ROLL CALL Present - Chairman Marcus, Commissioners Friestedt, Jose, L'Heureux, Schlehuber, and Farrow. Absent - Commissioner Rombotis. Ex-Officio Members James Hagaman, Planning Director; and Dan Hentschke, Assistant City Attorney, were also present. Staff members present were: Michael Holzmiller, Principal Planner Bill Hofman, Associate Planner Richard Allen, Principal Civil Engineer Charles Grimm, Associate Planner PLEDGE OF ALLEGIANCE was led by Chairman Marcus. PLANNING COMMISSION PROCEDURES Chairman Marcus explained Planning Commission procedures in its capacity as an advisory Commission to the City Council, and identified those matters delegated to the Planning Commission for a final decision. Chairman Marcus further explained the procedure observed by the Commission during public hearing items. ITEM OUT OF ORDER DATE OF MEETING: October 14, 1981 TIME OF MEETING: 7:00 P.M. & \ 0 PLACE OF MEETING: Council Chambers # COMMISSIONERS ’ 7. CUP-207, CITY OF CARLSBAD. Request for approval of a conditional use permit to allow placement of a modular unit for temporary use as offices for the Fire Department on the south side of Elm Avenue between Pio Pica Drive and Highland Drive in the RP-Q Zone. Chairman Marcus explained that it has been determined that major revisions to this project may be necessary; therefore, the Fire Department has requested a withdrawal of the item at this time. Chairman Marcus inquired if anyone was present to address the item, and received no response. The Commission approved a withdrawal of CUP-207. NEW PUBLIC HEARINGS Marcus Friestedt Jose L'Heureux Schlehuber Farrow 1. CT 81-34/CP-181, TRABERT/PERRIER. Request for a 6 unit tentative tract map and condominium permit on property located on the south side of Navarra Drive, west of Viejo Castilla Way in the RD-M Zone. With the aid of a transparency showing the location of the project, Michael Holzmiller gave a staff report on the matter. MINUTES October 14, 1981 COMMISSIONERS ’ Chairman Marcus opened the public hearing at 7:07 P.M., and extended the invitation to speak, The Commission recognised Ed Eginton, Architect representing the owners. Mr. Eginton stated that the staff report addressses the project thoroughly, and expressed willingness to respond to any questions. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at 7:08 P.M. The Commission approved the Negative Declaration issued by the Planning Director, and adopted the following Resolution, recommending approval of CT 81-34/CP-181 to the City Council based on the findings and subject to the conditions contained therein: RESOLUTION NO. 1872. RECOMMENDING APPROVAL OF A 6 UNIT TENTATIVE TRACT MAP AND CONDOMINIUM PERMIT ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF NAVARRA DRIVE, LA COSTA. APPLICANT: TRABERT/PERRIER 2. ZC-247, ANDERSON. Change of zone from R-A-10,000 to RMHP (Mobilehome Park Zone) on property located on the west side of El Camino Real, south of Tamarack Avenue, approximately 800' east of the Country Store. With the aid of a transparency showing the location of the project, the staff report was presented by Bill Hofman, essentially as contained in the written staff report. He further explained the cross sections showing the proposed grading of the site. Commissioner Friestedt inquired as to the primary concern that Staff has with the project. Mr. Hofman explained that it would be the complete alteration of the site, created by grading to accomodate the mobilehome park. He added that the secondary concerns are the traffic impacts on El Camino Real, that would be created by a mobilehome park. Commissioner L'Heureux inquired if the amount of grading is a proper factor in determining land usage on a piece of property. Mr. Hofman explained that in this particular case, the mobilehome park zone would only allow a mobilehome park; therefore, land usage is tied to the zone. He added that the Commission must consider on any zone change whether a site is suitable in size and shape to accomodate uses allowed in that zone. In this case, the Commission must consider whether this particular site is suitable in size and shape to accomodate a mobilehome park. In response to Commission query, Richard Allen explained that the Grading Ordinance sets no limit as to the amount of grading permitted on any site. With regard to cut and fill, Commissioner Friestedt inquired as to the grading criteria for any applicant in the City. Mr. Allen explained that as far as the overall quantity, the applicant would have to file an Environmental Impact Assessment, as part of a grading permit. He added that that would determine the environmental impacts of the grading, and if they are significant, they may require some mitigating measures. Marcus Friestedt Jose L'Heureux Schlehuber Farrow - MINUTES October 14, 1981 Page 3 COMMISSIONERS For clarification purposes, Mr. Hofman explained that the land use issue for zoning allows consideration for grading. As far as the environmental review, it did indicate that further environmental review would be required prior to any grading of the property, and the development of the mobilehome park. He added that in considering the environmental review for the Zone Change, only at this time, the applicant would not have to spend funds on an EIR before he knew if he could develop the property. Connnission discussion reflected the amount of grading necessary to accomodate the construction of a mobilehome park, and access onto El Camino Real. Mr. Hofman again explained the cross sections showing the proposed grading of the site. With regard to access, Mr. Hofman explained that the lower portion of the site could be a potential extension of the Country Store, and share access with it, or some other compatible use that could share access with it. He added that Staff is not limiting access by any action taken at this meeting, and if the Commission approved the rezoning and the mobilehome park, it would have its' own access. In conclusion, Mr. Hofman explained that it would be preferable for any development on the lower portion of the site to share access with the Country Store. Commissioner Friestedt inquired if it would be appropriate to require a redesign of the access onto El Camino Real. Richard Allen explained that in a memo to the Planning Department, it was suggested that the proposed entrance onto El Camino Real from the inside of a horizontal curve not be allowed, and the entrance to the site should be moved to the north end of the project as far as possible from the curve section. Chairman Marcus opened the public hearing at 7:35 P.M., and extended the invitation to speak. The Commission recognized Mr. John Felker, 3514 Don Juan Drive, Carlsbad, representing the Anderson group. Mr. Felker distributed copies of his presentation to the Commission, addressing compatibility with neighboring properties, environment, esthetics, traffic, noise, quality, and grading; and spoke in favor of ZC-247. With the aid of wall exhibits, Mr. Felker explained the two to one slopes, which would be the maximum on the property, and the quality of the mobilehomes. He also showed pictures of the design of the proposed mobilehomes, and samples from Ranch0 Carlsbad. In conclusion, Mr. Felker requested approval of the project. The Commission recognized Mr. Jack Edwards, 18811 Crenshaw Place, Torrance, Civil Engineer representing the applicant. With regard to the staff report, Mr. Edwards explained that this project with 45,000 yards of fill comes out 9,000 yards per acre, and is compatible with other grading in the area. MINUTES October 14, 1981 \ Q COMMISSIONERS Page 4 Mr. Edwards continued to address the three planning issues with regard to suitable site, traffic impact, and other land uses. With regard to the slopes, he explained that they are less in magnitude than they are in the existing condition, as there will be less erosion. With regard to access, Mr. Edwards indicated he has worked out an alternate access, and could work with Staff on same. As proposed, he stated his opinion that it is not the most desireable; however, indicated it is not a dangerous situation. Mr. Edwards stated that he concurs with Staff that the site is suitable for low density single family development, that the privacy and sound buffers should be provided for the existing single family homes, and that traffic impact should be minimized. The Commission recognized Mr. Arthur Anderson, 3345 Don Diablo Drive, Carlsbad. Mr. Anderson referred to the petition received by Staff in opposition to ZC-247, and addressed the concerns listed on same. He stated his opinion that their homes are compatible to the immediate area and the City in general. With regard to the terrain, Mr. Anderson stated that when it is graded, it will have a much nicer appearance than at present. Mr. Anderson stated that the area for their homes is over 10,000 square feet and could not be called sub-standard. He added that the buildable portions of the lots to the south are right at the 10,000 square foot figure. With regard to office- professional use for the property as suggested, he stated it will require much more grading, have a heavier impact on traffic, and would not come close to the existing zone. The Commission recognized Mr. Steve Cannady, 3526 Madison Street, Carlsbad. Mr. Cannady spoke in favor of the project, and requested approval of the zone change. The Commission recognized Mr. John Manes, 4962 Park Drive, Carlsbad. Mr. Manes indicated he was speaking for 80 residents in the area, and spoke in opposition of the zone change. He showed an overlay picture of the proposal to the Commission, and stated his opinion that if the zone change is approved, it will create a great environmental impact on the neighboring properties. Mr. Manes continued to state his opinion that there are other sites available that would better serve the needs of this project, and reiterated that he is strongly opposed to same. The Commission recognized Mr. John Berkowski, 5005 El Camino Real, Carlsbad. Mr. Berkowski explained that four years ago a traffic study was done for the development of the Thunderbird Ranch, and since that time, traffic has doubled. He stated his feeling that it is not compatible to the area to allow more commercial or mobilehomes, and requested that the zoning remain as is. The Commission recognized Mr. Ernest T. Sheen, 4734 Birchwood Circle, Carlsbad; President of the Board of Directors of the Carlsbad Palisades Homeowners Association. MINUTES .October 14, 1981 Page 5 Mr. Sheen continued that the Board of Directors has authorized him to express their strong opposition to any zone change in this area. He added that they feel the proposed zoning will have a devaluating affect upon their homes, and same is not compatible with the area. The Commission recognized Ms. Cheryl Gann, 4968 Park Drive, Carlsbad. Ms. Gann indicated she is not against development; however, expressed concern with regard to the affects this project would have on her property. The Commission recognized Ms. Ardena Larsen, Ranch0 Carlsbad Mobilehome Park. Ms. Larsen spoke in favor of the zone change, and the people of the Ranch0 Carlsbad Mobilehome Park. The Commission recognized Mr. R. C. Larsen, Ranch0 Carlsbad Mobilehome Park. Mr. Larsen stated his opinion that the houses in the area are not of better quality than their mobilehomes. With regard to grading, he stated that the adobe type dirt is the easiest to move, and the most compacted, and grading would be no problem. The Commission recognized Mr. Arthur Anderson, 3345 Don Diablo Drive, Carlsbad. Mr, Anderson submitted a petition for the record, in favor of ZC-247, which contains 160 signatures, and requested approval of same. The Commission recognized Mr. Ken Stillman, 4960 Park Drive, Carlsbad. Mr. Stillman stated his opinion that a mobilehome park is not compatible with the neighboring properties, and spoke in opposition of the zone change. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at 8:27 P.M. With regard to the Negative Declaration, Chairman Marcus indicated she would have concerns regarding the approval of same, as this is only for a zone change, and an EIR would be required at the time further plans are submitted. Discussion reflected visual and noise impacts, grading, and access. Bill Hofman explained that Staff is not concerned so much with the land use in terms of a mobilehome park versus a high density condominium; but the suitability for that type of use is the concern. Michael Holzmiller explained that the present zoning on the property is R-A-10,000, and if a standard subdivision is developed under that zoning, it would not allow too many units on this property. He added that the question before the City at this time is whether the property is suitable to change the zoning, and go from something that permits a very limited amount of development, to a zone that will permit 20 mobilehome sites. Mr. Holzmiller added that Staff does not feel that this piece of property is appropriate to change the zoning. MINUTES October 14, 1981 Page 6 Commissioner Friestedt stated that if the applicant and the Engineering Department have indicated that the access problem could be resolved with regard to the EIR to be acceptable, and if they are agreeable to work together, the issue could be mitigated or resolved. Connnissioner Friestedt continued that in his opinion the amount of grading is not that important; it is the way we judge the property in the way the application has been submitted. Commissioner Schlehuber expressed concern about approving the Negative Declaration, without further environmental report; although he feels that mobilehomes are needed. The Commission denied the Negative Declaration, and recommended a focused Environmental Impact Report be done, dealing with grading, traffic circulation, and visual and site impact. RECESS Chairman Marcus called a recess at 8:53 P.M., and the Commission reconvened at 9:lO P.M., with six members present, 3. ZC-242, FRANDSEN. Request for a preannexational zone change from the County's E-l-A to Carlsbad's C-2(Q) and RDM for property located on the west side of El Camino Real, 1400 feet north of Alga Road. With the aid of a transparency showing the location of the project, the staff report was presented by Michael Holzmiller, essentially as contained in the written staff report. Chairman Marcus opened the public hearing at 9:13 P.M., and extended the invitation to speak. Since no one wished to speak on the matter, the public hearing was closed. In response to Commission query regarding ensurance that the applicant will share a common access easement, Michael Holzmiller explained that it will be done through a Q-overlay, and both property owners have signed an agreement that they will get an easement. Michael Holzmiller indicated that the concern expressed by the Commission and Council was that the City not allow strip commercial along El Camino Real. He added that this request will be the end of commercial zoning in this area. Commissioner Jose stated he is in opposition of this development in the RD-M zone, due to strip commercial. He added that he is not in opposition of the RD-M, but he is against the C-2(Q). Commission discussion reflected previous direction to Staff with regard to continuance of commercial development and strip zoning. COMMISSIONERS The Commission approved the Conditional Negative Declaration issued by the Planning Director, and adopted the following Resolution, recommending approval of ZC-242 to the City Council based on the findings and subject to the conditions contained therein: RESOWJTION NO. 1841, RECOMMENDING APPROVAL TO THE CITY COUNCIL A PREANNEXATIONAL ZONE CHANGE FROM COUNTY OF SAN DIEGO E-l-A TO CITY OF CARLSBAD C-2-C (COMMUNITY COMMERCIAL) AND RDM (RESIDENTIAL DENSITY MULTIPLE ZONE) ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL, NORTH OF ALGA ROAD. APPLICANT: FRANDSEN 4. CT 81-35/CP-182, NATIVE SUN INVESTMENT. Request for approval of a tentative subdivision map and condominium permit to develop 14 units on the north side of Ocean Avenue between the Pacific Ocean and AT&SF Railroad in the R-3 Zone. Michael Holzmiller gave a staff report on the matter, with the aid of a transparency showing the location of the project. Chairman Marcus opened the public hearing at 9:24 P.M., an extended the invitation to speak. The Commission recognized Mr. Michael Mahoney, 2101 Racquethill, Santa Ana. Mr. Mahoney stated that there are three conditions of approval that the applicant would like to appeal. With regard to park fees, he explained that they paid a sizeable amount of money for the 2.2 acre parcel, and feel they should be allowed some credit for the dedication of that property. Mr. Mahoney continued to address the location of the pool. He stated that no unit will be subject to adverse noise from the pool. Staff was concerned that the pool might erode due to severe wave action, and Mr. Mahoney explained that there is a retaining wall with a 16 foot elevation, which is 7 feet higher than the elevation of San Malo. He added that the applicant does not feel the pool is in any jeopardy. Mr. Mahoney addressed Condition No. 34, and expressed concern as they have spent exhaustive sums on an EIR. He indicated that they are willing to hire a civil engineer who specializes in wave action, and submit that report to the City. In conclusion, Mr. Mahoney stated that the design of the units has changed dramatically, and they are compatible wih San Malo. In response to Commission concern regarding the remaining 3.25 acres, Mr. Mahoney stated that there are developable problems with that portion of the property, and any future development proposals would have to be worked out. He added that the applicant has no plans at this time, as it is not part of this development. Commissioner Farrow expressed concern with regard to the swimming pool, as it protrudes out at the point. Marcus Friestedt Jose L'Heureux Schlehuber Farrow MINUTES October 14, 1981 Page 8 , COMMISSIONERS \ Mr. Mahoney explained that they are willing to work with the pool; however, the applicant was concerned about the condition placed on the map, as it does not give them any latitude. He added that they would like to provide an engineering survey on the pool, and if it is found that it will be a problem, they would like to address it at that time. Discussion reflected on the location of the pool. Mr. Hofman responded that Staff’s recormnendat ion was very.similar to where the applicant is proposing to locate the pool, but between D and E where it would not be susceptible to wave attack. He added that it would not affect the design of the units. The Commission recognized Mrs. Mary Parente, 2458 Ocean Street, Carlsbad. Mrs. Parente expressed concern with obstruction of her view, and stated she was hoping that the first building would have been set back further, so that the people who own homes on Ocean Street would not have their north view obstructed. Mrs. Parente also requested that the City ensure that if future development occurs, no access be allowed onto Ocean Street, at the southern tip, due to traffic circulation. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at 9:41 P.M. In response to Cormnission query regarding park-in-lieu fees, Michael Holzmiller explained that it would have to be decided by the City Council, and would be based on a recommendation from the Parks and Recreation Director. Discussion reflected on the park-in-lieu credit, and public access to the beach through this property. Commissioner L’Heureux suggested that the condition be amended to indicate that if there is a fee dedication, appropriate credits be given. Commissioner Schlehuber stated his opinion that the Commission does not have sufficient information on the matter, and suggested that it is a matter for Council considerat ion. Commissioner Jose pointed out that on Ocean Avenue in the past, easements were required for public access to the beach. He added that without this, the applicant would, by State Law, have to provide public access to the beach through his property. For clarification purposes, the Assistant City Attorney explained that the question of whether it can be applied is a legal question. He stated that if the Commission decides as a policy matter that it is appropriate and legal, then the recommendation would be to give the credit. If the Commission determines that they do not have enough informat ion, the recommendation would be that the Council make their decision based on whatever facts that have at that time. Commissioner Schlehuber suggested Condition 5 be amended to read, “The applicant shall pay park-in-lieu fees to the City, as determined by the City Council,. . . .‘I - MINUTES October 14, 1981 Commissioner Schlehuber referred to Condition 34, and inquired as to Staff's position, with regard to the letter from the applicant on same. Michael Holzmiller explained that once it reaches that point, the plans will be reviewed. Staff would have a consulting firm review it, and they would advise how much it will cost, and the City would require the developer to deposit sufficient funds that the City would hold until the report was completed. He added that the developer would know how much it will cost. Richard Allen responded that the reason Staff is doing this is that it is a highly specialized field in geology and soils engineering, as well as oceanography. Staff also wants to ensure that the specialist is competent and will do an adequate job. Commissioner Friestedt suggested that the applicant submit a list of five names of engineers to the City, and Staff can then select the engineer for the job. Commission discussion reflected on alternatives to Condition No. 34, with regard to wave action and the location of the pool. Bill Hofman explained that the reason for Condition 34 was to look at the entire project, and its susceptibility to wave attack, which includes the pool. He continued that the reason for the added condition on the pool relocation is the particular location that it is proposed is the most susceptible to wave attack. In conclusion, Mr. Hofman suggested that the Condition remain as is. Commission concensus reflected their desire to have the opportunity to review an engineering report on the matter. The Commission approved the Notice of Prior Compliance Marcus issued by the Planning Director, and adopted the Friestedt following Resolution recommending approval of CT 81-351 Jose CP-182, based on the findings and subject to the L'Heureux conditions contained therein; and subject to the Schlehuber following revisions: Farrow Page 9 . COMMISSIONERS \ 1) Condition No. 5 to read: "The applicant shall pay park-in-lieu fees to the City, as determined by the City Council, prior to the aproval of the final map as required by Chapter 20.44 of the Carlsbad Municipal Code." 2) Condition No. 16 to read: "The final location of the pool shall be shown on the final site plan and approved by the Planning Director prior to issuance of grading permits, and shall be subject to approval by the Planning Director based on the findings of the engineering report ordered by the City under Condition No, 34, and on esthetic considerations." RESOLUTION NO. 1877, RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT TO DEVELOP 14 UNITS ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF OCEAN AVENUE BETWEEN THE PACIFIC OCEAN AND THE AT&SF RAILROAD. MINUTES October 14, 1981 Page 10 COMMISSIONERS 5. V-326, CORSO. Request for a variance of the Zoning Ordinance to reduce the front yard setback from 20' to 8' on property located on the north side of Basswood between Eureka Street and Adams Street and addressed at 1300 Basswood Avenue. With the aid of a transparency showing the location of the project, Bill Hofman gave the staff report, essentially as contained in the written staff report. Chairman Marcus opened the public hearing at lo:18 P.M., and extended the invitation to speak. The Commission recognized Mr. Ken Chriss, 2971 State Street, Carlsbad, Architect representing the applicant. Mr. Chriss spoke in opposition of the staff recommendation, and indicated that in order to make the house liveable, this is the easiest and best use for same. Mr. Chriss continued to address the necessary steps taken for a variance, which he feels provide the extenuating circumstances to allow them to go ahead with their applications for the other construction permits to make the additions to the residence. In conclusion, Mr. Chriss expressed willingness to respond to any questions. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at lo:23 P.M. The Commission adopted the following Resolution, denying V-326, based on the findings contained in the staff report: RESOLUTION NO. 1875, DENYING A VARIANCE TO REDUCE THE FRONT YARD SETBACK FROM 20' TO 8' ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF BASSWOOD AVENUE BETWEEN EUREKA STREET AND ADAMS STREET. APPLICANT: CORSO 6. CT 81-13/PUD-25, SCHWAB. Request for a 3 unit/lot tentative tract map and planned unit development located immediately east of Skyline Drive and north of Tamarack Avenue (extended.) The property is located in 3 different zones. The eastern majority of the property is in the P-C Zone, the middle the R-A-10,000 Zone, and a small western section is located in the R-1-15,000 Zone. With the aid of a transparency showing the location of the project, the staff report was presented by Bill Hofman. Mr. Hofman referred to the addition of Conditions 15, 16, and 17 under Engineering Conditions, which were distributed to the Conxnission at this meeting, and explained same. * Chairman Marcus opened the public hearing at lo:28 P.M., and extended the invitation to speak. The Commission recognized Ms. Lynette Cervantes, 17801 Cartwright Road, Irving, representing the applicant. She indicated that they are in agreement with all conditions, and expressed willingness to respond to any questions. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at lo:30 P.M. Marcus Friestedt Jose L'Heureux Schlehuber Farrow - MINUTES October 14, 1981 The Commission approved the Negative Declaration issued by the Planning Director, and adopted the following Resolutions, recommending approval of CT 81-13/PUD-25, to the City Council based on the findings and subject to the conditions contained in the staff report; with the addition of the following conditions to Resolution No. 1873: 15) High Ridge Avenue shall be dedicated prior to final map approval based on a right-of-way width of 42 feet. 16) High Ridge Avenue shall be improved based on a right-of-way width of 42 feet prior to occupancy of any new buildings. 17) The developer shall pay the current local drainage area fee prior to approval of the final map. Fire Department Condition No. 15 will be changed to Condition No. 18. RESOLUTION NO. 1873, RECOMMENDING APPROVAL OF A 3 LOT TENTATIVE TRACT MAP ON PROPERTY GENERALLY LOCATED IMMEDIATELY EAST OF SKYLINE DRIVE AND NORTH OF TAMARACK AVENUE (EXTENDED). APPLICANT: SCHWAB/SUNSET PACIFIC. RESOLUTION NO. 1874, RECOMMENDING APPROVAL OF A PLANNED UNIT DEVELOPMENT FOR A 3 UNIT SINGLE FAMILY RESIDENTIAL PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED IMMEDIATELY EAST OF SKYLINE DRIVE AND NORTH 0~ TAMARACK AVENUE (EXTENDED). APPLICANT: SCHWAB/SUNSET PACIFIC. 7. CUP-207, CITY OF CARLSBAD. This item was heard at the beginning of the agenda, and was withdrawn. 8. EIR 81-1, OCCIDENTAL. A public hearing to recommend certification of an environmental impact report for a project located at the intersection of Poinsettia Lane and Interstate 5. With the aid of a transparency showing the location of the project, Charles Grimm gave a staff report on the matter, essentially as contained in the written staff report. Commissioner L'Heureux expressed concern with traffic and run-off on Poinsettia Lane. Chairman Marcus opened the public hearing at lo:45 P.M., and extended the invitation to speak. Since no one wished to speak on the matter, the public hearing was closed. EIR 81-4, SANTA F'E COMPANY. A public hearing to recommend certification of an environmental impact report for a project located .75 miles east of-El Camino Real and north of Palomar Airport Road. With the aid of a transparency showing the location of the project, Charles Grimm gave the staff report, essentially as contained in the written staff report. Mr. Phillip Hinshaw, the City's Consultant, responded to Commission questions regarding the preservation of certain habitats. Chairman Marcus opened the public hearing at lo:54 P.M., and extended the invitation to speak, The Commission recognized Mr. Bob Ladwig, Rick Engineering, 3088 Pio Pica, Carlsbad, representing the applicant. Mr. Ladwig expressed appreciation for the work done by Staff on the project, and stated they are in agreement with the findings identified in the mitigation measures. With regard to the biology (riparian habitat) and width of the buffer, Mr, Ladwig stated that they feel that there should be a buffer; however, the precise dimension should be determined when a project is brought forward to the Commission. He added that they have no problem in leaving the condition as is, but requested the Commisson look at that one mitigation measure, and possibly change the language to reflect same. In conclusion, Mr. Ladwig requested certification of EIR 81-4. The Commission recognized Mr. Barney Rickett, Professor at the University of California, San Diego, Department of Electrical Engineering and Computer Science. Mr. Rickett referred to the UCSD solar wind radio antenna, located north of the project in the Dawson Los Monos Reserve, and briefly explained the affects this project would have on same. Mr. Rickett expressed concern that various industrial uses can cause severe interference with the solar wind radio antenna, and emphasized that the situation requires some assessment of the types of industrial activity that will be allowed on this site. In response to query by the Assistant City Attorney, Charles Grimm indicated that the mitigation measures regarding the antenna from the EIR for the Palomar Waste Transfer Station could be incorporated in this report. Discussion included the list of industrial uses that would cause interference with the UCSD solar wind radio antenna, concerns of property rights, and the financial affects of relocation of the solar wind radio antenna. Since no one else wished to speak on the matter, Chairman Marcus closed the public hearing at 11:08 P.M. Commissioner L'Heureux stated that the EIR is unacceptable in his opinion. He continued that the mitigation measures proposed have no direction, and suggested stronger language be used in same. -.
