written staff report.
Discussion reflected the individual Commissioners' feelings
with regard to the minimum width requirement, the require-
ment for the two car garage, and the use of metal exterior
siding.
Staff passed around so% pictures of different types of
mobile homes.
The Commission concurred that the Ordinance be sent back to
the City Council, accepting the 20 foot minimum width as an
additional development standard, and strongly recommended
that the Council require a two car enclosed garage, and the
original wording on the siding.

RESOLUTIONS FOR ADOPTION:
13. RESOLUTION NO. 1827, MUSSER.
Commissioner L'Heureux expressed concern with Condition No.
2 of the Resolution, and indicated that the term 'unusual
circumstances" is not clearly defined. The Assistant City
Attorney concurred.
Commissioner L'Heureux further stated that the reason it is
left vague in the Ordinance is because there are no unusual
circumstances; thus, he agreed with the Planning Staff's
original recommendation to deny the project.
The Commission directed the City Attorney to re-draft the
Resolution, for clarification purposes.
14. RESOLUTION NO. 1814, CITY OF CARLSBAD.
Commissioner Rombotis pointed out that one of the issues
was that the Commission did not find that the parking lot
was of a temporary nature, and the.Resolution refers to the
parking lot as being temporary.
Commissioner L'Heureux referred to Condition No. 5, and
stated his feeling that the landscaping should be such that
it provides some type of buffer or screening from the people
across the street, looking into the parking lot.
In response to Commission query, Bill-Hofman explained that
the reason Staff combined the Resolutions was that in the
event an amendment is proposed, there will be one application
number to go along with it. He added that administratively,
Staff felt it would present problems separating the two.
In response to Commissioner Rombotis' concern over the use
of the word "temporary" throughout the Resolution, Michael
Holzmiller explained that the application was for a temporary
paved parking lot. Staff included in the findings that the
Commission was not satisfied that the parking lot would be
temporary, and when it is appealed, Staff will attempt to
show that it is, in fact, going to be temporary to the City
Council.
The Commission adopted the following Resolution, and directed
the City Attorney to re-draft Finding No. 5C, to reflect the
Commissions' concerns the the parking lot as proposed would
not be a temporary facility:
RESOLUTION NO. 1814, APPROVING A CONDITIONAL USE PERMIT
REQUEST TO CONSTRUCT MODULAR OFFICE STRUCTURES ON THE
SOUTH SIDE OF LAGUNA DRIVE, BUT DENYING THE REQUEST TO
CONSTRUCT A TEMPORARY PAVED PARKING LOT ON THE NORTH
SIDE OF LAGUNA DRIVE BETWEEN PI0 PICO DRIVE AND ELMWOOD
STREET. APPLICANT: CITY OF CARLSBAD.
